Deficiency in services, breach of trust, cheating, fraud wrongful debit of premium of rs. 7, 9666.00

This is a complaint by a consumer, under section 2 (1) (C), in the consumer protection act 1986, in a written statement of complaint is filed here in writing to irda, describing an unfair trade practice has been adopted by the insurer, bajaj allianz general insurance co. Ltd. That she is consumer as defied under sections 2 (B) and 12 (B) is a person who can be termed as a consumer under the act is filing the complaint.

General home insurance policy purchased from bajaj allianz general insurance co. Ltd for consumer’s home purchased dated 06.07.18 full premium amount paid rs 7, 966.00, via the credit card.

G. This general home insurance policy was never issued or generated by bajaj allianz general insurance co., nor the debited amount of rs. 7.966.00, has the amount been refunded in case of erroneous billing.

That, dated 06.07.2018, the consumer, calls bajaj allianz general insurance co. Ltd toll free phone number[protected], and[protected], dated 06.07.18 soliciting insurances and gets connected to customer service agent by the name of rahul.
Considering that complainant had already purchased a policy of auto insurance from bajaj allianz general insurance co. Ltd., dated 28.06.18, hence consumer calls them soliciting for other two different policies a) travel insurance b) general home insurance.
The customer care associate of bajaj allianz general insurance co. Ltd mr. Rahul who managed and takes the consumer thru the process of online purchasing both policies assures the consumer, dated 06.07.18, that all due care has been taken and no issues will hinder the process of purchasing policies online.
Hence thus assured by an associate of bajaj allianz general insurance co. Ltd the complainant proceeds further and purchases two separate and different policies. The next policy the consumer, purchases on the same date 06.07.18, was a general insurance towards her home full payment rs. 7966.00 is paid towards the premium of general insurance paid and debited via credit card dated 06.07.18 at 10:04 am. After making two separate payments dated 06.07.18, the consumer is further reassured by the associate of bajaj allianz general insurance co. Ltd, mr. Rahul once again as she confirms with him regarding both policies and he re-assures her that the payment has been received and she will receive the soft as well as hard copies within two to three working days.

However when the consumer does not receive the copy of general insurance but only a soft cop of travel insurance that she starts calling bajaj allianz general insurance co. Ltd toll free number beginning 09.07.18 up to 18.07.18 four times (Audio recording available) and requests information on all three insurance policies.

To the surprise of consumer, she is is informed by the associates of bajaj allianz general insurance co. Ltd dated 09.07.18 named jyoti and sachin that they are unable to track the home insurance as she has not purchased the policy nor she has made any payment towards home / general insurance.

That the consumer since then then emails and writes several request to bajaj alliance insurance co. Ltd beginning 05.08.18, seeking a refund of the amount which has been deducted from the credit card. Contrarily bajaj allianz continues to fool the consumer by deliberately refusing to acknowledge that the client has paid towards the general home insurance. However the company repeatedly continues to overlook her payment debited and regarding general insurance while repeatedly keeps mailing the soft copies of travel insurance. That the consumer after being deceived by baqjaj allianz then re-insurwes the house dated 10.07.2018 with another insurance provider and accordingly inform bajaj allianz to refund the amount back to her.

That the insurer, bajaj allianz general insurance co. Ltd to refund the amount of rs. 7.966 which they have fraudulently charged from

D) to return to the complainant the price, or, as the case may be, the charges paid by the complainant;
E) to pay such amount as may be awarded by it as compensation to
F) the consumer for any loss or injury suffered by the consumer due
G) to the fraud of the opposite party;
H) to discontinue the unfair trade practice or the restrictive trade practice or not to repeat it to provide from adequate costs to complainant;
