Bajaj Finserv — Bajaj finserv bajaj finance cheating in policy terms and changing loan foreclosure charges from 0% to 4.6% without any prior notification

Dear sir/mam,

I am avinash from bangalore, and i have 2 personal loans with bajaj finserv.

The 1st loan account number is 404sal14495631. The loan was taken on 15th sep 2015 for the amount of rs.4, 65, 000 with a tenure of 60 months and interest rate of 13.5%. The 2nd loan account number is 404spl00440796 and the loan was taken on 29th march 2013 for the amount of rs.5, 00, 000 with a tenure of 60 months and interest rate of 15%.

I am a customer with bajaj finserv for more than 9 years and have been diligently paying emi’s for both these personal loans. I had also taken 2 consumer durable loans before this and have closed both the consumer durable loans upon the completion of tenure.

For both the personal loans, they had clearly told that there will be nil pre-closure charges and even my loan agreement reflects the same. While applying for loan, the bajaj finserv executive convinced me and committed me for the nil foreclosure charges benefit. They told me that due to nil foreclosure charges benefit bajaj finserv charges are high as compare to another bank.

I look both these loans for the benefit of nil pre part payment /foreclosure charges, and i was looking to close both the loans before july’2016.

On 1st june 2016, they sent mail/message that effective 1st june 2016, 4.6% charges applicable for foreclosure/pre-payment. So immediately called up customer care and they are also mentioning the same.

I visited bajaj finserv's bangalore residency road branch to clarify and close these 2 of my personal loans. I thought they will talk some sense compared to the customer care people, but sadly they are also sticking to the same information that going forward 4.6% will be charged for foreclosure above 25% of loan amount.

Now i have to forcefully continue the loans even though i have money to close these loans. Also i spoke to one of the agent who had coordinated with bajaj finserv when i bought these loans. She spoke to someone in higher management in bajaj finserv to understand why they are doing this. She got a response that, since other banks are offering attractive interest rates now (Hsbc - 11.99%, hdfc - 11.49%), it seems many are doing balance transfer of the bajaj finserv loans to these banks to avail attractive interest rates. So bajaj finserv is incurring huge loss as people are moving out to other banks after paying their first emi, by availing this 0 foreclosure policy. So to cut down on this, they have made the policy changes it seems, which is clearly unethical and cheating old customers.

If reputed company such as bajaj finserv are changing the policy terms they should notify customers at least 15 days prior, so that customers such as me can think of closing the loans before june 2016 to avoid foreclosure charges.

Please help me in this case, as they are cheating me on the basis of showing and removing of nil foreclosure charges benefit.

I also understand that Bajaj is charging this fee because customers r taking balance transfers to other for at low interest ... but some genuine people who want to close it are also being affected...

All I want to insist to bajaj is that u charge the customer who are taking new loans on or after June 1 & those who r opting for balance transfers to other banks, but not to the one who already have taken jus by believing yr words.

Trust that this makes logic and reaches the top management...
Even I have the same issue. I have written mails to them after no proper response over calls.
I have clearly stated that I am not responsible to pay the additional charges except my outstanding. Awaiting a reply. If they do not agree, I am planning to take the case against them and also with Ombudsman.

See if that would help you. Good luck
I found the document contains you may be charged 4 percent plus for prepayment. But on phone they said no precessing fee. Such a looser. I am even terrified buying something in Bajaj electronics. Cheats.
Thank you for your comments. Please keep me informed if you receive any update from them. Many Bajaj finserv customers are suffering due to this. We need to raise it and oppose this until they rebook at their decision.
Same problem here, I was really shocked to see their mail on foreclosure charges on 1st June'16. No prior intimation and foreclosure charges levied with immediate effect. Absolutely unethical and trying to loot the existing consumers. Have written to their grievance mail address but no response yet.
Loan No[protected]

Let me know how we can complain to the Govt. regulatory bodies.
who is the governing authority for such cheats ? They have been deducting extra EMI from me for 2 months now and customer care is pathetic, neither greivience cell responds nor customerservice head !!!
Anybody got any response from their Grievance Redressal team? I haven't got any response yet.
Grievance SR number - SRN05625428 raised on 4th June.
I am not positive that they will look into this concern. They are least bothered about the customer service. I am not too hopeful of getting a solution to this. Forcibly, I have to continue my loans. Hope we have some stronger laws in future to penalize these companies.
I am also waiting, now I have raised the matter to head of customer operations, though i know there wouldn't be any response. Still for a matter of proof.

The next step would be to raise to banking ombudsman.

Actually these guys reply within 48hrs and also call. I have experienced earlier. But for this issue the entire organisation seems to be deaf and dumb.

Am not gonna leave this. And neither I'll pay them for foreclosure
Hey all, further to my mails, as I didn't get any response I called them.back
The customer care guy was kind enough to answers and listen patiently. The reason he told for mails not being responded is due to some technical issues in mail server as they have 1000s of mailed piled up ever since this charges were implemented
He however gave positive hope that charges maye waived off soon (though he didn't commit abt it). There would be official confirmation about same asap. So that's the update. Keep hoping guys.
Hi. Thanks for the update. It's great to see that you are persistent in your efforts. Keep up the good work. Your action will impact multiple people like me and you are fighting for us all. Let me know if I can be of any assistance with this. Thanks again.
It seems there is no Ombudsman for hearing complaints against NBFCs. But you can approach the concerned Regional Office of the Department of Non-Banking Supervision for a resolution of the complaint.
Bajaj Finserv should come under the Jurisdiction of the below Regional Office address, assuming they are registered with them.

Keep up the spirits avinash ji!!
Right Arun ji, there is no direct ombudsman, but there are some internal bodies through which we can raise the issue. Am doing an r & d of it. Anyways, u too keep us updated. But I hope Bajaj themselves will solve this as customers have piled up with complaints against this.
Yes I have also raised the query with RBI, https://www.rbi.org.in/scripts/helpdesk.aspx. You guys can also try it out.
Same is the case with me. In February, I had applied for personal loan of Rs. 5 Lakh. At the time of loan approval, it was mentioned that, There will be nil foreclosure charges for early foreclosure of the loan and it can be done after paying first EMI. For this benefit only, I had decided to go ahead with Bajaj finance instead of doing it through any other bank.

Now I closing the personal loan by paying outstanding amount, I am charged Rs 22548 as Foreclosure charges(mentioned in the Foreclosure letter) which are 4.6% of the outstanding principal. When I queried customer care executive about the same, they just say their policy has changed prior 1st June. That does not solve the purpose. I had to pay unnecessary penalty for the early foreclosure which is against the mentioned in the loan approval mail.
There is no need to pay foreclosure charges as per the agreement. Just keep writing to the Grievance Redressal and Customer Head. You might get a Foreclosure letter without additional charges applicable for next 7 days.
Hi friends.. Did anyone receive any positive update from Bajaj Finserv .. I had again called Bajaj Finserv consumer care, but they are sticking on to same foreclosure details..
I got the foreclosure letter with zero foreclosure charges and have closed the loan by paying the outstanding balance. As I mentioned earlier keep writing to their Grievance Redressal team and customer head, they will issue your foreclosure letter if you are willing to close it.
