Cleartrip — cheated us after taking the money

It is a fact of the case, on the 20th april, 2018 at about 1:30 a. M., i booked a room in pelling through your aap for 3 nights (19th may to 22nd may) and paid the entire hotel room's fare through my debit card just after i booked a deluxe room in sai kripa hotel gangtok for 4 nights, that is on and from 22nd may to 26th may 2018 and subsequently i paid the entire hotel charge for 4 nights that is 8467 through my debit card, as my return of journey from siliguri to kolkata on 26th may 2018 but suddenly in the last saturday, 21st april, i was just surfing ur aap for the car service and suddenly i noticed that the rooms in the hotel sai kripa, ganktok has been booked from 22nd april to 26th april instead of 22nd may to 26th may. I became astonished. By seeing the booking details i promptly rang to the hotel sai kripa to enquire the matter and then one, mr. A. Chakraborty, as a manager of the hotel, stated me to talk immediately to the cleartrip person of kolkata and give me a number. Then, i promptly go to your aap and wrote the entire fact in the "write to us"option. But getting no feedback from there i rang to the given number by the hotel manager, one lady, picked up my phone and whenever i am going to start my problem to her as because she is a concern officer of cleartrip but she refused to hear anything from me and along with bad behavior she started malaine me and humiliate me by using abusive word and also straightly refused to help me but i requested several times and after that i could communicate the entire facts to her over the phone by bothering her humiliation and criticizing and requesting her good self to help me out several times she then given me a mail address (Hotelteam. [protected]@cleartrip.com) and then i again write the entire fact and send a mail to the given address promptly attaching the voucher and trip id as well as booking details and instantly i communicate the entire fact also to the hotel manager over the phone and also via massege and also requested him to consider our problem sincerely and to shift our booking from april to may but he straightly refused to do any co-operation with me and turned into violent by saying, "all rooms are already been sold out in the month of may, there's no room left in the hotel for shifting" and thrashing on me and warned me not to contact with him and stared doing misbehave with me and trying to malaine me and humiliated me by using filthy language and by crossing the last stage of dignity he cut the phone. Then i text to the lady to help us out but both are starting misguide me and malaine me and criticizing me and giving mental harassment to me by continuously misguide me and started playing with my problem and treat me like a joker and started to enjoying with my problem on sitting in the desk of consumer support and refuse to do any help which break the rules of consumer protection act. After facing all of these i along with my family spend the whole night in depressed and in troma. Then the next morning, 22nd april, 2018 i started searching on the google about the cleartrip helpline and there i got a number and instantly i called there and a lady picked up the phone and by hearing entire fact again, as like everytime she refused to help me again and started using abusive words and by bothering all the humiliation i keep continue requesting her and then she unwantfully gave me a mail address again ([protected]@cleartrip.com) and i instantly wrote a mail on the given address. After doing the mail i again called in the same number and there again another lady picked up the phone and again i stated all the facts. It is indeed very painful that everytime new new person came to the call, and they are holding my call intentionally and misguided me and treated me like a ping-pong ball and wasting my valuable time since last 2 however, she assured me and commited me that if the hotel rooms are available in the same hotel, then cleartrip can transfer the booking from april to may and she again told that she along with her back team will talk to the hotel manager and put up my call again on hold by a long time, she started do misbehave with me, criticizing me and told me that, "it is not possible as because there are no room left in the hotel, it is only then possible if the rooms are available in the hotel. Then, i requested at least to refund my money and as it is mentioned to the t&c in cleartrip that after 24 hours of booking and also within 24hours of cheakin, refund is possible, but there 300 rupees charges apply, that's why i told us to refund my money but she continuously told me the negative words and misguided me and also break the rules and regulations of cleartrip and doing mental harassment to me and laughing at my condition and i felt mentally uneasy and then i gave the phone to my daughter but that lady also doing such hellfull behavior with her also by using filthy language and offensive words and refused to hear our problem and hang up the call. Then, i started again searching in google for the details and there i noticed that from 24th may to 28th may rooms are available in the sai kripa hotel, that means along with the concern hotel manager the customer support team are continuously telling false and concocted story since last 2 days to harass us and malaine us. Then, i instantly called again to the given number of cleartrip and stated the fact that rooms are available and requested their good self to help me and shift my booking, but they refused to do such things and they started humiliating me and thrashing me left and right by using abusive words and they straightly refused to maintain the rule of cleartrip and cut the call. Doing such kind of things with me they are spoiling my valuable time as well as they tried intentionally to harass me.in the afternoon my daughter rang to the customer support desk and at that time one manoj, from customer support desk committed my daughter that as the rooms are available in the hotel sai kripa so, he will easily arrange and to provide us the room in the month of may as per our need and also ensured my daughter, he will send the necessary documents to the concerned hotel through a mail for booking our room there and also he will give us confirmation regarding this booking within 24 hours after that, we became very happy that the company has really realized our situation and they can give us a well protection in the eye of consumer protection. The person manoj, also assured my daughter that he would send the mail to the sai kripa hotel within an hour, so naturally we entrusted upon him as a valid customer and after 2 hours later i called the manager of the hotel and he admitted that he got the mail but he could do nothing to help us out, and stated me that he will send the counter reply to the company. And the next day, 23th april 2018, at about 9:30-9:45 a. M i again rang to the manager of the concerned hotel with a humble request that i along with my wife and two minor daughters will travelled to the gangtok after returning the pelling, if we will not get room then we will be in a big trouble but he straightly thrashing me that,"i can't give you any room, in spite of the rooms are available in my hotel and he also stated me, "i am not bound to obey the dictam of cleartrip company, and cleartrip can't instruct me, you can do anything in against of me, i have good contacts with police and local people, you and cleartrip company can never ever do anything in against of me, i am a very influential person of this area, if i think i can't enter you to gangtok, then my daughter and wife requesting with folded hands over the phone that since last 2-3days requesting you to shift our booking but you intentionally misguided us and also spoiled intentionally 2 days and now we are very much afraid to enter into gangtok and also think that any unwanted incident maybe happen in our family during the stay at gangtok or pelling. After that again i, along with my daughter called to the customer support desk and again requested them either to refund to my account or to arrange a room at gangtok. But it curiosly enough that your customer support desk played the same role to us with a negative approach. We again requested to them that as per your t&c i communicated with verbally and also in written within 24 hours of cheakin (Wrongly booked on 22nd april to 26th april) but your people and your hotel manager co-jointly made a conspiracy and frodulently cheated us for their wrongful purpose and gains, as my money has already bren transfered to your account. After that getting no other alternative i lastly rang to the lady ([protected]) and requested her also to help us out but she turned violent and passed the phone to one the jagmohan, who introduce himself as a zonal manager of your company, he again like the other people of the company tuned again that he can't do anything after 10-15 minutes conversation over phone it has come to light that your company can't do anything for us. After 3days several conversations and correspondence between your company and me as well as the manager of the concerned hotel ([protected]) it is very much crystal clear that you and your people are not contious about the customer care and protection, your main moto is to grab the money of common people/consumer/customer and to render any service towards the customers. That is clearly a breach of trust and also negligence of service under consumer protection act and also to cheat the people in questions of tranjuction of money so, under the above facts and circumstances you and your people along with the concern hotel manager (Your associate) are whole responsible for commiting such offence to the general people within the provision of specified law. You and your people just not only cheated us but also giving us the continuous mental harassment and agony me along with my family which can't be compensated by any means. And it is to be noted that you, your people and your accosiate neclect us and intentionally defamed us by which i along with my family members lost a huge defamation by your willfully act and activities. Your are hereby informed either you refund the money and also give the compensation for mental harassment and wastage of time and as well as defamation in the tune of 2 lakhs within a week, otherwise i will have to take legal action against all of you, it will be treated as notice to you.
