Club Jiva — wrong presentation of facts by club jiva team in goa

I was on vacation with my wife and daughter in Goa on 1-Jan-2019. We were approached by an agent of Club Jiva near Baga beach claiming to give gift scratch cards on celebration of 5th anniversary of Club Jiva. We were informed by him that on completion of 5th Anniversary of Club Jiva, the company assures a gift which could be an iPad, an LED TV, 10k in cash or free vacation and the terms and condition was to just attend a 45 minutes orientation session at La Sunila so that facilities could be demonstrated to us. Our daughter was too excited about the iPad and on assurance from the agent, we thought of paying a visit to the hotel, just for our child’s sake.

We were asked to show ID Proof and Credit Card to claim the gift. When we asked why credit card is required, the concerned mentioned that the same is required for the Visa/Mastercard team for debiting the gift amount to the Bank with which we hold our credit Card and that his team has tied up with few major banks.

The receptionist has checked the id proof and credit card details and upon which we were informed that we need to attend the presentation for an hour.

After we stepped into the meeting hall of La Sunila hotel, we were introduced to a Sales agent named Siddhanth and he took 4 hours discussion even though we told that the child is hungry and need to have lunch and requested to finish off the presentation in 1 hour. We came to know only at the end of 2.5 hours that Club Jiva wants us to buy membership and offer is valid only till 1-Jan-19 on account of the fifth year celebration

We were given a false picture that the Club Jiva membership which would entitle us to cheap accommodation in 5-Star properties across the world and they are under the umbrella of DEA and have resorts worldwide, and offers holiday ownership and we can also rent out the property in case of not able to make out for vacation. Mr. Siddhanth also claimed that if we make a booking with 25% of the amount, we are eligible for reservation to any of the resorts of our choice on the same day itself…On informing that we need reservation for our anniversary on 2nd Feb 2019 nearby Delhi, the sales agent Siddhanth, assured that the same is being taken care of and he will place the request for our booking same day itself in Ramada Hotel, Gurgaon and all we need to check with customer care of Club Jiva is the the room number of the hotel a week to 10 days in advance..

Finally with the misrepresentation and false commitments, we were sold a membership of Rs80, 000 for a tenure of 5 years. After paying up Rs. 30, 000 through my debit card, to our shock, they came up with an agreement that rest of the amount to complete 50% of the amount needs to be paid by 5th Jan.. On informing them that we will not be able to pay that much amount in near future, only after July we will be able to pay rest Rs. 10, 000, they said its perfectly fine, you are our valued customer, hence maintenance amount of Rs. 6991 and rest 10, 000 can be paid by July…We just went by word of mouth and they gave us another shock when they gave an excuse that i-pad cant be given to our daughter as it is out of stock and instead they gave us a free holiday voucher which they claimed, we can avail any time we would like to.. We could sense something was wrong, but by then payment of Rs. 30, 000 has already gone. Mr. Siddhanth handled the situation very diplomatically by approaching the customer care people in front o[censored]s, asking them to book the Ramada hotel for us for 2nd Feb and they said its already been taken care of…Not only this Mr. Siddhanth shared two of his personal numbers with us and promised to give us a call around mid-week of January to confirm the rooms booked in the hotel.

After reaching Delhi, I tried calling up Siddhanth, but both the numbers were switched off. And I got a vague message later from him that he is in his village so can't talk, I am wondering WHY! On failing to reach him, I called up and followed up with Customer care since 16th Jan, but they always gave an excuse that our request is under process and it will surely be done for 2nd Feb.

Today when my wife called up to enquire about the status, and spoke with Namrata, Jaydeep Shetty and Joyita, Joyita apologise to my wife for the false claim by the sales agent Siddhanth and later on she was shocked to learn from them that booking will be confirmed only after the payment of rest of Rs. 10, 000 to complete 50% of the amount and also needs to pay Rs. 6999 towards maintenance…On my wife’s insistence to Mr. Jaydeep that she wants to speak to Mr. Siddhanth as he made false promises and has kept his phone switched off, Mr. Jaydeep re-assured that he will call back in 10 minutes and put Siddhanth on con call but never got a call from Club Jiva..

We have realised that we were cheated by club Jiva in a professional way and duped us of our money and is trying to extact more money from us and on reading the feedback of people in other sites of people sharing their bad experience with Club Jiva, we realised there are many innocent people like us who has been a victim of such false claim..

We lost trust and interest with Club Jiva and please refund the amount of Rs.30, 000 for the misrepresentation of facts with the sole intention of duping innocent middle class people .

It is highly unethical behavior towards us and chose not to continue our association with such company and need refund of my amount immediately.

I humbly request the higher authorities to kindly look into the matter as it’s a serious concern of cheating innocent people by making false claims, false promises and misrepresentation of facts.
