Club Mahindra Holidays — fraud by club mahindra- I wanted my money back

My name is Shanu Kumar Aggarwal. I am a Chartered Accountants and working in MNC. Club Mahindra did fraud with me. I am chasing Club Mahindra since last 15 days on member experience but I am not getting any response. Even I have written various email so far to member experience and CEO ( Mr. Kavinder Singh) in this reference but they are not providing me solutions. Club Mahindra did fake commitment at the time of selling membership and kept my hard earn money. When I asked on Member experience if you can not fulfil your commitment made by sales representative that return my money back so that I can plan personally holidays for my kids vacation. They didn't response so far to me. I am really unhappy and upset. Club Mahindra is doing harassment and kept my hard earn money. Club Mahindra has spoiled whole vacation of my kids. I will proceed for legal action against company for the cheating and fraud if Club Mahindra didn't return my hard earn money back. I am surprise that a listed company can do fraud. I am writing full details of case below:

Club Mahindra Membership sold by Club Mahindra Sales person ( Mr. Rahul Singh, Mobile No. +91 [protected], WhatsApp No. +91 [protected]) on 18th May 2019 in an event organized by Club Mahindra team in Gurgaon at Infinity Honda Showroom ( Sohna Road). The event was organized to provide a free vouchers of 2N/3D in Club Mahindra resorts but I bought Club Mahindra membership on the basis of offered provided to me by Rahul Singh.

Rahul Singh had explained 10 year and 25 years plan with option of Purple, Red, White and Blue season. I was not convinced with the Club Mahindra plan. Then he offered me an attractive plan with 25 years membership with option of white season and studio apartment. The below plan was explained to me:

1. 7N/8D in CMH Resorts Complimentary
2. 7N/8D in RCI Hotels Complimentary
3. 4 vouchers of 2N/3D
4. Food Vouchers of INR 7, 000/-
5. Yatra Voucher of INR 6, 000/-
6. Cash Back of INR 4, 500/- ( will be redeemed from Down Payment)
7. Book my Show Voucher of INR 2, 000

He also offered me that I can enjoy 6N/7D immediately using my 3 vouchers ( as mentioned in above point No. 3) as member in studio apartment of Club Mahindra Resorts after making down payment. He made the below plan for me for these 6N/7D:

1. Naldehra- 26th & 27th May 2019
2. Mashobra- 28th & 29th May 2019
3. Kandaghat- 30th & 31st May 2019

Club Mahindra will also provide me pick and drop facility from Chandigarh to Naldehra resorts, Naldehra resorts to Mashobra resorts, Mashobra resorts to Kandaghat resorts and Kandaghat resorts to Chandigarh drop at the end of trip.

I was convinced with above plan and asked to explain payment plan.

Further, he explained me about the payment plan. He told me the total amount would be payable of INR 443, 400/- for 25 years membership with option of white season and studio apartment. This payment schedule would be follow as per below line:

1. 10 % Down Payment after deducting Cash Back ( as offered in above Point No.6) ( INR 44, 340- INR 4, 500= INR 39, 840)
2. Three Post dated Cheques of INR 11, 309/- dated 07th July 2019, 7th August 2019 and 7th September 2019.
3. Further, No need to pay till 2 years. Rest EMI would be started after 2 years in a gap of 6 months but would be cover in 48 months ( 4 years) for rest amount after my satisfaction with Club Mahindra service and experience.
4. No need to pay anything rest.

After the detailed discussion, I decided to purchase Club Mahindra membership and paid Down Payment of INR 39, 840/- immediately. He filled a form No. ( JAN/2019/25YRS/250561) and given me member copy.

He asked me to provide copy of my PAN, copy of Aadhar of myself & my wife and three post dated Cheques of INR 11, 309. I immediately given my copy of PAN and forwarded copy of Aadhar of his Whatsup No. ( as mentioned above). I requested to him to collect 3 Posted Dated Cheques from my office on Monday on 20th May 2019. He sent his person Mr. Anas ( Mob: +91 [protected]) to collect the Cheques on Monday. I did handover three Cheques ( Cheque No. 216461, 216462 & 216463 of my Citi Bank Account dated 7th July 2019, 7th August 2019 & 7th September 2019 respectively) to his person.

After that I called him to ask about my membership and trip plan. He assured me booking and membership would be completed in a day but I didn't receive any details. I was continuously chasing to him. He was not picking my calls so I started to chase him on his Whatsapp No. but didn't get any response. He was writing every time on Whatsapp that I am out of Delhi. I understand that there might be any challenges in his side and not able to do bookings. I asked him about it and he explained me " Sir I m trying but availability nhi mil rhi h..June me aap plan kar lo pls" on Whatsapp.

So I rescheduled my plan as per below and sent to Mr. Rahul Singh:

1. Naldehra- 23rd & 24th June 2019
2. Mashobra- 25th & 26th June 2019
3. Kandaghat- 27th & 28th June 2019

On 25th May, I received a message from Club Mahindra regarding my membership no. generated ( Member ID 2870835) on my registered mobile no . I did login using this Member ID on Club Mahindra website. I asked about to complete few details and agree/disagree with filled up detailed. I noticed that details which was filled over there doesn't match with the plan as explained to me. I called to member experience on 27th May 2019 on [protected] regarding to correct the details. Mr. Jafar ( Holiday adviser) of Club Mahindra spoke with me. I explained him about the discussion with Mr. Rahul and asked to correct the details & provide me the positive solutions. He said that he can't do booking till membership get activated. I asked him to please correct the details first then I can agree with all filled up column. He asked to me write email to [protected]@mahindraholidays.com with mentioning all promised done by sales person.

I had attached below documents as a proof which were self explanatory to clarify you about the discussion with Club Mahinda Sales Person:

1. Copy of paper ( in Mr. Rahul Singh's hand writing) on which offer was explained.
2. Copy of payment slip of INR 39, 840/- ( after adjustment of Cash back of INR 4, 500/-).
3. Member Copy of Form where also mentioned about Food Vouchers of INR 7, 000/-, Yatra Vouchers of INR 6, 000/-, 7N/8D in CMH and 7N/8D in RCI.
4. Email from Rahul singh where he mentioned about down payment and 3 EMI which has already been collected through post dated Cheques.

I have email all details to member experience and called various time but neither they are providing me solutions nor they returning my money back.
They always said that we are forwarding your complaint to our Mumbai complaint department and you will be getting call from complaint department. I didn't receive any call from complaint department of Club Mahindra as well. It appears that all Club Mahindra teams are involved in this scam.
