Sub: refund and cancelation of membership due to cheating, misrepresentation and fraud

My name is vivek gupta member id is 2696504

I had called to sterling holiday resorts (India) limited and club mahindra holidays for getting membership and i preferred to go with club mahindra because of well-known and brand name in market in hospitality sector.

But unfortunately, your brand name and reputation is going to down due to sales persons behaves cheating to customers.

Mr. Abdus & mr. Rahul sale representative (Channel sales) on behalf of club mahindra visit to our home (Delhi) at april 2016 to explain the benefits and reason to take the membership.
I have written this letter due to the below false representation and cheating to customers.

1. First false representation:
The demo video shown us the study apartment (1 room+1 drawing room + kitchen)
He explains us that the studio apartment is sufficient for one couple and one adult (3 person)/2 children (No age limit explains for children).
Based on their video, we go for studio apartment.

2. Second false representation:
Mr. Abdus offers us the below 25 year membership with the below offers:
A) 4 vouchers (8 night - expired on july 2016)
B) ₹ 15000 discount (7500 immediately, balance cheque /emi adjustment 7500)
C) 5 complementary nights
D) rci membership
E) ₹ 5000 rcv
F) 48 month emi (₹ 9070/ month)-convert to 36 month emi (₹ 9070 /month) after payment of 3 emi.
G) 60000 points to be credited
H) extra charges for additional members-₹ 500/- person

3. Third false representation:
No information about the amc charges
Based on that commitment, total cost offer us ₹ 3, 54, 300 (Without interest), i filled up the form no dec/2015/25 yrs/111977 dated 8th april 2016 (As attached for your reference)
Mentioning all information (Name, address, mobile no, co applicant name, address proof, credit card detail etc.) and i have paid 10% dp of ₹ 29, 490 (After deducting ₹ 7500/-) dated 8th april 2016
Attached the mail receive on 21st may 2016 form abdus.
But till 5th june 2016, nether i had not received membership kit nor any updation of my application even continuously follows up with mr. Abdus & mr. Rahul.

9th june to 17th june i have send mail for cancellation of my application and refund (Mail attached) to below mail id:

After long discussion with mr. Abdus, he explained that basic information (Address, mobile no and co-applicant name) was wrongly entered in club mahindra system.

He insists to wait for a week and don’t cancelled the application, and i accepted
Finally, i received kit without verification from miss pooja working in below address and deliver to my address. Dated 20th july /2016
Unit no.34-45, 01st floor,
Tdi centre, plot no.7,
Commercial complex, jasola,
New delhi,
Delhi-110025.

I am surprised that my application was not correct uploaded in system and after 3 month, i had received my kit, how can june & july emi was due, but i have request to give some time to release the payment.
7/06/2016- emi due - ₹ 9070/- (How can be due if application is processed on july)
07/07/2016- emi due - ₹ 9070/-

On the same month of july, my emi was realized, and i was not question how in july emi can be reflect.

My emi was realized on timely (7th of every month) from july 2016 till jan 2017 (7 month).

Further account department from jasola office called us to adjust the cash back of ₹ 6000/- from june emi due, i was surprised to hear that my cash back is ₹ 6000/- instead of ₹ 7500/- (As committed)
And i also paid june pending emi of ₹ 9000/- (18th jan 2017)-mail attached

I had already paid
Down payment = ₹ 29490/-
June 2016 to jan 2017 (Emi ₹ 9070 /month)= ₹72560
Total payment = ₹ 102050/-

I had called to mr. Abdus to clear all pointed committed but no response, finally i have decided to visited to jasola office 10th jan 2017 about all concern which is pending as below (Mail attached)

1. Refund of ₹ 7500/- pending
2.co-applicant card not yet receive.
3. Points of 60000 not yet receive.
4. Voucher handed over for replacement against new one.
5. Rci kit not yet receive.
6. Conversion of emi from 48 month to 36 month without change of emi amount of ₹ 9000.

Miss pooja is attending us and ensure us to resolve all issue.

When i booked resort in udaipur and kumbhalghar date 26th jan 2017-27th jan 2017, (5 person)
Room was allotted for 2-hu in udaipur but 1-studio apartment & 1-bhk in kumbhalghar
My family was shocked when i entered in studio apartment. (1 room+ 1 kitchen)

Service of kumbhalghar is worst services

Again mr. Abdus tell us that no need to pay for extra person, he (Mr. Abdus) will send the approval to resort but no mail send by mr. Abdus. And tell us to pay the extra amount of ₹ 2800/- each resort and he will give us extra complementary 5 night.

Extra charges per person was ₹ 1500/- instead of ₹ 500 (As committed)

Immediately i visit to helpdesk in kumbhalghar and raised our doubt, they say that studio apartment is one room with kitchen only.
After return back to home, i had request to mr. Abdus to meet us urgently either my home or office but he was not interest to meet us, finally i had visit to jasola office in delhi 9th feb 2017 for raised our complaint and again miss pooja & mr. Ashwani attend us.
I am socked again to hear that mr. Abdus was left the company. And inform all issue to ashwani but he refuses to provide us solutions.
Based on above facts, i observed that mr. Abdus is providing false information, misrepresentation, and cheating to customer.
I am frustrated and expect form club mahindra to resolved my problem. Otherwise i will take final strong action to file a complaint to consumer court for harassment cheating and for false representation to customer.
I want to get back my full refund and cancelled the membership
I will also circulate this issue to social media and news as well.
