[Resolved] Club Mahindra Holidays — refusal of full refund for withdrawal of application for club mahindra membership

We got a call from club mahindra executives after purchase of a car for an offer package of 2nights/3 days stay that was to be availed within 6 months.
On repeated calling from their side, me and my husband decided to visit their offer venue at radisson blu, dwarka, sector 13, on 30th september 2017.
Along with the offer, more stress was given by mr vinay sing (Holiday consultant-sales) and mr anand to apply for the club mahindra membership.
We were given lucrative offers and promises and were told that the offer is valid only for that day and should we wish to apply we have to make payment of 10% of the membership amount before leaving and that day itself.
At that time, me and my husband had clearly stated to them that we have an infant and would prefer staying in club mahindra resorts near to the airport which doesnt need much travelling.
Their hardcore marketing tactics made us fall into the trap and we ended up paying 10% of the membership amount of inr 37220.
They were not transparent in revealing the location of their resorts and after coming home we searched and realised that reaching club mahindra property would take a lot of travel from airports.
Also we had very clearly stated to them that we have already visited most of india and are more interested in availing the membership facilities for overseas travel.
At that time mr vinay and mr anand told us that club mahindra has acquired many properties worldwide, though their brochure has mention of properties at only 4 places — bangkok, dubai, austria, malaysia.
On enquiring about the same, mr vinay replied that these are old brochures and the newly acquired properties are put up for printing in the new brochures. He was asked to mail us the overseas properties which he did after multiple requests.
A verification call from mumbai was made to us, and the lady over the phone was also asked about the overseas properties for which she replied that club mahindra is spread worldwide, and that she will mail us the same, which never happened.
After all these developments, me and my husband decided to withdraw our application from club mahindra membership.
We wrote an application and mailed it to the concerned club mahindra executives to cancel our application and refund us the amount of inr 37220/ in full as per their clause 8.1 part c mentioned in their membership rules.
There after we have been recieving multiple call from different club mahindra executives stating vague reasons and refusing full refund.
There has been a series of exchange of mails between us and mr vinay sing, anand kumar, shubham rai, member relations club mahindra.
According to their withdrawal policy full refund is promised if we withdraw within 10 days of application.
Now they are coming up with vague resons like withdrawal application has to be sent from the 'registered' mail id, though they have both the applicants and the co-applicants mail id's with them, and have themselves previously contacted us on both.
Also, as per their telephonic conversation on 5th october 10.15 am, application cannot be withdrawn on personal grounds, which is no where mentioned in their membership rules.
We believe what they are trying to do is to buy more time by giving mails from different people so that the first 10 days are passed and after that they will simple refuse to refund stating delay in communication.
Also, i believe that the reasons stated by us to them are no where personal.
We want our money to be refunded to us at the earliest and also club mahindra should also be levied heavy fines for refusing to refund peoples hard earned and rightly due money,. Nothing can be said about them besides cheaters and would never recommend it to anyone.
