Ananya Educational and Social Welfare Society (Regd.) — Illegal Construction and Encroachment
This is to bring to your kind notice that an illegal construction raised by Kawal Singh S/o Late Ram Swarup, R/o Village Rangpuri, Post Office Mahilpalpur, New Delhi, that the building has been newly built not only ground floor to third floor but fourth floor has also been built along with a mumty whereby the height of 15 meter is also violated. The building has been projected by four feet outside the plot towards the road on which proper bathrooms have been made creating a public safety hazard and violating all the construction norms under all laws despite the fact that the building is in a lal dora area.
1. The total construction is illegal and without any sanction from any govt. department or agency. New water boring has also been illegal carried out to the level of 400 feet deep and a submersible pump has been installed. Besides two new water connections have been taken from the Jal Board and no payment has been made to the Jal Board for new connection. The old water connection has been used for the construction purpose. Due to various illegalities all the water connections require immediate disconnection and suitable legal action in the matter. There is totally violation of ruling of the hon’ble Supreme Court.
2. The plot on which the old house has been demolished was existing as house no. 156 on khasra no. 599 in the name of Rajbir Singh S/o Kawal Singh. Rajbir singh had expired in 1982, but the electric meter is continuing in the name of Late Rajbir Singh S/o Kawal Singh misused the electric connection for construction purpose and no temporary connection was taken for new construction Kawal Singh took four new electric connection on the same khasra no. 599 instead of showing the house number through the electric meter of house no. 156 and installation of new connections on khasra of 599 are at the same location. The electricity department has been misled, no payment has been made for new construction, the new connections could not be installed in an unauthorized building and therefore need to be disconnected forthwith.
3. The building having a projection of four feet on the road and with full construction is a major safety and fire hazard besides being totally illegal and needs immediate demolition. This is a public hazard and jeopardizes the safety of the entire village in case of any untoward incident.
4. The construction has also caused breakage of a neighbour Deep Chand a senior citizen and retired from AIIMS living along with his old wife, 18 inches wall adjoining the illegal construction and the owner has also built projections towards his house for which, he had not given any permission written or verbal is totally illegal. The 18” wall of Deep Chand is coming up on 2nd floor has been used for raising his wall by Kawal Singh which is totally illegal. These acts are an encroachment on his privacy and his property.
There cannot be any projections on Deep Chand’s land irrespective of the fact that the area is available due to his house being only double storied. Serious damage has been caused to his house making its structure weak causing mental agony and distress. Some of the shuttering on his side is still hanging and some has already fallen on his side of the plot/ second floor roof. The 4” wall raised towards his side of the plot is lying almost naked with improper placing/ spaces in between and the bricks are likely to give way during rainy season/thunder storm/minor earth quake and is dangerous to the extent of a real strong possibility of causing grievous injury/death to him and his family due to the utter negligence of the owner/builder.
