[Resolved]  Builders — Nuisance created by neighbour

Sir/Madam.

I am staying in a society in Pune. Some builder has bought our neighbour's bunglow. He is not statying there. Huge grass has been developing every few months in his plot and we call him up to clean it. That place has become unhygenic and not safe from kids perspective. Our kids are not able to play in our area because of possibility of snakes and insects. Their attitude is why we should spend money in cleaning that place? we are planning to build an apartment there. Its our place, we wil do whatever we want.

Last week we heard their tap opened inside the locked house and even after calling them they did not send anyone. When the whole city is facing water shortage, such people shows careless attitude.

Even after repeated requests they are not listening. Is there any rule to stop this?

Builders — Black market

As we all know, the property rates have crossed the sky limit. Builders are taking disadvantages of this situation. I visited many undergoing projects in Thane areas to purchase a home but I was shocked when builders asked about heavy hard cash (black money) from me even though I am eligible to get home loans from banks. This shows that builders are making fool around helpless customers and trying to make black money from it. I request all home seekers not to entertain these shameless builders and government to look into it.

Dear Sir,

We have purchased flat five year back at prabhu appartment newly constructed appartment at flat no404, prabhu vashyam, ahmedabad from builder Shri jagdish madhu (sailent partner but main accused) & their partner name to be received

There were problems regarding Provided " LIFT " Arrangement. LIFT Provided by buider is inbuilt by low quality materials, even after full payment given by us. Only money is not a matter but main problems is there may be accident due to low quality of LIFT.

The flat owners many time faced minor accident due to imbalance lift, but there may be a serious accident. All upper Flat owners maximum suffer and use lift with a fear.

We have verbally complained via mobile phone to builder for repairing of the same. They always agree to repair the lift, gates & all other fixtures but not repaired the same till today. Many times we have given complaint him by but they did not receive the same.

the quality of lift is so poor so off and on we are in trouble we feel any accident can happen any time. So he advice us to contact builder urgently and change all four doors & fixtures to smooth working of lift. All flat owners are continuously trying to reach/meet builder mr. jagdish madhu or his father mr. prabhu das madhu through telephonically but they do not come online, also three to four times all the flat owners have visited their residence office to meet them but they did not face and bluntly answered “ they are not present”.

There were many other problems regarding construction like

1. Low Quality of Electrical cabling used for entire building may hazardous and some times may be FATAL

2. Low Quality of Brickwork & Plaster work as a result broad cracks had been arrived at Ground floor flats and after wards repaired by flat owner

3. Builder did not pay balance property tax : Flat Owner have supposed to pay & paid on behalf of builder

4. Builder did not pay maintenance charges for vacant flat till sell ; as per agreement as a result little bit flat owner beared full building maintenance charges.

5. BUILDER DID NOT ISSUE " BUILDING COMPLETION CERTIFICATE " TO ANY OF THE FLAT OWNER
6. Till the date we have not been given my account of flat no 402 whenever I request him he is to try to avoid me.
7.parking area of flat is not sufficient and he has made illegal construction In parking area and formally he was in municipal corporation so he threaten us that he will do whatever he likes to do.
8 I have been given the papers of flat no 404 and this flat is not in exist I have requested him to submit another papers but he says we have reallocated the number from 404 to 402 but when I approach for loan bank authority says it is not proper
9 the builder has built 12 flats out of which he has sold only 5 flats and the construction cost of the reaming flats has been added in our cost this nothing but a cheating to us builder is not making any payment of maintaince and the maintaince of flat is as bad as municipal health’s quarter or any slum
10 we have not been informed the present secretary and president and some flats have been sold to his brothers so all the cost has been affected to us
11. as a members of flats no account has been given to us he has charged rs 66000 more from me I have requested for account but he did not give me account so I request you to check the account from any charterd accountant
You are requested to take necessary action against builder and/or his partner and/Or suggest any other department/ person to contact/ write our problems too.
12.i have paid the fees for obtaining b u permission even though I have not been received the b u permission
13. the character of main accused mr jagdish madhu is criminal and all the time he threatens me. He has so many property for that inquiry should be conducted
14. The flat water facility is to poor and by giving sub standard water bore we get every time problem the quality of water is not hygienic but builder has only interest in money
15 I want bylaws of society and I want to know whether the flat occupied by the builders are free from maintaince .
16 flat owners are entitled for parking facility or not.
17 the builder jagdish madu is having criminal back ground so he is above the law

Builders — builders taking parking charges in black

As per Supreme court directives builders cant sell the parking...now builders are taking cash as black money for parking charges....and avoiding tax also in the same...it was better earlier...atleast gove was getting the tax on that money.....
1. Never buy under construction property
a. It can take ages even when 99% construction is completed e.g. builder internal disputes, land owner disputes, Manciple corporation disputes (you get to know this only after possession date is passed :) ).
b. Once you make payment there is no way out - you woudn't want to take pain of searching new property(your dream) and incur cancellation charges loss
c. If you see 500 people working at site doesn't mean you will see them next week too. They are rotated among builders sites.
b. Brand doesn't guarantee timely possession (refer point a). Try searching for customer complaints on any famous developer :)
e. In current market situations possession delay is very probable as the profit margin are less. Everyone is trying to pull money including developer, govt officials, buyer too. So even if possession happens as later planned the quality could be compromised.

2. Never trust the salesman!!!
a. Sir, possession is in 8 months at max 10 month
b. There will be ample space in the society
c. Municipal corporation has a water connection to our society - we will connect at possession
d. We will give you everything in written in agreement
e. We will give you best parking space
f. Specification will be as shown in sample flat
g. We have X, Y, Z project currently running, Mr. X is our brand ambassador
e. Prices will go up next week, this is limited time offer
f. Only few flats remaining
g. We successfully completed X number of projects (successful doesn't mean customers are satisfied)

3. If you have black money (i am sure you dont since you are talking pain in reading this), ignore above and below points - go ahead with your purchase :)
4. If you are investor you should buy properly at around 70% of market rate to really make any profit out of it OR be ready to wait for 10+ years. Remember there is lot o[censored]nsold inventory at the moment which will take 5+ years to vanish.
5. Mumbai, Delhi, Banglore, Pune are not future cities - they are already congested and lack proper planning to survive coming year - think again before you invest much at any of these location.

Conclusion, if you want a peace of mind:-
1. Buy ready possession flat
2. Delay buying decision. There are good chances you will be able to get the property you were eyeing at better price.

Always remember "Anything that goes up, comes down!". Wish for me that i get my flat possession soon - it delayed for 6 months for no reasons.
