[Resolved]  CGHS — member transfer

i purchase a flat in cooperative group housing society i have registered my sale deed against the conveynce deed of my seller & i made a payment to my seller now member of that CGHS are delaying in transferring the membership in my name they are making excuse by saying why u made payment to seller according to them payment of flat should go to the society first but my bank from where i took loan were not willing to give cheque in favour of society thay said cheque must be issue in favour of seller from whom u r purchasing flat. bank said because property is freehold now there is no role of CGHS plz write me after getting sale deed can CGHS management committe put any objection in entering flat

The managements of group housing societies consider themselves a law unto themselves, and all this because of the pusillanimity of the Government of Delhi which enacts laws but is not interested in implementing them. What happens to a buyer of a flat in a CGHS is indeed scandalous considering that we are living in a democracy not feudal times. The managment of a CGHS uses muscle power and arm-twisting tactics to extract thousands of rupees as entrance fee from the buyer of a flat before allowing him to occupy his flat. Then, in the name of granting him membership of the society, they again take from him thousands of rupees, whereas all that a flat owner, under the Cooperative Amendment Law-2006, which came into being on 13th January 2007, has to pay for membership is Rs 610 only.
This kind of hooliganism on the part of the managment of a CGHS can be stopped if taking of entry fee and taking of membership in excess of the stipulated amount are made cognizable offences punishable with, say, two years rigorous imprisonment.
Come to think of it, who are the people who form the management of a CGHS? They are, like other flat owners, just flat owners in that society. They are elected by the flat owners in a society for running the day-to-day work of the society. The mandate, which means a command, given to them is to serve the society since they have voluntarily offered themselves for this job. But, in practice, these elected representatives of the people of a society become bosses of that society. They start behaving rudely with the very people who have elected them.
To expect any remedial action from the Registrar of Cooperative Societies is futile. That office has little credibility so far as its powers to discipline an erring CGHS are concerned. This office would not take any action against a society even when it is doing everything against the rules. My own frustrating experience has taught me to expect nothing from this office.
The only way to put an end to the existing high-handedness of the managements of group housing societies is for the people living there to unite and file a plethora of cases against them. There are ample reasons, and all quite genuine ones, for filing court cases against them. That would succeed in putting a check on their lawless activities.

I completely agree with above complaint.

In fact, we went through the same trauma to the extent that Managing Committee member & the office bearer even disconnected the Electricity supply to our newly purchase Flat until we pay them Entrace fee in CASH.

So much so, they did even allowed us to enter the Society premises until we gave them a verbal commitment to fulfil their unethical demand and they made the Truck wait outside the building for ~ 2 hours.

It was quite an embarrasement / harassement. I hope there is some authority which could control such an armtwisting hooliganism by managment of a CGHS and they should be immediately stopped taking illegal entry fee and taking of membership in excess of the stipulated amount. They should be booked and the offence to be made cognizable punishable with, minimum two years rigorous imprisonment. We need strong action !!

Registrar of CGHS in Delhi is defunct organisation. Their interest is somewhere else. They take no interest on the matter of plight of the Residents of the CGHS. I have gone to the extent of Complaining to Lt. Governor and Chief Minister of Delhi to take action against Registrar of CGHS, but of no avail. Management Committee has many means to extort money from the Residents. We ignorant people feel the living in a CGHS is more of comfort, but it is other way round. Residents do not unite due to fear of harassment by Management Committee.
I am agree with you the same case is going in the society of Rohini name THE BHARAT CO-OPERATIVE GROUP HOUSIG SOCIETYLTD.Plot No.20 Sector 13 Rohini Delhi 110085. The Presindent $ the Secretary of the above said society is adament for the entry fees Rs 20000/ from the byuer

Beware of buying a Flat in Nava Kairali Apartments, Plot No.10, Sector-3, Dwarka, New Delhi-110078. I shifted from a CGHS at Sector-13 of Rohini to this CGHS. This Society is mostly inhabited by Malyalees (Keraltes, Christians). I bought the Flat assuming that South Indians are more honest than North Indians, but here it is other way round. We are not allowed to celebrate any Hindu festivals except Holi and Diwali. The Malyalee members are united and we North Indians are just 15% of residents. Our Electricity Meter Bill is owned by Management and thus Electricity Bill is prepared by them. The manipulate in raising bill by favoring their own Malyalees group. I feel it as it is the blunder in my life.
Yes management commitee thinks that they are beyond the law of land. They misaapropriates the charges collected from flat owners and not interested in the well being of the society for which they are elected. This is the case with Cenntral Electronics Ltd Group Housing society, plot no 14, Vasundhra Enclave Delhi.

This is the case with every CGHS and same is happening at K M C.G.H.S., Plot-12, sector-12, Dwarka, New Delhi for past 7 years and even before that. These muscleman consider themselves beyond law and make the life of residents miserable. All the persons employed such as electrician, plumber, maali, securtiy guards work as personal servants of the office bearers. anybody who tries to confront management for their wrongdoings is boycotted socially. Management is not answerable to anyone. They forcefully extract entry fee to fill their pockets and threaten who don't pay. Society Manager with blessing of President & Secretary often misbehaves with residents. The elections have not been conducted by society and office bearers are illegally occupying the office and taking unilateral decision. All kinds of financial bunglings are taking place and accounts never presented in last 2 years. The new owners are not beng given memebershipm inspite of directions form RCS. the Management is illegally demading Rs 10000/- for transfer of membership a clear violation os DCS Act.
There is a need to make these society mafia accountable and covering them under IPC. The RCS office also needs to wake up adn take strict action against them. Such office bearers should be debarred from contesting elections for life time.

As the number of Cooperative Group Housing Societies are coming up by and night, it is high time for the Government to make an Statutory Body solely responsible to monitor and control the functioning of Management of Society. If all do write such requirements to the Minister of Housing and Urban Development, may be some stone may move.
