Hi I had booked an apartment with DLF 2 years back and paid the booking amount as well, at that time DLF did not say that there was litigation with the land owners . They were telling all that the plans are in the final stages of approval from HMDA which they got . DLF did the Bhoomi Puja on 4th Nov 2009 , in Jan 2010 they sent a site update which again did not speak of any litigation pending with the land owners but gave all other details.
Then on 24th March 2010 i gave the second Installment via cheque and some amount by demand draft, they had not presented the cheque for clearnace . I had written an email to them on 20th May 2010 asking them the reason for not presenting the cheque to which they replied will get back to me as to when the cheques will be presented. Then on 25th May 2010 i got an email from them saying that DLF has increased the per sft cost by 400/sft due to change in specifications in which they had said that they have cancelled the plans for 2 BHK and now all the flats will be 3BHK and above . The specifications where the same which they had shared with me at the time of booking but it had 2 parts one is the basic infra specs which had changed and that cost 200 and another 200 for modular kitchen, bedroom furniture etc which i agreed for the infra specs and not the modular kitchen , They also increased TIC (Town infrastructure charges from 140 to 220/ sft) which i agreed.The acknowlegement was confirmed by a email on 18th June 2010. Then they kept saying that they will update me on the project status every time i called or wrote and email to them. Till August 2010 they had not the approval from HMDA looks like as per their email on 09th August 2010 . On 22nd Feb 2011 DLF sends a email that the project as of that day stands cancelled due to litgation with the landowners and please collect your payment with 6% interest .
Since last 6months i have been seeing the site there is some activity going on there which clearly shows that DLF is cancelling the project so that they can relaunch the project at a higher rate due to the change in market situations . We have been cheated for nearly 2 years we had other options at that time within our budget today all the other projects are at a much higher price.
Can the consumer court take up the matter and first verify the claim that if there are really any litigation with the land owners pending, second that if DLF comes up with a project at a later date our interest should be safe guarded and we be given a flat in that project at the rate which we had booked .
