[Resolved]  DLF New Town Heights Gurgaon — Extornist DLF

DLF Started Selling New Town Heights Gurgaon through agents across the country instead of advertizing it on their website . They called in Pre Launch. They did sell it through agents starting february. When the money was taken by wire transfer by them, they advertized this sale in the Web site by March middle and Increase the price by 20% with Some thing Called Preferential Location charges. This was universally applied to all the Big appartments.

Later the Agents in Collusion with DLF assigned appartment numbers to all the gullible persons who has paid up money in the prelaunch and imposed this 20% fee on them. Either you take the appartment or we will keep your earnest deposit.

A clear case of blackmail, deceit and extortion. Coming of top of it, A rude and arrogant person lying thorough his teeth sits as Customer Care GM. He forgets conveniently that DLF did not even advertize this sale till the middle of March. It did not accept direct communication through individuals through the middle of march and then claimed the agents are cheaters, not them.

Result: All the customers who are trapped are feeling cheated and let down by this appartement Sale by DLF. They cant withdraw their money since allotments have been done in collusion with agents and Customers have no way out.

Yesterday my family visited sec 91 site. Construction is not started at all... One guard told that DLF don't even own that piece of land and there is a dispute going on. DLF promised that construction will start in January, which is about to end.
Hello Future neighbours. Let me make some points clear. Although I cant give any official guarantee, but i m very much confident that those who have signed the contract with DLF wont b duped.
1. DLF admits that there is a delay in starting of project. They will start with sec. 90, then 91 and then 86. There were problems in aquiring the land and documentation process. In 90, the project is already started and its not a whitewash. In 91 it will start in feb, and in 86 by mar end.
2. The real allotees have already received the contract and they had submitted to dlf. DLF is in process of registring that contract and they expect to give the customer copy in feb.
3. DLF is maintianing correspondence with customers and sent letters indicating that the project has not strted yet, but they commit to complete it in the specific time. Even this condition is marked very clearly with in the contract.
4. Its my personal opinion, in comparision with other builders and projects going in gurgaon, DLF is doing better. I wont name other builders, but others are even worse. Friends, lets have faith in our builder and wait.

This is in response to one of the customers challenge in court for changing the lay-out even bookings and 20% payments and now asking for more PLC etc..

When i read the text of other people, i realized that other people also felt equally conned. I bought DLF on the premise that the per square foot rate is quite low, but charging such a huge PLC is unhear of. And that also, without mentioning it anywhere on the form. All of a sudden with a PLC of 500, the cost of the house ballooned and it looked like an unprofitable investment.
All through i felt that DLF being a foremost buidler will be ethical. But it now seems that being bigger makes DLF a bigger thief.

I sincerely believe that we should form a committee and take up the case strongly with DLF.

So far I dont feel I am being duped. The concern i have is different from other people - not about INTENT of DLF but state of DLF's monetary health and ability to dleiver. Big Question - Are most people paying up installments on time? I have paid around 50% of the value. I am hesitant to create trouble or delay/hold further payments as I am contractually bound to pay interest otherwise. The worst I see is about a year of delay in possession. So i dont mind continuing to pay the whole amount. So the million dollar question - Do others think like me (not counting those who have been duped but the majority of others who have no other reason for worry except cash crunch and delay risk)?
It is indeed surprising that even after a year of Booking DLF is sitting on almost INR 250 Crores it has accumulated from around 1000 flats booked in Sec 90.

DLF has the audacity to demand more interest free money it desperately needs to funds its operation from gullible people like us and few o[censored]s just because of the false reputation of the company are choosing to question our own instincts. This is a fact that the company is struggling to maintain the cash flows and it is using our money as advances rather then putting into the project it was paid for.

I think before the situation really get out of hand and we are sent the cancellation letters, we need to seriously approach the company and make it accountable rather then letting it send us threatening letters. The delay in remitting the recent instalments from few o[censored]s has been only because the intentions of the company in honouring its commitment seems questionable off late. We all must make DLF pull up its socks now.
I think the main issue that we should be worried about is whether DLF would complete the project within the timeframe that they have committed to us and with all the infrastructure development that they have promised. I think, the first and foremost step we need to take is to ensure we have a common forum and voice to be able to talk to DLF about our concerns from time to time. I am a late entrant to the group and so not sure if such a group already exists. They might be lax in responding to individual queries but to a representative of a group, they will definitely be more responsive.

Also, I think we should all force DLF to make the payments construction linked. As of now, we are paying based on the payment schedule irrespective of the construction progress which is not fair and infact not allowed by law. The banks should be lending money only to the extent of construction completed. However, because of the builder-bank nexus, they are able to influence the banks to lend money to people to pay DLF and in the bargain both the banks and DLF are benefitting at our expense.

I think, this is a very reasonable and winnable cause that we should all fight for. That would be a big relief for us atleast from the interest costs. Please do let me know if all of you are game to taking this cause up with DLF. I also heard from reliable sources that DLF has agreed to such demands in the past to change the payment plan to construction linked.

Lets take up this cause
Since there are more then 1000 flats, some have booked them genuinely for personal use, some for investment and some for re-sale, making forums or groups, choosing representative is not an easy task and very difficult to work out. Better we all should b together, and try with different approaches but with one goal. If someone gets a breakthrough, rest follow it. We all should concentrate on:
1. Is the project still on.
2. Whats the current prediction of finishing of the project.
3. Since all over, the prices are slashed till 20%, are we going to get the benefit of it.

If we get some convincing answers from DLF, we should continue from the project, otherwise we should think of Plan B. Soon, after complition of one year, we will b free to sell our bookings. If by the time, DLF is not able to give any genuine response, we should withdraw from the project.

Subject: Construction status of DLF New Town Heights – Sector 90

I booked a 3Bed Room + S Room apartment in the aforesaid project on 16-Feb-08. I visited the site on 07/02/09 and even after a year there is little progress on the construction site. Only some excavation has been done so far at Sector-90 site, which is far behind what could have been done till now. No work has started at Sector-91 and 86 sites.

This does not augur well for my confidence in your ability to deliver the project on the promised date of Feb-2011. I am disappointed that while I am honouring my commitment of releasing the payments to DLF on time, DLF is not living to its promise of giving me the possession of my aforesaid apartment by Feb-2011. While you have sent a letter to me re-assuring that I will be getting the possession in Feb-2001, this assurance needs to be corroborated by the ground reality else it has no meaning for me and fails short of your intended purpose of boosting my confidence in your delivery capability.

As a customer, who has given my hard-earned money to DLF for this proposed project, I have the right to know certain aspects of the project.

Please enlighten me by providing answers to the following questions.

1. Why work is happening at a tardy pace despite the fact that I am paying you the money in time?
2. Where and how the funds collected for this project are being used?
Looking at the project status so far, it does not look like that the funds collected against this project are actually used for this project. Where is that money being spent?
3. Where is the plan leading to possession in Feb-2011?
In reference to your letter stating booking date i.e. Feb-2008 will be treated as agreement signing date and for calculation of penalty etc. I want to see your current working plan that leads to possession in Feb-2011?
4. Why not switch to construction-linked plan?
Mere assurance that the possession will be given on time is not enough. If DLF has confidence in its delivery ability and wants o honour its commitment then the balance payment should be changed to construction linked plan. You have all the intentions to complete the project on time so should not make any difference to you anyway.
5. How about passing the advantage of lower input costs to your customers? Some other developers have already done this.

The world is going through a financial turmoil and your customers also exist in the same world. Not getting the possession by Feb-2011 will mean that I will have to pay EMIs for an extended period, adding more financial burden on me. What measures can I expect from you as a customer so that -
a) I retain my confidence in DLF as a reliable brand
b) I am convinced that the project will actually be delivered on time
c) I continue to believe that the pricing (despite change in market conditions since booking date) is still competitive.

I appreciate it is a difficult financial time for everyone. The current financial turmoil is also an opportunity for DLF to build a stronger brand. It is high time to live your values of ethical and professional service and retain confidence of thousands of customers like me.

With respect to letter, u can expect the following answers.
1. Work is as per schedule. They are waiting for Enviorment Clearence. We are at present on # 126-128, but hope to get it soon.
2. Funds are in safe hands with us and will b used only for this project.
3. WE confirm that the date of booking will b treated as date of agreement, and this has been conveyed to you in written and clearly.
4. This project is not Construction linked and DLF is not going for such type of projects anymore.
5. We calculated the price considering all Ifs and Buts. We wouldnt have raised the prices, if the scenario was vice-versa.

Actually my point is we should have some faith in DLF and give them some more time. By getting nervous, moving to court or any such things wont effect anyone and wont resolve the situation. Just b patience and think calmly. Anyways by writing any letter, they will respond equally in a letter. Its just a piece of paper to make us calm and feel safe. Lets dont get demoralise, try to understand the situation and have faith in DLF.
I know from my experience with DLF that it plants its own people in various residents/customer forums and they try to create confusion and keep working against the group. Looks like we have got one in this group as well.

Anyway, welcome Mr Goel, you don't want us to get demoraslised until we pay the entire cost to DLF. We should get demoralised once we have paid the full money and are in wait-mode for n no of years. The entire DLF Phase 5 has developed in last 6 years and I have a fair idea of how much time it takes to complete a project of this scale. Please also enlighthen us by telling the names of projects they have delivered in two years time? Do you think we are fools to believe in a letter sent by DLF?

DLF has already agreed to change payment plans of their commercial projects (time bound -> construction linked). Please also read the DLF Chennai story on moneycontrol. There will soon be a story for Gurgaon as well. Some o[censored]s who interact through other means will soon be filing a legal suit so tell you bosses to be prepared for some sweet time ahead. HC verdict against DLF on the green-belt zone in DLF City phase Gurgaon, court stay on new tower in Ridgewood, Chennai fiasco - days are over when DLF can arm twist its customers.

Dear Mr. Goel,

DLF answers can easily be countered by following answers:

01. Work is not at all as per schedule. Even the excavation work is not complete. We had recieved a letter few months back that we shall be invited for Bhoomipujan before they start the work, which to my knowledge has not been done.

02. The Environmental Clearance(EC) application was filed in Aug08. DLF needs to explain if it was serious in starting the project, why did it filed the application so late. Moreover starting the project itself is not linked to getting the EC, the other commercial projects DLF is doing and are almost about to be complete dont have EC yet !

03. We believed so far that the funds are in safe hands and thats why we have been paying, but off late there has been no progress at the site and there seems to be no firm plan as well. Each month we are told that the construction shall start next month, which shows that DLF has no firm plan to get this project going. We need to be satisfied in regard to the usage of fund for the purpose by actually seeing it happening.

04. The DLF has got the leeway just becuase it is not construction linked and we want to safeguard our interests by converting into one.

05. DLF has this specific clause in the agreement, through which they can raise the price in the event their cost go higher at a later stage, so why shouldn`t we also get a similar benefit. Especially when the asking rate for the ready to move in flat in main Gurgaon now is at around Rs. 3000/- psf. How does DLF justify Rs.3000/- psf it has charged from us at far off place.

The point is not to complicate the matters by taking the matter to the court but representing ourselves & getting a fair deal. DLF in any case has done injustice by charging uniform PLC !
