[Resolved]  DLF New Town Heights Gurgaon — Extornist DLF

DLF Started Selling New Town Heights Gurgaon through agents across the country instead of advertizing it on their website . They called in Pre Launch. They did sell it through agents starting february. When the money was taken by wire transfer by them, they advertized this sale in the Web site by March middle and Increase the price by 20% with Some thing Called Preferential Location charges. This was universally applied to all the Big appartments.

Later the Agents in Collusion with DLF assigned appartment numbers to all the gullible persons who has paid up money in the prelaunch and imposed this 20% fee on them. Either you take the appartment or we will keep your earnest deposit.

A clear case of blackmail, deceit and extortion. Coming of top of it, A rude and arrogant person lying thorough his teeth sits as Customer Care GM. He forgets conveniently that DLF did not even advertize this sale till the middle of March. It did not accept direct communication through individuals through the middle of march and then claimed the agents are cheaters, not them.

Result: All the customers who are trapped are feeling cheated and let down by this appartement Sale by DLF. They cant withdraw their money since allotments have been done in collusion with agents and Customers have no way out.

Reference discussions with your representatives with me and our E.D. (Marketing) on February 21, 2009 at DLF Centre. As far as the firm commitment is concerned, we are working out the details of rebates / credits to be allowed and also about the modalities of re-scheduling the Payment Plan and other aspects involved. As most of you are aware, we shall be re-scheduling the Payment Plan, linking it with the Construction after 35% towards the cost of the property is paid by the allottees and we have stopped sending demands for any demand over and above 35% of the cost. Simultaneously, for people, who have made payments beyond 35%, we will be working out other schemes, like Advance Payment Rebates, etc. As you will kindly appreciate that since it affects a large number of customers, we are going into the nitty-gritty of each issue and working out the details and we should get back to you before the end of this month through individual communication to all.

Meanwhile, we already have the Building Plan approvals and we should be starting the construction positively within this month and you will get the communication in detail, as promised above, positively by the end of this month.

DLF has, no doubt, cheated all in the name of Preferential location charges. I wish to warn all customers, hereby, Guys dont get illusioned. These [censored]s levy PLC much later and then you are in prisoner's dilemma. You just can not come out of it. I had lots of respect for DLF but somehow crooks sitting out there in corporate offices and influencing policies this way has wrath upon us. However, the consequences are well seen. Look at the DLF prices and if they dont return money to those who are suffering after paying through their nose, this collusion will take DLF on collision path with the Almighty and they will have hard time defining sustainability.

I have applied for a 4 bhk apt in DLF Gurgaon 86 sector. After one year of booking there is no work which has started on the project.

I have listed down the points which i have raised with DLF but I have still not received any solution. DLF asked me to take legal recourse if i want to cancel the contract. I am based in Mumbai and hence unable to visit Delhi frequently.




1. While applying I had given the option on pool & club facing for PLC, where is my consent on making it green facing. If I am paying a premium charge I should be given a choice of selecting my property.

2. DLF has charged customers even without starting work. Why should we keep paying DLFmoney when the project is not even taken off.

3. There was a big delay by dlf in sending the agreement on account of which there were delay in installment payment. DLF has charged me interest for the delay stating that had the disbursal been on time I would have paid the finance company interest and hence i should pay DLF interest even though the delay was at their end.

4. DLF sent me the signed agreement in Feb 09 one year after booking that too with lot of pages unsigned and witness page also not signed.

Now I dont trust DLF and would like to exit from this project with an interest on the payments made. The DLF spokesperson has asked me to go legal if i want to claim anything from them.

Also there was a commitment from DLF to communicate status on the project on 15th of March which has still not been done.

Are there any other people who are facing similar issues.

. The credit goes to all the group members to continuously attack DLF which made a stub born DLF to talk, re-think and moderate themselves to the ground realities. This proposal of DLF though may sound good but certainly carries many gimmicks and between the line statements. Many of the members are sending their observations to same. I also tried to read between the lines. Same are being as below :
1. The area of property increased by 5%.This is highly debatable issue as regards carpet area vers. . Super area. They are not mentioning about the ratio. I had an occasion to talk to a senior into civil engineering. He had his observation that perhaps and most positively this is their handicap as the plan is to reduce the number of stories and impliedly to increase the carpet are and/or super area.
2. 5% Discount is offered on basic sale price only. What about other charges like car parking, PLC, EDC and IDC. These alone form almost 28% of total flat cost? Is it not something between the lines. Needs attention.
3. 10% Timely payment rebate. This shall be credited / adjusted in the last installment. Meaning thereby this 10% money will go to them first and they shall enjoy interest there on. Why it cannot be otherwise i.e. all the payments made in time should be allowed the rebate at the time of payment and if at all the person defaults he can be penalize accordingly.
Furthur this clause is declared now any retrospect effect should not be made i.e if a person has defaulted earlier the rebate should not be denied as he was not aware of it, so not carefull. Also this 10% rebate is a significant in the total cost frame up . This clause should be spelt very clearly and should not leave anything in the hidden agenda.
4. Price protection. We understand DLF is already sold almost full of this project . As to why they would reduce the basic selling rates in these projects. Should we read that if DLF sells any product below this price anywhere in the world, we would be allowed price reduction and why we should be entitled for any happening in the world . So this declaration may only be decorative in nature.
5. Interest Payment on more than 35% to carry interest . My point on this is as per this proposal DLF has yet not received all clearances to enable them to start the construction. And I feel due to declaration of general elections the clearance may not come due to code of conduct. Further again these clearances etc. have been the responsibilities of the builder without any fault on the part of the flat purchaser and the purchasers money is locked up.
Impliedly interest on this portion i.e 35% should be allowed at least upto the time of start of construction.
6. The EXIT clause has not been addressed properly.
all these builders are big frauds. No wonder the real estate market in India is not clean.
People are taken for a ride and all the customers are meek helpless gulible spectators.
I was planning to look into this DLF project but it looks like I wont @least for now.
Probably Unitech's new project on Sohna Road for 40 Lacs for a 3 bedroom apartment at Sohna Road (much better developed location currently) has prompted this move than any of Customer complaints which they can circumvent easily once the money is with them. This is pure Market driven move. Also, looking at 40 lakh at Sohna Road, the price for 3 bedroom apt at NTH should be in the range of 35-37 lacs only.

Pls be cautioned that this is a big eye wash by the company as one can never trust what happens "tomorrow" with DLF. To get a fair deal, we have to talk about the current benefits as itr will be very difficult to get the money back from them once we give them 80-85% money to them. It is right now that we should ask them to give the discounts in the current manner & not in such an eyewash fashion.

To be honest, the only real discount that they have given is just 5% on BSP & thats all we have got which will be realised & credited in next few days/weeks. As far as the future 10% is concerned, we can never trust this group with this as I am sure knowing their unethical behaviour, this wont be passed on to the consumer. It might be observed with them in various ways like:

1) Giving us extra area over & above the 5% (but less than 10% as mentioned in the agreement) allocated by them (so the additional cost will be borne by us).
2) Fat registration fees charged by them for registering the houses.(they might come back & say that part of it will be adjusted only if you register through us).
3) Even one delay of EMI due to some genuine reason can also give them the right to forfeit this amount & not pass it on to the end consumer.
4) For any other reasons that they might come up with.

Also, it should be noted that it is the present which needs relief package & not future & it is imperative that we get the benefit in present as all the other builders like HDIL etc have given straight price reduction of 20% to their sites even in place like Mumbai. It is the present that the Govt etc is giving SOPS to the builders along with the lower raw material costs, then why the benefit to be passed on to us in future, which is also debatable.

Also, have heard that DLF has taken a refund of license fees from Haryana Govt of Rs 370 crores appx basis on the current recession, then why not the same attitude/ benefit be passed on to us. This is also coupled with the fact that the cement/steel/construction prices is almost down by 22% then why are they being such crooks absorbing all the benefits & not passing on the benefits to the end consumer, who had shown faith in them which was misused.

Therefore, in my opinion, we should ask them for upfront 20-22%% discount on the BSP & the same should be credited to us & all the future EMIs should be made with adjusting 20% & not that we block our 80-85% money & then again let them harrass us as we can never be sure with them for future, especially when they will have a major chunk of our money with them.

Over & above, if they want to give us extra5% in area, its upto them, but it is now that the recession is on & it is now that the customers needs the relief package especially when they have not even sourced their licenses/ construction not started etc as this is the only time we can put them on the backfoot & ask them to pass the benefit that they have been recieving.

I totally agree with Rc. I need a relief now. My salary is stagnant, as I had taken the decision to buy based on my due promotion which is now on hold due to recession. Moreover rather than extra resources I might have to take a cut in the salary. I hope Mr. KP SIngh realises that times are tough for them buth tougher for us where we can loose everything on one wrong move. Where 50 Cr might be nothing for them 5 lakh less liability for people like me can make or break. DLF is synonmous with Gurgaon and DLF should realise the same. They have given flat discounts, no questions asked, in southern cities while the city that gave them so much is feeling left out. Might be totally business decision but Mr. Singh if you take a good decision now, it will remain with your company for a long time. And some o[censored]s might have blind faith and money to invest in your projects through out our life. I am a shareholder in your company as well and you know how that has hit as well. Request for a fair soul searching, even if you cut down on your margins the goodwill you generate will give courage to other buyers to get in other projects with you and holistically what you give away might be much less.
I AGREE. FIRST THEY ALLOTED A FLAT AS PER WHAT I HAD REQUESTED THEN THEY CHANGED THE LOCATION OF IT.I ALSO THINK THAT THE PLC CHARGES OF 400-500 RS. /SQ. I have an apartment in New Town Heights Sector 86. I fully agree with the concerns of the buyers and feel that all o[censored]s are facing an erosion of our wealth while nothing is happening on the ground. Till date the clearances are not in place and DLF should offer an exit route to those who wish to exit, as it in not the fault of the buyers that DLF has not got the clearances.

Moreover, people are facing salary cuts and job losses, and in this scenario, DLF should change its stand from "no cancellation" to a more considerate viewpoint and should allow people to exit gracefully if they so wish. After all, it is us customers who have made it possible for DLF to grow so much and an exit route is very much required at this stage, when they have not dug earth at the site after 1 year.

I am ready to join any group and go to any number of meetings and spend whatever time required to take this issue to the highest level and would request more and more people to join the movement...

Hi, I am also a victim of NTH.

I wish to read the MOM of the 21st Feb meeting and those of any further meetings if they have taken place.

Also, I would like to know when the next meeting is scheduled and would like to join the same. I feel that the rebate offered is not a clean one, as it is only 5% and that also on the BSP, and the 10% on timely payment is just a promise.

Also, DLF should refund money collected in excess of 35% with interest, rather than adjusting it later. Further, it is also very important that they pay us interest on the entire 35% as there is no deployment of funds collected for the last one year.

I totally agree with you and i am also being trapped in their net and my fate is very bad as i have taken the entire loan of Rs. 60 lakhs by availing a down payment rebate of 9%. My monthly EMI is Rs. 65960 and my yearly interest payment is Rs. 6 lakhs approx. I want to get rid of this booking and want to get back my entire money which i have paid to them. My home loan is with ICICI home finance and i am not getting any option to come out of this. I also want to become the member of the group and intends to join the next meeting. Pls. enroll me as a member in your group and help me to get out of their loop as I am financially very tied up.

DLF is a BIG FRAUD. DLF just wants to keep the money of helpless investors and do nothing. Launching a project without Environment Clearance is illegal. DLF must be taught a lesson by consumer courts as I don't expect any action from Govt. on this issue..
