[Resolved]  Ittina — Not refunding the booking amount

I had booked a flat near hoodi circle, Whitefield(ittina Arni) in august 2006 and they had promised it will be ready by jan 2007. After the booking amount was paid there was no sign of they callim me for the loan to be processed. So when i checked with them they told they are yet to get certain legal sanctions and it may take a year or two. They told if i want to cancel the booking i can cancel. So i cancelled it in august 2007. Till now i am chasing them for my refund. I have approached consumer court for this as well, but i dont know how long will it take to get justice for me. So beware while dealing with Ittina. After i was cheated i searched about ittina and came through lots and lots of complaints against Ittina. Had i checked this before booking, i could have saved my money.

So dont ever think of Ittina while planning to buy a flat. They are the greatest fraud. ( all you guys can check about ittina on net, you will find lot of complaints against Ittina)

I don't think so they will finish by Jan end. It will take another 6 months to finish & handover. Just for eye wash only they sent an email saying "E - Block" is ready. Remaining blocks will take 6 - 10 months to handover. And amenties & other outside work will take some more time to finish. People will use Ittina Mahavir from 2010 - Jan...
But the question I asked was that did they really started giving possession of E-block?
Yes E-Block handovered. But what is the use??? Work is going inside premise & other blocks work is going on. No one is ready to stay. They need to finsih few more blocks & handover. But to complete other blocks they need another 6 months.
E block handover... Not yet its only on papers - it will take another 30 days.
How will banks release the Final Disbursal if they are not convinced.
How will Ittina refund Pre EMI.
Unless these issues are settled, Actual occupation of the flats with the key handover to customers cannot happen.

The bottom line is- customers are ready to wait for ever and listen to excuses. Ittina will always have excuses for cusomers, that sound sweet and promising. So lets wait and wait

Though the procedures in Ittina Mahavir is not complete in every respect including Amenities and Facilities, we have decided to hand over a few Blocks and give part delivery / part possession basis so that the owners can start their wood work in their Flat and will be able to start living when all the facilities are ready. This will also bring in the required confidence amongst the owners and the payments due with the owners will be forthcoming. This will enable the Company to speed up the work and deliver other Blocks faster. The program of delivery of some the Blocks is as under and owners who have purchased in these Blocks are requested to come and settle their bills and take part possession of the Flats.

So all we see above is fresh excuses from Ittina.
I have heard about some letter being sent to customers about inclusion of some kind of Arbitration clause in the Sales agreement...
If any of the ittina customers receive any letter or email from the Ittina Management, that is of serious concern or poses a new challenge for customers, please post it so that we all could be on our toes to fight back.
And apart from that they sent Arbitration notices to all custmor's to accept. Any one accepted?
Dear all,

I have received a letter on 26 Nov. 2008 (dated: 12 Nov. 2008) from Ittina office about inclusion
of the Arbitration clause in the Sales agreement and we have to give our consent whether we are fine with it or not and if no reply is received within 7 days, it will be assumed that the customer has
accepted the additional clause (7 days already over on receipt).

I personally feel that addition of this arbitration clause at this stage makes no sense at all as we all are interested in getting possession of our flats as soon as possible and have been patient beyond all limits.

In case of any further delay, I do not think an arbitrator would be able to do that justice what a court of law would do for the customers.

Please let me know your thoughts.

Did somebody seeks any help from lawyer on inclusion of Arbitration clause at this point of time.
Till date, if there has been any "good customer value/behaviour" incident by Ittina?

Court, though little slow, we can presume shall be neutral and shall always work for justice. In arbitration there's no guarantee - and that too Ittina being our opposite party, we can never expect proper justice; they can stoop to any low levels.

Hi Friends,

anyone knows what is the current status of the Ittina Mahaveer, Today I have lost the confidence in Ittina. how about our settlement for the delay ittina has done. I hear that some of the team has gone to Consumer court for the delay in handovering the apartment.

Any updates wouldbe appreciated.
In my last visit on 7th Dec, I met one customer at the Ittina Mahavir site who has a flat in O block. She said that there is a group of customers who meet up at the Ittina Office every saturday at 11 am. She told me that the customers in E Block taking part possession, have been told that the Pre EMI refund will not happen as Ittina doesnt have the funds. (This may refer to the Arbitration clause other have mentioned above).
Also during part possession Ittina is not giving proof the payment to KEB for electricity. they are giving temporary connections. Later these customers may have to pay the deposit to KEB to get a permanent electricity connection...
I request everone visiting this forum to visit the Ittina Mahavir office at 11 am, possibly every Saturday. This will definitely put pressure on the Ittina Management, and customers will not be forced to accept whatever Ittina management decides for them

Guys, get a little bit more involved. Visit the Ittina Office on saturdays to get the updates, even I will do the same.

Subsequent to the meeting held with some representatives on the 12th Dec. 2008 with our Managing Director Mr. I Mahabaleshwarappa, we are glad to inform you that several customers have come forward to collect possession of flats in E, N, L & D Blocks in Mahavir. If you are a customer of any of the above Blocks, we request you to kindly come forward with your pre-EMI statements (if you have availed Home Loan).

Due to a severe health problem, our Managing Director Mr. I. Mahabaleswarappa will not be in a position to meet customers this Saturday at our office. However, our Customer Care representatives and Director Engineering will be available at the site to address any concerns raised by you. Our MD will be available in office from Monday onwards and he will be able to meet customers at any point of time on any day of the week. We also would like to invite a few representatives of the group for any discussions to clarify any concerns. If you would like a meeting with our MD, do let us know and we will fix up a time as per your convenience.

Hi All,

Please do not beleive Ittina. They are big cheaters. Latest update is E, L, D and N block are ready. But fact is None of these are complete.
E-Block :
No electricity and not taken permission from the BDA for staying NOC.
It is not safe to move because any time KEB will come and take out the power. The temporary power is illegal. No indivisual power meters for flats.No lift ia available.

L Block:
No water tank. No power. Not completed plastring work. No progress in lift work.None of the blocks are fitted with sanitaries.
The block is in pathetic condition. You can't stay as it is not safe. No authorization from BDA NOC.

The same status for N and D block.

More importantly, he wants money and he is insisting people to come and take the flat. But he will take all the money from the customers and he will fit certain things in the flat. But still you can't stay because of no water and electricity.

The pipes are not connected and this is one more way of taking money from the customers.

Please do come and attend the meeting at 11 am at Ittina office on 27-Dec-2008. All the customers from Mahavir project are meeting and further quick steps will be taken.

Hi all, If you have any updates from E, N, L & D Blocks? So that we will come to know what's happening exactly.
Guys stop chatting and start meeting up.
I am sorry to say but I have not been able to participate in the meeting myself, at 11 am on saturday so far, but I will be present this weekend (Dec 27) to attend this meeting and moreover meet all Ittina Mahavir customers to see what can be done to end these grievances and reach a solution.

Only request to all Ittina Mahavir 'Genuine' Customers:
Come down this sat at 11 am. Lets meet up and discuss.
