Reference: Your notice no 43647 dated 27/11/2012 received on 8/12/2012 Subject: Demand of Rs 70133/- with a note that our meter was not working
Dear Sir,

I am shocked to receive your unilateral demand without any hearing. I have to submit as follows:

Your team had come on 13/09/2012 to verify our appliances and meter. They seem to have found the meter not working. During this period of about five months we were billed an average units which we were promptly paying on due dates without even noticing the reading. As such the bill was more or less of the same units so there was no need to check the unit reading... This task is of the department and a relevant letter or team should be sent to us before we realise that the meter is not working. As an aside – the meter is an asset belonging to the department and we are not supposed to touch it. The person who comes for reading every month also didn’t deem it fit to let us know.
The department simply doesn’t look at all this and instead of sending us a reminder/letter chooses to send a team which comes here in the month of Sept/2011 – five months hence. They chose to verify the appliances and their load factor. Even at this time they don’t deem fit to inform us the problem. Without even going into the details – the team chooses to make out a “Punchnama” and delivers it to our office peon. They promptly take this peon’s signature who doesn’t even have the authority to accept any letter on behalf of the company or the undersigned.
After few days we get a letter copy from the MPEB testing department with their findings that the meter is found intact and there has been no tempering with it. It signifies that as customers – we didn’t even touch it and are not to be blamed for its not working condition. Report dated 29/10/12 – (attached)....
However – disregarding the above report, disregarding the responsibility of issuing us a letter asking for explanation, disregarding the unauthorised acceptance of the “punchnama” and not accepting the fault as their own of meter not working – your office irresponsibly calculates the appliances at the highest load factor and multiplies that by 8 hours for every day – no holidays etc and no concessions for the no-lights usage during day time etc) makes out a demand for Rs 70134/- .
On receiving this notice – the undersigned went into a shock and had to be put into medically administration for which the company has already spent over Rs 40,000/-. The report will be submitted on demand to you of the expenses and the shock that the undersigned went into.
Not compromising on the rights of approaching the relevant courts – I hereby request you to correct your asset (your meter) and take back the notice forthwith which has caused undue damage medically to the undersigned. Any consequences shall be personally dealt with under relevant laws.
