[Resolved] Orchid Infrastructure Developers Private Limited — ORCHID Infrastructure builder denying penalty even for more than 1 year delayed possession

I had booked a flat at ORCHID PETALS, Gurgaon and possession of the same has been delayed by more than a year. Recently I have received possession letter from builder asking for more money prior to inspection of flat. Even though ORCHID is giving 1 year delayed possession, builder is denying penalty (Agreement had clause 5Rs /sq ft) stating approvals delayed by goverment and saying builder not liable for penalty. For the victims of fraud by Rajiv Gupta, MD of OIDPL, the fact that this scoundrel Rajiv Gupta is paralysed now and living a hell of life cannot be of any solace. They paid their hard earned money to him but he cheated them at almost every stage starting from the stage of framing the agreement till people received possession offer letter of incomplete and poorly constructed flats.
