[Resolved]  PATEL MOTORS INDORE/RATLAM — Refunds not processed

This has reference to my complaint number [protected] lodged today with Maruti Helpline. The complaint is against Patel Motors (Indore) Pvt Ltd - P801 (referred to as "dealer" below) for not refunding cash amount of Rs 10,500/-. I have many reasons to complain against the dealer but I will stick to the more serious ones as I look forward to a speedy solution.

I bought a Wagon R LXi car from this dealer for an agreed price of Rs 347,817/= (on-road price for metallic colored car) against quotation number 7596 dated October 4, 2009. The car was being bought in the name of my company GE Capital Business Process Management Services Limited and it was agreed that the dealer will release the car on receipt of Delivery Order from the Financer that was to be GE Money Financial Services Limited. The delivery order was sent to the dealer on October 6, however, he refused to release the car basis delivery order (this was due to immense amount of misunderstanding between their branch staff and management).

Owing to this mis-communication between them, I had to pay the entire amount in "cash" for speedy delivery of the car. At this juncture, I was told that metallic color is not available and they can only provide me with white car and with a price difference of Rs 3000, i.e. Rs 344,817/=. I had no other option but to accept this, as it was told to me after the cash was handed over to them.

On October 8, the cheque against delivery order was prepared and sent across to them vide First Flight courier number 14764686. The cheque was for Rs 314,486/= (ex-showroom price) and after a week's time they refunded us this amount in cash after withhelding an amount of Rs 10,500/= without specifying any reasons whatsoever. I waited patiently for this amount to be refunded and then started following up on Nov 10. At this time, I was told to submit my identity card and latest payslip to avail the corporate discount of Rs 2000/- which I did promptly.

After much follow up, finally on Dec 22, I received an email from their General Manager, PK Garhwal, informing the following:-

1. That there has been a revision in RTO charges effective Oct 11 and that an amount of Rs 6747 has been adjusted against the same.
2. That Maruti has not approved the corporate discount because my payslip and ID card did not reach them on time, and another Rs 2000 additional on account of this has been adjusted.
3. That after adjusting the above, an amount of 1753/- is refundable to me[protected]. It’s a separate mystery that even this amount is not paid back to me.

A revised (original) invoice after incorporating above changes was sent to me last week having same number, same date, but different amounts. A reason enough for me to challenge this in a court of law.

Now, please note the following points:

1. When the car was delivered on Oct 6 and original invoice was generated on Oct 7 - how am I liable to pay additional taxes which were effective Oct 11 ? The entire amount for the car was paid to the dealer much before Oct 11 - infact he had an additional amount of 314,486 by way of cheque delivered on Oct 8. Why should I be paying this additional amount of Rs 6747 ?

2. Nobody ever asked me to submit a copy of my ID card and payslip on the date of delivery or before that. The first such request was made on Nov 10 and I sent my documents immediately on the very same day. The car was bought in the name of GE Capital and that should be a reason enough for Maruti to extend the corporate discount. Obviously, the dealer did not do his homework on this front. The quotation number 7596 accounts for the corporate discount and at the sametime, does not talk about the fact that I will be required to submit "anything" to avail the same. Why should I be paying this additional Rs 2000 for no fault of mine ?

In light of the above, I want the dealer to immediately refund the due amount of Rs 10,500 (alongwith applicable interest) to me without any further delay, failing which, I will be forced to take this matter up to consumer court.
