[Resolved]  Reliance Consumer Finance — Car Loan Fraud

I am Kanika Maheshwari D/O Prabhat Maheshwari. I am residing at Satyam Apartments, Flat E1, 7A/2 Rajpur Road Delhi -54. I applied for car loan from Reliance in April' 08. The loan got approved () for amount 3,30,000 but due to some issues Reliance did not send money to Hyundai and we canceled the loan and started a fresh one with ICICI. During that period of settlement with Reliance, they debited 2 EMI's from my ICICI account and later i asked ICICI to stop payment against Reliance car loan. They sent me letters stating that outstanding is due on my account against loan. There system shows my account as closed in 1 system and another shows it as active. I dont know how they maintain there database but if any loan has been canceled it should show the same across all databases. After so much of trouble we finally got the EMI's which got debited and closed all transaction to Reliance. Now after an year's time i got to know that my name is listing in Cibil defaulter list against Reliance dues. I was surprised to know that my name got listed for EMI's due fow loan which does not even exist and got canceled. I did not receive any NOC letter from Reliance and when i called there customer care they told me that it has been dispatched on 5thSep' 09 but till date its not received. Now i am mailing reliance customer care to mail me my NOC so i can talk to Cibil to remove my name from the list but they are not responding.

Sir, I would like to request you please take necessary action against company who did this with me and if any information require from my side I’ll be available.

RIL — repayments/car loan

Dear Sir/Madam,
I have a taken a car loan whose agreement no. is LADEL[protected]of amount 247500/=INR from Delhi ICICI bank for ZEN./LX. On the fixed interest rate for 57 months that is from 07/07/2004 to 07/03/2009. My monthly installment is of INR 5383/=.

I paid some of my EMI through submitted bank cheques and then submitted a part payment of Rs.175, 000/=INR on 21/10/2005 through DD of dd no.102347.I became unable to track my loan repayment status from last two and a half year due to some unavoidable reason and now I want to close my loan. There is a provision for the foreclosure charges on the outstanding principal amount so when I submitted INR 175000/= it must be deducted from my outstanding principal amount in that particular month that is Rs.192485.37/=INR as per repayment schedule sent to me. Now the repayment schedule statement sent to me is not calculated as per the principal amount after deducting 175000INR from Rs.192485.37/=INR onwards. My point is when there is a provision of the foreclosure charges on the O/S principal amount and on the other hand you are not deducting INR 175000/=INR from my principal amount are contradictory in itself.
My second point is that I submitted this much of amount on the recommendation of the bank and bank has accepted the amount against my loan then bank should not put my submitted PDC(s) cheques to respective bank to avoid bounce charges and OD charges after 21/10/2005, but they have put all the cheques to the bank at the EMI dates and then adjusted bounce charges and OD charges from my submitted amount of 175000/=INR.This is a great mental harassment to me from the bank people. It is a great irresponsibility from the bank side in accepting my money (INR175000/=) and then using the same in their own way without giving me any waiver in my principal amount and they managed my this money since 21/10/2005 without providing any interest to me. If the concern authorities in the bank did not have a procedure for the part payment then they should not accept this lumsum amount against my loan so that I could submit this much amount in the concerned bank for whom I have given the PDC(s) to avoid bounce charges and overdue charges.
Now I feel very much decieted and I am compelled to pay a huge extra sum against my loan unnecessarily. This is an ideal case of exploitation of a client who takes a loan from the ICICI bank and to avoid any inconviency in collecting EMI, he pays a part payment to bank moreover bank accepts the same but now the client who proves his honesty regards the bank loan is being exploited. I expect your immediate intervention in this matter to stop this injustice. I’ll appreciate your help that will provide me a way to solve this matter.
