[Resolved]  Royal Palms India Ltd — Possession still not given

We have booked a flat in Garden View apartment at Royal Palms GOREGAON, MUMBAI 65.

Possesion was to be given in December 2008.

Thirteen months have gone but possession is still not given and no intimation given from Royal Palms to us.

Now they are telling possesion will be in december 2010.

That means it will be 24 months delay.

please assist.

The Maharashtra Law says if the Builder delays the possession of the said flat, the consumer is liable to get 9% interest on the paid amount for the delayed period, this is info i received from an expert, have to check the law, do inform if you get connected to an authenticated information on the above.

What lies...
I have taken flat in Royal Palms, Goregaon east problem which i am facing:-
1. I took flat in palms the quality of construction is very poor and 3rd grade quality.
2. The building which is given to us is 80% work done by builder rest he refused to do work.
3. The agreement say drinking water but there is no BMC supply of water.
4. Electric meter is also we have take on our name with fight.
5. There is no queering or water given to the construction or can say no water on brick work.
6. The sever line is not proper. i.e. all sever is constructed below ground floor flat. If something happen then ground floor flooring need to be dig and work will be done.
7. Aarey excess say free of cost but that is not true.
8. Lift fire safety are no were in picture.
9. Building lay out is not given to any society.


These are the core points which I have given there are more. Still i[censored] want to buy property in ROYAL PAL then its your choice may god help u.
We can only give advice to people who will spend their hard earn money……
I had gone to check thie place My friend has investd in a condo (THANK GOD) its only for 14lakhs - 350sqft super built up area - u will not even get tht place in thane as a matter of fact --- pathetic construction horrible area not safe for women at night----- GOD help people who have booked 1 2 and 3 bhk in tht area ----- consider ur money wasted ---- Take care --- This is my personal opinion - U may like to stay there

If you get possesion by Dec2010 consider yourself lucky. I have invested since 2004 & have not yet got possession of Orchard Road Mall & Picadilly 3, after 100% paid & flat registered in my name. They do not want to spend on paint & sanitary fittings, before possession ...They wait for the customer to get fed up & do the flat himself ...

All this money made by cheating people, they will pay trhe price ...coz, there is a God ...& they have cheated people with their hard earned money ...

I have just bought a 3BHK 1688sq.ft last week and have paid 5150 RS per sq.ft.I have paid one check for Rs 2133500/ and have given 2 post dated checks, one for dec 15th /2010 and one for jan /15th 2011. I am from outside bombay and did not do any research. the building is 12 storries and 8 floor are built. the receipt said that the money is not refundable, but i can stop the 2 post dated checks, can some one advice me please what to do ?/
There was no flat available when i visited but they called me the next day as one flat was returned by the previous buyer. Also the contract they sent me by email says that this is the lease property for 999 years, and the residents have to pay Re 1/- per sq.ft per month. The free membership to the club is promised but the club was in very bad condition.

Yes these people are horrible, we purchased flat in Garden view and we have not received possetion. It has been two years. Just praying to GOD.

I have brought a unit at Orchard Road Mall & really tensed if my money is safe & if any business can be run there. If any have invested in Orchard Road Mall, can we voice our opinion for them to use it like a normal mall, instead of the current way they have neglected the mall.
Like to hear the views of others who have invested in Orchard Road Mall, @ Royal Palms, Goregaon East.

Please Let me Know what does 999 years of lease means that after buying the property it wont be in the name of the owner it will be in the name of royal palms. What is it that 1Rs per Sq.ft ever month rent for the lease. Please let me know is it safe to invest in mall or not. Or who has already invested in the Mall can write to me on my mail. Thank you.

There are issue concerning the possesion of flats and completion of the buildings but not ignoring the facts that society are being formed and properly functioning .The quality of the construction is below average but again the flats are cheap and affordable compare to rates in the radius of 6 kilo meters which is approximate not less than 20000 per sqfts.Peacefull location and amazing views from the flats and cooler climate .my personal suggestion to the developers is increase the saleable rates from 6500 per sqft rates to not less than 12000 per sqft and reinvest the difference in the quality of constructions and beautification off the royalpalms .
i have also booked a office in royal palms orm with a scheme of rent back at 18percent which means they will return me around 36per in two years, as far as my planning went i believed that area will develop in 2 - 3 years but to my hororr i am seeing hardly any development in last 2 years .
last week i have rechieved a possession letter on checking with pace of development it was found hardly anything has improved .

I am planning to take 2 BHK flat in garden View Apartment, it is resale flat..
I am family person with 1 son of 15 years.. Please suggest me is this is fine decision of buying flat in this area as i and my husband both are working at andheri and kandivali so it is convinent for us so we thought of purchasing..So please suggest is this buildinga ant area is fine..

Referring to the above comments -

I think the rates at royal palms are low due to political reasons..

I have above said apartment there and soon we are going to form Co-Op housign society, the royal palms area is developed in much better way that I expected when I invested in the property.

There are few problems from Builder side ... like collection of charges for club house which doesnt exist till date and delivering bit less than promised.. i myself got possession of apartment after over 1 year delay but when I received it everything is now at peace and looks much better.
I have also invested else where in mumbai/thane and my family and needless to say that the same problems exist.

The apartments are getting legal registration - the registerar office must be checking property related clearance and its validity.
