[Resolved]  Sanjeev Kumar — Complaint against MCD

Subject:- Complain against officers in MCD, Najafgarh Zone, New Delhi

This has reference to the last communication No. 14(5)/09-RN/2404/6110, dated 17.03.2010, received from the O/o the Hon’ ble Lt. Governor of Delhi and my last representation (copies enclosed), which are self-explanatory.

2 Also please refer letter no. DC/NGZ/Appeal/2010 – 1254 dated 12.10.2010 received from Dy. Commissioner, Najafgarh Zone, MCD, New Delhi (Copy enclosed).
3 Vide para 2 of letter mentioned in para 2 above, Dy. Commissioner, Najafgarh Zone, MCD, had directed the PIO/SE/NGZ to take necessary action to remove the encroachment from the street, which I have been requesting for last more than a year. But no action has been taken yet. As usual and expected, written instructions from Dy. Commissioner, MCD, Najafgarh Zone to Suptdg. Engineer, MCD, Najafgarh Zone have again been violated/disobeyed by Suptdg. Engineer, MCD, Najafgarh Zone.
4 I cannot understand the reasons for this gross inaction/biased attitude on the part of MCD, Najafgarh Zone. If Shri D. P. Tura, Dy. Commissioner, MCD, Najafgarh Zone do not want to get this encroachment removed from the street OR for any reason(s) is not able to get this encroachment removed from the street, then please let me know clearly. I would certainly stop making communication in this matter, which seems to be useless for MCD, Najafgarh Zone. I cannot even imagine that civic body like MCD can deliberately sleep on such a tiny matter for such a long period.
5 Photographs of the huge platform, ramp and malba in the street are enclosed. In reply (copy enclosed) to an RTI Application, Najafgarh Zone, MCD had claimed that these had been removed from the street but they still exist in the street. Please see photographs.
6 Now, just imagine a civic body (like MCD) in the capital city (DELHI) of the largest successful democracy of the world (INDIA), headed by a COMMISSIONER (Senior Civil Servant of India) which :-
(i) Can sleep over tiny matters for years;
(ii) Can submit false, wrong, manipulated and biased report to the office of the Lt. Governor of Delhi;
(iii) Can give wrong information to an application under RTI Act 2005 despite having provided photographs as proof for inaction on its part;
(iv) Can disobey instruction issued by the O/o the Lt. Governor of Delhi;
(v) Can harass law-abiding senior citizens like my parents; and
(vi) All these with impunity.
7 Is the intervention of Hon’ble Judiciary necessary to solve this tiny problem and to get justice, which can be given if authorities in MCD, Najafgarh take this matter in all seriousness?
Frustration and injustice received from Najafgarh Zone, MCD have forced me to take this step.

(iii) Shri K. S. Mehra, Commissioner, MCD, New Delhi (The Commissioner can get an idea of the style of working of MCD under his supervision. In over more than a year, MCD, Najafgarh Zone was not able to remove encroachment from the street); and

(iv) Shri D. P. Tura, Dy. Commissioner, MCD, Najafgarh, Zone, New Delhi. (Instructions issued vide para 2 of letter No. DC/NGZ/Appeal/2010 – 1254 dated 12.10.2010 by the Dy. Commissioner, MCD, Najafgarh Zone to PIO/SE/NGZ to take necessary action to remove the encroachment from the street have again been violated/disobeyed, as expected. If Shri D. P. Tura, Dy. Commissioner, MCD, Najafgarh, Zone is not able to get this work done, please let me know in writing.)
