[Resolved]  Sankalp Computers & Systems Pvt. Ltd — delayed & substandard Delivery

My company “cosmic Care & Wellness Pvt. Ltd.” As you know is engaged in online based business for which we had asked your company to provide with customised online software for which you asked us for a payment for two lakh rupees which was further increased to two lakh fifty thousand rupees due to few more feature addition to the software. As per our discussion we were supposed to get fully functional software within 2 weeks from advance paid and balance on delivery. The advance for the same was paid to your company on 28th Aug’2009 (cheque no.285208 of PNB – bandra branch) but unfortunately we did not receive the delivery of the software before December 2009 which delayed my launch.
On receiving the software we were given a brief training and was told we would receive the in-depth training manual to help us (this manual is still not received). On using the software we found it not user friendly and not up to the mark of what was promised. We were not able to carry on with business as the commission calculations for the agents was not happening due to many features missing in the software and many illogical system created by the developers which was giving wrong calculations to the agents, hence we did give out any commissions to our agents involved. Finally after few amendments on March we were told the software was ready for calculations hence we asked your staff to do the calculations and give us the payout details when he did we were shocked that few agents were still not given payout that means the software was faulty this was brought in the notice of your staff. Further we asked for some changes in plan in the month of march which was supposed to be delivered within 10 days but unfortunately this was prolonged and ultimately as per you was ready on 8th May but in factual no proper delivery is yet given to us as no passwords or how to use it and where on web is the site is not informed.
We have been conveying to your company that my agents are pressurising me to pay their commissions and we need the software up and running for which on every call we were promised that within 2-3 days we would receive our software. Since your company did not deliver what they were supposed to, my company has suffered a major financial loss and loss of trust amongst my agents.
I request you to reply as to why your company should not refund my company’s money (rupees two lakh fifty thousand) paid towards the software (which is still not delivered) along with the financial loss incurred by my company due to your company mismanagement and substandard software.

PS.: if you want i can also pin point you in details how your company has let my company down starting from Mr. Rahul who was more of recovery man than your sales person to your web designing department who would refuse to do anything we tell them following which we had to take service of another web designing company after paying your company for the same to hundreds of mess in your software.
