Serious Complaint — No action taken place by mcd for commercial activity done in whole basement where as basement is used for parking or storage purpose

SUB: REQUEST TO REGISTER A CRIMINAL COMPLAINT


Dear Sir,


With due respect we have to submit following facts for your consideration and taking suitable action in the matter.


1. That we all are the residents living with our family at Jawahar Nagar area which falls behind Jawahar Nagar Post office .

2. That we all are peace loving and law abiding citizens of Delhi having clean antecendents.

3. That in our locality there is one building known as White house bearing no. UA5836 Jawahar Nagar has a basement where a cyber cafe is being run illegally . It is pertinent to note that Landlord of this building has let out this building for Running a Girls Hostel to One Mr. Sharma.

4. That due to Girls hostel and Cyber cafe college students and other antisocial elements use to visit the Cyber cafe and create nuicense .It is difficult to pass through this area with family members as they passes odd comments .

5. That this cyber cafe is operating 24 hours without any break .The vistors inspite of objections from us are parking their vehicles on the street in front of white house area thus blocking the free passage for the movement of vehicles in the street. It is becuase of blockage of Passage our vehicles are being damaged. Major problems we all are facing due to this cyber café are free traffic movement in and out of colony. Blockage of passage for entry and exit.. Dirtiness on street due to empty bottles, cigarette packs etc. Misuse of parking area by outsiders.

6. That the vistiors use to smoke and drink near the parked vehicles and sometimes in abrreviated state tried to enter in girls hostel and urinates here and there. They used to throw empty bottles here and there on the road.

7. That these vistors used to abuse each other loudly and uses very flithy language.

8. That it is also important to note that in such residential area as per Govt. Notification Commercial activity are not allowed that too in basement which should be used for parking and storge only . It is important to note that Landlord has let out the basement area to one foreigner who with partnership of one lawyer is running this cafe .It seems that this cuber cafe is being run without obtaining any permission from concern authorities.

9. That when we raised objections to all this activities they do not bother and threatened us to face dire consequenses by saying that it is being run by lawyer so we can not do anything. This cyber cafe is becoming a nuisance for all the residents of area.

10. That as per the building bye laws of MCD & DDA beasement can not be used fully for any type of commwercial activities .We have reservation that thiscyber cafe may be used as meeting place for the anti social elements also as it is being opened 24 hours.

11. That as per normal practice and laws no Cyber cafe can be operated 24 hours and that too in basement area of a residential bulding where basement is to be used only for Stoage and Parking.



In view of above facts we all humbly request to your godself to istruct the concwerned SHO to take suitable action against the Landlord and tenants and others under the provisions of law for crearing nuicense by running a Cyber Cafe in basement of Building where Girls Hostel is running.

It is further requested that this Cyber cafe may be closed immediately or shifted to other place.

We all are confident that an immediate action will be taken on our request .

We are submitting complaint annonymously since the owners of the building are big builders and have money links ith local antisocial elements and have links with Local MCD officials also .Besides the Owner of Cyber cafe is a foregner who is running it in partnership with lawyer of high court who had threaten us with dire consequences and said you may appraoach any authority or Police etc no one can touch him .They have entred in to agreement with landlord for running Call centre but actually running Cyber cafe in total basement area whicch is totally against the norms as no cyber cafe can remasined opened for 24 hours and that too in residential area and in basement arera.
Hope you will take nescessary action in getting this cyber cafe sealed and shifted to other commerical area.

Please keep the complaint secret one keeping in view the threat given by lawyer and his association with antisocial elements.
