[Resolved]  Shyam Sundar jewellery — Fraud/theft

Respected Sir/ Mam,

I ordered a gold neck-less to (Sham Sundar jewelers address - 694, barah tuti chowk sadar bazaar, new delhi -06) on (13/11/10) with the advance payment of rs 48,158.00(as a gold jewelery). He said the complete cost of my neck-less would be approx 1,15,000 - 1,20,000 rs. Then he contacted me on 20/11/10 and informing that its not possible to complete the order within the weight we have decided earlier for the jewlery. In result of of trusting him I asked him to increase the weight by 10gms. Then on 2/12/10 I paid him 50,000rs in advance. Till date i paid 98,150 rs in advance. As that was the desinger jewlery so i asked him to use the best quality of ruby(stone)and best jewlwery with HALLMARK. He asked to me wait for a month to get the best quality of the ruby (stone). waited for 2 months. In between he called me 2-3 times to visit his store to checked the ruby and stone. Finally in the month of april he called me and he said my jewelery is ready. I told him that i am working and travel too. So I will be coming on Sunday. On sunday i called him to confirmed about the timing so he said he can't make it because of his personal reason. He did such things twice or thrice. Finally he called me and said that i will be available on 25/9/11, however i have to pay extra amount to collect my neck-less. At the time of ordering the price of the gold was 20,200/10 gm. According to the date of the order the balance amount should be approx 30,000 rs now he said because of the delay I need to pay approx 65,000 rs if I want my neck-less. I refused that because that was not correct so went to his shop then he denied to give my advance money,my old jewelery. Then i told him i will file a complaint then he finally asked me to pay 48,717.00 rs. So the total amount was 1,46,875 rs which was not at all correct also mental stress and harrasment as i am the only one the family who is working and taking care of everthing. Also as their was a cap of my earing which was supposed in gold however it was turned into metal. As per the bill he gave me jewelery weiight is 70.400 gms( Stone- 10.620 gms + Polish 8.970 gms + gold is 59.780 gms) and he made the jewelry in 22 carats gold as the design can't be made with 24 carrats as he said to me. He said the amount he divided (rs 2,000 for labour + rs 6,000 for stone + rs 1,38,875 for gold). i asked him that i will cross check for my satisfaction from other jeweler he said fine. so i did that. now once I cross checked my stuff stone quality was pathetic and also the weight was almost 19 gms, the percentage of polish which he charged was not valid and weight of the gold was also less. Then i called him and he start shouting at me and then i went to his shop and refused simply stating come after diwali as i am busy. So i went after diwali i asked him to weight the neck-less without stone, he denied and said he will not do that and said do what you wanted to do. He refused to pay for the local stone which he used , also for the polish, and the difference of the gold. The calculation was done as per 24 carrat not with the amount of 22 carrat. He is such a in co-operative person and he shouted at me more then twice. As i am working also take care of famiily on top of that such kind of shop keepers who just made my life hell. Because he did a fraud and he is not ready to accept that.

what I want the difference of the gold stone polish and weight. Please look into this matter as this is not right because that was my harden money which saved from my job.
