[Resolved]  Telecom Regulatory Authority Of India — Fair usage policy on unlimited internet usage plans

Dear Sir,
Until recently there was no limit to which a person could download using an Internet Connection labeled as an Unlimited Plan or a UL plan, but recently TRAI has approved the ISP's to put a cap on the usage o[censored]nlimited download users, this is called Fair Usage Policy (hence forth abbreviated as FUP) on unlimited plans.

I believe the users are at a loss as only the heavy users are opting for the unlimited plans and the Internet Service Providers (ISP) are charging accordingly but are not delivering as they have FUP as an excuse.

I have 2 points.

1.If the user the user is paying for the unlimited plan then why can he not have the liberty of the unlimited download? this is clearly cheating on the ISP's part as they cannot decide how much download is enough for a user ! and the FUP are fairly low for most of the ISPs. The users must have the entire right to download as much they want when they are paying for the unlimited plans.

2.If there is a surge in the usage o[censored]nlimited plans which resulted in the ISP's capability to deliver the product they promised hence resorted to Fair Usage Policy, then why are the ISPs not improving their infrastructure to handle the extra load or change the tarrif plans so that users are in the control of how much they want . FUP is essentially making the word unlimited download a lie and this policy must be abolished.

I sincerely hope that the consumer forum will take action action against this treacherous policy.

This is the special case of AIRTEL. My Airtel number is [protected]. I am not getting signals at my home, for every call I have go to balcony, with out privacy. Since airtel has not taken any action, the same matter was came in TIMES OF INDIA.Next day, airtel field persons came and did something.But, no use. Due to this, I opted for PORTING to vodapone on 5th June 2011. The airtel persons informed me over phone, that they donot want to loose the customer and opted me with 10% discount on my monthly bill, I requested them to accept my porting request, they have not done. Again, on 8th September 2011, with the Unique Porting ID AA 514196 with the expiry date 23/09/11. I requested porting to vodaphone, they asked me to pay the billed and un billed amount. An amount of Rs.310/ on[protected] paid the billed and un billed amount with E receipt No.[protected]. Again on 19th September2011, I requeted to accept my PORTING to vodapone.Again, they asked me to stay with Airttel., I requested them to accept my porting to VOdapone. I requested Vodapone to follow up my porting case with airtel, They informed me that, AIRTEL is not leaving my connection.Again on 29/09/11 @10.42 am., I requested Airtel to accept my porting with REf.No.F[protected]. Again, 29/09/11, 18.56hrs with ref.F[protected], I requested to accept my porting. I received a message that my porting request has been rejected due to substantial contractual obligation from the subscriber agreement. So far they have not done anything. I requested Airtel Nodal officer on5th October to accept my Porting request. He requested me to continue. He also not done anything. Again on 7th Oct., I requested Mr.Santosh, Nodal Officer, Airtel (cell No.[protected]), to accept my porting request, he also asked me to give one more chance to Airtel, to serve better. He told that he will talk with me in the evening after discuss with their staff, so far they not done anything.
So far, the Airtel or Vodapone are not done anything.

I request the concerned authorities to accept my porting request & do the justice immediately, to utilise my phone.

Mean time we made number of calls to their call center and in turn they confirmed that the request will be attended within 48 hrs. We also made personal visit to customer care center at Bannerughatta road which is not helpful to us. Mean time we have sent number of mail's in this regard and finally complaining to the authority by which our request will be honored immediately. We hope the authority will take suitable action in this regard.

I am having an Aircel postpaid connection([protected])for last seven months, Now I want to port to another network, but I am not able to get my port code even after sending the message for the same, when I contacted the customer care they have given the complaint No. 1-[protected] but not able to solve the issue, now I doubt that they are deliberately doing so. I have no current dues in my connection.

I hope TRAI will be able to solve these kind of problems

With reference to my mobile number [protected] provided by TATA DOCOMO I would like to bring to notice that.
I have used 3000 sms in bill cycle and it got disconnected on 18th oct and today that is on 23rd oct my new bill cycle starts but i couldn't able to use sms services.

When i contact to the customer care regarding this issue they not even look after this issue and not even solved my problem and keep on extending the issue.If i try to contact docomo higher officials, the helpdesk people do not provide to escalate to the concerned person.

I hope TRAI will look forward in these type of matters and pressurize service providers to keep the commitments given through sms services while marketing in sweet words.

I m a regular customer and obtaining a prepaid connection bearing No. [protected] since 2009 and from the date of purchasing I m also using your 98 internet plan in which you are providing a 3GB internet value for a month . First of all there is no reminder from your side about the deadline of 98 internet pack. Secondly various time I realize that illegal deduction were continuously carried out by you time to time. In this regard every time I talk to your executives but they did not took any pain and flatly refused to lodge / pursue my complaint. Finally yesterday 09/11/2011 at about 8.35 while I was in roaming I received a call from my client and after that my phone is showing a sum of Rs. 109 balance in my phone and after that at about 10 o clock I switched off my phone and when next morning at about 10.30 AM I switched on my phone and called a number and its shocked to see that my balance is only 9 Rs. After that I called to 121 and talked to executive she said that they had deducted a sum of rs. 30 for MCA service and 14 rs. Internet charges and when I talked about the rest of amount she cannot give a satisfactory reply to me. Previously when I also noticed when my balance in night was deducted almost 100 rs. In last month and when I contacted to ur executive they said that I have downloaded a game, which was not done by me. So kindly look into the matter and provide me the every deductions of previous two months on every call.

My name is Prakash.S.R. My cell number is [protected]. I need clarification from the competent authority regarding illegible deduction of amount from the balance of currency.

I have recently changed my service provider on POTABILITY system (Unique Porting ID is AX916353). When I met the new service provider as and when I got the message, the new service provider (AIRCEL) he explained about plans and I agree the following plan :

Calls to any AIRCEL number (1 (one) paise for 3 sec.) and to all other networks including land-line numbers (local calls) (i.e., half paise per sec.). Upon the discussion about plans, he has taken documentation and issued new SIM card and inform to insert the same when you get a message (de-activation of signals from previous service provider). On the same day they issued a recharge card by name "Blyk" card and collect Rs.74/- from me. After getting the message of deactivation previous service provider, again I met the new service provider at their outlet and get the new new SIM card activated. Further, the new service provider explained about a plan that "If you recharge @ Rs.120/- and you will get 10, 000 seconds of talk time (for any network) and Rs.35/- will be credited to your main balance" with a validity of one month (only for enjoying 10000 Seconds of talk time) and it will not affect you main balance . Accordingly I have recharged @ Rs.120/- and enjoyed talk time of 10000 seconds.

Subsequently, after the expiry of 10000 seconds of talk time, the call amount was started deducting @ 1 paise per second (i.e., 0-60 paise per minute). Immediately I met the service provider at the same outlet and lodged the complaint (only they have taken verbal complaint and there is no complaint book is provided to lodge the complaint in writing even I asked the coordinator). He said we will send a mail to customer care. Immediately, I rushed to the said AIRCEL outlet and inform about the deduction of amount for my calls @ 0-60 per minute / 1 paise per second rate. I also make a call in front the new service and shown the details of message. There after, he told to me lodge a complaint on customer care on '198'. Accordingly, I have called lodged complaints 5 to 6 times on the said customer care number. I have received various calls from customer care number ''[protected]" regarding the complaint and each and every time separate persons have called and asking me the same question. In the time they have deducted Rs.49/- from my balance currency without informing me (no message is sent about the deduction). Further I rushed again to their authorized outlet and lodged complaint about the deduction of amount without the consent of customer.

Please confirm whether any law says to deduct the amount without the consent of any prepaid customer of any mobile service provider ?

On[protected] I have seen the rate chart of 3G prepaid data plan at "http://www.idea3g.co.in/prepaid.php" as follows:-

I recharged 100 Rupees and I did not receive any 3G balance.
And so I communicated Idea cellular limited's customer care and nodal officer regarding the problem -ie I did not receive the
3G data balance as disclosed at Idea website.
After this I received phone call from Idea official, and I was informed it was a miss print at Idea website and so they will arrange the
200 MB data balance to my Idea account.
Now Idea people rectified the Web miss print and and telling me I shall not get any 3G balance.
I really feel like I am being cheated because Idea web professionals assume I shall not be able to prove their old mistake for which I am suffering and so I shall easily be fooled/ cheated by Idea customer care.
I really feel helpless and upset and requesting you to suggest me the right way to establish the truth.
Also I want to have the Official contact e-mail address of the chairman of Idea Cellular Ltd. so that I can inform the real truth to the supreme authority also explaining how their officials cheat ordinary customers.
I hope there are some good people who understand and fight against humiliation.

I have never done such a request to the airtel. So, why they are doing this practice from time to time without my consent ?
