Sub:- Illegal construction on open space of Society’s Road along T.P. Road.

Sir, myself K. C. Panchal, residing at A/36, Saibaug Society, Near YogiDarshan, Duplex, Darbar Chowkdi, Saiom Chowkdi, Sun City Road, Manjalpur, Vadodara would like to present the following complaint/representation on the above subject matter.

The 7.5 mtrs wide Internal Road of the our Society passing through Block No. 35, 36, 37, 38 & 34, 33, 32, 31, 30 had an exit towards 18 Mtrs. T.P. Road, but the Owner of Block No. C/30, Shri. Brijpalsinh Thakur & Block No. A/35, owner Shri. Dinesh Vasava had erected a illegal Wall closing the 7.5 Mtrs. Wide Road alongwith the boundary line of Block No. C/30 & A/35, thereby causing rain water blockage and hindrance to traffic flow from in and out of the Society & causing a lot of problem to me and other residence.

The illegal construction constructed by owner of Block No. C/30, Shri Brijpalsinh Thakur & owner of Block No. A/35, Shri Dinesh Vasava has blocked/reached up my entrance gate which is in my view completely illegal, which causing lot of problem to me in daily routine of life. The visitors visiting the houses of above persons are parking their vehicles in front of the entrance of my house. Some times, I am not able to enter in my house too, because of the said nuisance of parking their vehicles at my Gate. Frequent, requests have been made to the above persons for removing/infringed the said illegal construction, but, despite of the fact, the wall has not been removed.

In view of the above, the constructions of wall as discussed hereinabove is illegal, as per the approved Layout Plan No.L/105/2001-02 dtd. 28.08.01, Survey No. 331/1, Final Plot No. 428, T.P. No. 19, of the Society. It is therefore requested to remove the illegal construction and open the road for benefit of the entire Society members.

Kindly refer to above Municipal Commissioner, Vadodara Mahanagar Seva Sadan, (VMC) Vadodara’s office letter No. BA. P. JA. No. 2645/2/11-12 dtd. 30.01.2012 addressed to the Section Officer Shree, Urban Development & Urban Housing Department, Sardar Patel Bhavan, Block No. 14, 9th Floor, New Sachivalaya, Gandhinagar and copy endorsed to undersigned, under which the Hon’ble Deputy Municipal Commissioner, has informed for removing of illegal construction under police protection on open space of Society’s Road as early as possible on payment of removal charges.

Till date no action seems to have been taken for breaking illegal construction on Open Space of Society’s Road by any officer of Town Planning Development Office, Vadodara Mahanagar Seva Sadan, Vadodara.

You are requested to direct the concerned officer i.e. Municipal Commissioner, Town Planning Development Office, VMC, Vadodara to remove the illegal construction at open space of owner of Block No. C/30, Shri Brijpalsinh Thakur & owner of Block No. A/35, Shri Dinesh Vasava. For this act of kindness, I shall ever remain grateful to you.

In this connection, it is to bring to kind notice that I alongwith my wife, leaves alone. We both are Senior Citizen. Recently, I had undergone Bypass Surgery. Further, my wife is also suffering from hypertension. Due to our old age our health does not remains in good condition. Further, due to illegal Construction made my neighborhood creates unnecessary tension to both o[censored]s and caused hardship, physically and mentally harassment.

For removal of the illegal construction, charges if any occurred, I am ready to pay the same.

Kindly do the needful in the matter at the earliest.
