Three properties under Mortgage, originally there were few more properties in Mortgage but Bank had slowly done the job of PEST [karaiyan] and we also wonder of your high power intelligence and super BRAIN master planning capacity, how you have brought in a third party collateral and swindle those properties of the Borrower and finally trying to snatch the property of an innocent Victim. How is it sir, you people are so intelligent in planning for a wrong doing even politicians cannot compete you, sir. Sir, do you expect Government to appreciate you for having such cruel plans and garland you people. But we Indian Action Party wonder of your Master plans.

You are hereby requested to go through the details furnished below and we are to inform you that; Beware, all the facts mentioned herein, are supported by Documental Evidence and Witnesses.

Kindly read it carefully and revert with conscience, we expect humanitarian action and not officialdom.

But you have failed to note that there is Super Power Almighty God watching everything, sir, some times truth are silent but finally truth will succeed. Alas.

Report submitted by the Private Detectives of the Party after thorough Investigation and interrogation:

THE FACT:

SUBJECT: M/s. Vijaya Bank IFB 3042 Vs Mrs. Vijaya Bai.

M/s. Macenzie Exports Pvt. Ltd. had started Banking operation in the year 1997, and had taken various Loans, Business Loans, Home Loans and Personal Loans against mortgaging their Property without any third party collateral Refer your Record till 2005 such as:

Secured and Unsecured Loans:

1. Packing credit loan Rs. 75,00,000
2. FUDBP loan Rs. 50,00,000
3. Housing loan [P.C.Chugh] 11,55,000
4. Housing loan [P.C.Chugh] 7,00,000
5. Pro-note loan to P.C. Chugh 2,00,000
6. Pro-note loan to Mrs. Sudeshna 2,00,000

Total Rs. 1,40,55,000

[Mrs. Vijaya Bai, is brought in as Guarantor for Existing Packing Credit Loan & FUDBP Loans of M/s. Macenzie Exports Pvt. Ltd.,]

MAIN QUESTION THAT NEEDS EXPLANATION:

Vijaya Bank IFB 3042 had given the above loans to the said Company against the properties of the Managing Director and other Directors and also Given Personal Loans against the Pro-notes, please explain: Why the property of Mrs. Vijaya Bai Chellappa was taken as a third party collateral?.

If you analyze then you will know the whole scam.

01 . FIRST-ACCUSED VICTIMISERS. [SPIDERMEN].

VIJAYA BANK, [A Government of India Undertaking] Industrial Finance Branch [3042], [Spider-net] ‘Ankur Manor’, No. 182, Poonamallee High Road, Kilpauk, Chennai – 600010.

02. SECOND ACCUSED -VICTIMISERS: [SPIDERS].

a. Mr. P.C. Chugh son of Jonan Chand Chugh.

b. Mrs. Sudeshna Chugh both Residing at Flat-1, Wing No. 1, 7th Floor, Arihant Majestic Towers, Koyambedu, Chennai – 600094.

AND

c. His father-in-law Mr. S P Chattarjee, S/o. B.P. Chatarjee Residing at No. 58/1, Saptaparini Apartments, Flat No. 77-G, Baaly Gunj, Circular Road, Kolkotta - 700019 (W.B).

02 A. Mr. P.C. Chugh, as Managing Director and his wife Mrs. Sudeshna Chugh and His father-in-law Mr. S. P. Chattarjee, as board of Directors was Running a Business in the Name as M/s. Macenzie Exports Pvt. Ltd., # 14, Ambalavanan Street, 1st Floor, Chennai – 600106 and later shifted to Aminchikarai, Chennai.

And the above loans were given out of way beyond the limit for bribe, creating a Scam. And Chugh had done a total turnover within 2005 to a tune of 16.63 Crores [One hundred and sixty six Million and three hundred thousand Rupees] and his company had paid to the Vijaya Bank, interest alone to a tune of Rs. 71,00,000/- [Rs. Seventy one Lakhs].

P.C. Chugh Crying In his Affidavit is as follows:

“I, P.C. Chugh had pledged all our properties with the bank for availing the loans. In the month of Oct 2005, we had requested the bank for working capital and the bankers suggested me to sell some of my existing collaterals to reduce the Adhoc limits and through bringing/substituting with new collateral to secure the Bank. In this connection we met Mr. Chellappa through a broker Kannan, and we victimized Chellappa to pledge the said property. We entered into an agreement and signed a memorandum wherein we paid Mr. Chellapa approximately Rs. 4,00.000/- [Four lakhs only] and mortgaged the property of Mrs. Vijaya Bai Chellappa. We released and sold the mortgaged properties with Vijaya bank.

1. Property at Muttukadu Lake at distress and paid the bank Rs. 24,00,000/- [Rs. 24lacs] directly from the buyer in the month of November, 2005.

2. Subsequently from the Sale of Mogappair Flat the bank received Rs. 10,00,000/- [10lacs] in the month of February, 2006.

3. From E.C.G.C. Rs. 19,25,000/- [Rs. 19lacs, 25thousand] in the month of March, 2006

The liability was reduced by Rs. 54,00,000/- [Rs. 54lacs] and we were looking for further support from the bank, to start the business with orders and Letter of Credits in hand but the bank after receiving the said amount refused to co-operate and made our account as NPA and thereby we lost our entire business. Subsequently the bank send us securitization notice in May 2006 and refused our several proposals to restructure our account.

4. We sold our own flat at Koyembedu to our friend Mr. Baskar and the bank received Rs. 32,00,000/- [Rs. 32lacs] directly from Kotak Mahindra Bank in June 2007.

5. Even after this we paid Rs. 2,00,000/- [Rs. 2 lacs] to the bank.

6. Hence we paid a total of nearly Rs. 90,00,000/- [Rs. 90 lacs].

In the year 2007 to save Mr. Chellappa from the evil clutches of the bank, as the bank was threatening to take action and demanding further payments, we sold our own flat at Koyembedu to our friend Mr. Baskar and the bank received Rs. 32,00,000/- [Rs. 32lacs] directly from Kotak Mahindra Bank in June 2007. Even after this we paid Rs. 2,00,000/- [Rs. 2 lacs] to the bank. We paid a total of nearly Rs. 90,00,000/- [Rs. 90 lacs].

We were totally taken for a ride by the bank and gross injustice has been done to us. Now the bank is threatening with so many sort notices.”

In the letter dated 19th September, 2008 written by Chugh to the Bank we find the following facts:

01. “We sold our property at Mutukaddu Lake, E C R, in the year 2005 at the INSISTANCE of the bank to reduce our liabilities so that we could be provided with the working capital needed to revamp our business. With complete trust we disposed the same for Rs. 24,00,000/- [Rs. Twenty four lakhs] under distress. Today the value of the property stands in excess of one crore. After this neither we received any working capital nor could we retain the property which we would have disposed now at today’s market value, we could have wiped off our entire liability with the Bank. Soon after the receipt of Rs. 24,00,000/- [Rs. Twenty four Lakhs], the bank DECLARED our account as NON PERFORMING ASSET in the Month of December, 2005. Still with the hope that the bank would stand by us and commit as promised, we sold our residential property in Mogappair once again under distress for Rs. 10,00,000/- [Rs. Ten Lakhs] in the month of January, 2006. On repeated letters and plea, yet we did not receive the working capital as promised to restructure and move forward with our business. Today value of this property stands in excess of Rs. 30lackhs.Total loss occurred from selling these two properties untimely on the INSISTANCE of the bank was nearly Rs. 1,00,00,000/- [Rs. One Crore] app.. This amount would have been useful for us to settle the entire outstanding with the Bank, had we not sold those properties then.

02. In both cases, we had SUBSTITUTED with a third party collateral with the bank to the tune of 46lakhs to SAFE GUARD the bank interest before being SUGGESTED by the Bank to sell these two properties.

03. Further we recovered claim 19.25lakhs from ECGC in the month of February after long pursuance and follow up and reduced the FUDBP liability to this extent.

Finally we have sacrificed our only Residential property and sold for 32,00,000/- [Thirty two lakhs] to one of our friends to reduce the liability further with the Bank”.

Chugh had submitted letters for discounting of his company bills under L/c from Prime Banks and had requested to adjust as high as 25% from every bill towards Adhore, PCL and FUDBP but it seems that the Bankers had demanded more bribe, more than
the profit he could make, there were no positive reply from the Vijaya Bank and as the bank scammers refused to support, company was unable to do further business and repay and Bankers had big headache; so, Bankers Master Planned to escape from the clutches of the scam that as follows.

After getting the Victimized Documents as collateral security in substitution of Chugh’s properties for the loans availed long time back, the Bankers had sold the properties of Chugh and reduced the liability to their convenient level and said TATA Bye Bye to Chugh and finally fooled Chugh..

We INDIAN ACTION PARTY strongly condemn and protest.

03. VICTIMISEE:

In the meantime the Victim Mr. A.C.S. Chellappa was searching for a loan of two to three lakhs, during that time one Mr. Kannan, a Finance Broker introduced the Bankers [Spidermen] of Vijaya Bank, Industrial Finance Branch 3042, [Spider-net] Ankur Manor, No. 182, Poonamallee High Road, Kilpauk, Chennai – 600010 to Mr. A.C.S. Chellappa son of S. Sundaram, aged about 73 years, Residing at No. 16/68, Perianna Maistri Street, Periamet, Chennai – 600003 and the Banker introduced Mr. P.C. Chugh to A.C.S. Chellappa.

VICTIMISED PROPERTY IN DISPUTE:

EMDTD All that piece and parcel of land and Very Old building bearing West Madras Municipal Door No. 28. 04 A. The Guideline value of the said property in the year 2005 was 23,00,000/- [Rs. Twenty Lakhs only] and the Banker’ Valuae’r Report was Rs. 43,00,000/- [Rs. Forty Three Lakhs only].

Taking the said [Disputed] Property as collateral security for Rs. 1,40,00,000/- [One Crore forty Lakhs] against existing loan beyond the value reveals the Criminal plan of the Banker and force to treat the Banker as the first Accused and worst criminals in this case. If at all Bank intends to provide fresh loan on third party collateral, Bank should follow the Norms framed by Reserve Bank of India and that which cannot not exceed 34% of the Market Value.

05. The Bankers, Mr. P.C. Chugh and Mr. A.C.S. Chellappa had a meeting on Monday the 25th April, 2005 in a Restaurant, one of the Banker lied to Chellappa that P.C. Chugh had approached Vijaya Bank for a fresh loan of Rs. 20,00,000/- [Rupees Twenty Lakhs only] and that the Bank was willing to provide the said loan on security of third party collateral.

05 A. Mr. A.C.S. Chellappa had told the banker that the said property originally belongs to his wife Mrs. Vijaya Bai and under went Settlement, supplementary settlement and Revocation.

05 B. The Bankers had visited the premises of Vijaya Bai and had seen her bedridden since 3rd January, 2005 due to right side paralyzed attack and further she had a serious illness due to cancer in gallbladder because of stone grown and her body condition was unfit for operation and she was in a coma state. Later the innocent Vijaya Bai died without any knowledge of these criminal transactions on 4th Jan, 2008.

06. Even after seeing her bedridden the Bankers knowingly asked, if Chellappa could furnish the original title Deeds of the said property and sign wherever required and the bankers had told that they will take care. Further it is understood from Chugh
that the Senior Manager had suggested the first plotted plan that Chellappa, should become a Director of M/s. Macenzie Exports
Pvt Ltd,. before Registering any Document or signing the memorandum, this Master plan reflects in the legal opinion, as
‘Abundant Caution’ given by the Bank’s Panel Advocate Mr. S. Jayakumar.

06 A. Accordingly Mr. P.C. Chugh had given a proposal in writing to Chellappa. And both signed a Memorandum o[censored]nderstanding that was brought by Chugh. And Chugh also issued a Cheque for Rs. 20,00,000/- [Rupees Twenty Lakhs] without date and Chugh took signatures of A.C.S. Chellappa in few printed papers and blank papers. Chellappa had signed all in good faith, without the knowledge of Chellappa, Chugh made him a Director of his company on the 19th Day of October, 2005 and on the same day Chugh cunningly eliminated his father-in-law Mr. S. P. Chattarjee, from the company because Mr. S. P. Chattarjee’ property is under mortgage. To this deal Rs. 420,000/- [Rupees Four Hundred and twenty thousand only] was fixed and that to be paid by P.C. Chugh. Rs. 4,00,000/- [Rupees Four Lakhs] to Chellappa and Rs. 20,000/- [Rupees Twenty thousand] to the broker.

07. As Mr. Chellappa was terribly in need of money to give treatment to his wife and to run the family, he agreed to the idea proposed by Bankers and Chugh.

08. Banker had maneuvered the encumbrance certificate without reflecting:

01. The registered deed of settlement dated 2nd Day of January, 1960.

02. Supplementary Settlement Deed dated 4th Day of February, 1976.

03. Deed of Revocation dated 17th Day of July, 1979.

and had arranged a stranger and Manufactured an Impersonated Power Deed in favour of A.C.S. Chellappa as if executed by Vijaya Bai, the Power Deed was forged with signatures impersonating Vijaya Bai further the stranger had subscribed her left thump impression in the fabricated Power Deed whereby the Power Deed is null and void hence the activities of the fraudulent by the said Power Deed does not imply to Original Vijaya Bai and the said stranger Duplicating Vijaya Bai is still alive willing to give confessional statement before the court of Law while the Original Vijaya Bai is Dead.

09. According to their master plan, the Bankers Technically split the Registration into two parts, One On 11th November, 2005 Mr. Chellappa was taken to Sub-Registrar’ Office at Periamet to Register a Memorandum of Deposit of Title Deeds, for and against the whole loan of Rs. 1,40,00,000/- while there were few other properties already in Mortgage sufficient to meet the loan but the bankers had cruel plan to sell some of the properties and substitute with Vijaya Bai property till the Month of May, 2006. In the month of June, 2006 the Bankers sold Chugh properties without the knowledge of Chellappa.

09 A. The Bankers took signatures of Chellappa in some printed papers and blank papers. Then Mr. P.C. Chugh paid Rs. 1,00,000/- [Rupees. One Lakh] to Chellappa and promised to pay three lakhs on 14th November, 2005.

10. Subsequently On 14th November, 2005 Chellappa was taken
once again to Sub-Registrars Office at Peramet to sign an illegal Document after which Chugh paid Rs. 2,80,000/-. Chellappa is totally victimized and being cheated.

11. Mr. P.C. Chugh promised that he will release the documents within six months. Using the financial crisis the Bankers and P.C. Chugh had victimized A.C.S. Chellappa and thus Chellappa is injured jointly.

12. And Chellappa was asked to sign in a Declaration and some one was arranged by the Bankers for the second time to Duplicate Vijaya Bai and the impersonator had signed the signature of Vijaya Bai in the Declaration brought by the Banker and being attested by a foolish NOTORY, hence the forged signatures Impersonating Mrs. Vijaya Bai differs from one another.

12 A. Two different persons Duplicating Vijaya Bai Disguised her. Dupes were engaged by the Bankers to impersonate Vijaya Bai at two different occasions.

AND

In fact the original signature and Thumb Impression of Vijaya Bai is very much available in

01. The Registered Settlement Deed dated 20th Day of January, 1960.

02. Supplementary Settlement Deed dated 4th Day of February, 1976.

03. Deed of Revocation, dated 17th Day of July, 1979.

04. And few other Important Documents.

All Registered at the Sub-Registrar’ office at Periamet and also reflecting in the Original Records Maintained by the Sub-Registrar, Periamet.

13. Later Chellappa was tortured to pay 71,00,000/- [Rs. Seventy one Lakhs] to the Bank in order to release the documents and Chugh mercilessly insisted Chellappa to sell the property, giving a false promise that he will repay the said Rs. 71,00,000/- [Rs. 71Lakhs] in 10 years period of time while Chellappa was counting his last days, all of the sudden Chugh gave a shocking news that the bank is demanding Rs. 75,00,000/- that news mentally tortured and killed Chellappala on 9th Day of January, 2010.

Let the curse of Chellappa, whole mankind and Almighty God be on the Cruel Bankers and their family.

14. According to the Correspondence Made by Chugh to the banker, his letters reveal the truth behind the whole play made by the Banker, no where the banker refused to the accusation made by Chugh. Mr. Chugh was approached by the members of Indian Action Party. On the request of Mr. Chellappa, Party had
Collected some documents from Chugh forcefully and found the entire operation made by the Bankers and Chugh.

15. The banker had planned to get a third party collateral and sold the property of Chugh to reduce the liability and now holding the victimized property of Chellappa. All these loans were given long time before Depositing the Title Deeds of the said property.

16. The bankers were well aware that they had given excess unsecured loans beyond the limit to Chugh and they knew that Chugh will not be repaying, lead to the headache for the banker, to find a remedy as such a criminal plan had been plotted by the bankers and purposely brought in an innocent victim Mr. A.C.S.
Chellappa. No loans were given against the said property and the cover note and declaration made on the property is for Rs. 1,40,00,000/- [One crore and forty lakhs] beyond the value [Rs. 43,00,000/- Rupees Forty Three Lakhs].

17. P.C. Chugh for ‘naam kay wasthey’ for name sake had transferred the title of his flat which was kept as collateral:

to his friend Mr. Basker and Chugh is paying a monthly EMI of Rs. 40,000/- every month to kotak Mahindra Bank and staying in the same apartment which was vested with Vijaya Bank as security for his loans.

18. First of all let the Bankers go to Kolkatta and auction the property of Chugh’s father-in-law which is under collateral with Vijaya Bank:

19. If we challenge the signature of Vijaya Bai one between the other on which bankers are relying upon. It will be proved that all are fabricated and hence the documents are null and void.

20. Mr. Chugh had corrupted the banker and had obtained loans beyond the security given by him. The bankers in order to safe
Guard, had cruelly planned and victimized an innocent person Mr. A.C.S. Chellappa.

21. We wonder: Why Bankers behaving like a cheat?.

Bankers were doing nothing since 2005 only waited for the death of:

01. Mrs. Vijaya Bai.

02. Mr. A.C.S. Chellappa.

As they expected both the victims died after which Bankers now started and trying to snatch the property of the innocent people. RIDICULOUS.

Let the bankers answer.

01. Is it true or not?.
02. What for they have been waiting since 2005?
03. Why did they not taken any action against Chugh?
04. Why did they not attack Chugh’s property at Calcutta?
05. Is Vijaya Bank, ‘A FRIEND YOU CAN BANK UPON’?
06. Are they not fraud?
07. Let the Bankers show cause, why a criminal case should not be filed against them?
08. Do they want us to go in a Democratic way?
09. Or to be given to third grade politicians to deal with?

22. Suggestion:

A complaint could be filed U/s. 200 r/w 243 and 315 Cr.P.C..

Charges are Punishable U/s. 420, 406 and 506 [ii] IPC.

23. FINAL: Finally Mr. A.C.S. Chellappa, the poor Victim died on the 9th Day of January, 2010 say, he was tortured and killed by the Bankers indirectly.

TAKE NOTICE THAT VIJAYA BANK SHOULD REPLY WITHIN 14 DAYS OTHERWISE THE SCAM WILL FLASHED IN ALL NEWS PAPERS AND MEDIA. THIS GOING TO BE THE TALK OF CHENNAI LIKE NITHYANANTHA.
BUT WE HOPE YOU WILL NOT PUSH US TO THAT EXTREME TO BRING YOUR TRUE COLOUR BEFORE THE PUBLIC.
