COMPLAINT UNDER CONSUMER PROTECTION ACT 1988 FOR REFUND / REPLACEMENT OF REFREGIRATOR / Amount ____ WITH INTERSEST @24%P.A ALONG WITH DAMAGES FOR MENTAL / PHYSICAL DAMGES OF RUPESS 50000.00 for in-convince caused to 02 minor children’s for 06 months.

It is most respectfully submitted as under



Sir: Madam,
A. I purchased a whirlpool refrigerator on the advertisement of responded number 1, through responded number 2.
B. That right from the beginning of purchase of refrigerator I made various complaint to respondant number 1, but in vain and the said refrigerator gave many problems with in guarantee / warrantee, but no one attended my complaints resulting in complete failure of the said refrigerator since feb 2011
C. That on the negligence of the dealer responded number 2, I made various enquires from responded number 1 and sent SMS at number 58558 and complaint at toll free numbers[protected]. But Shree Manish Kumar replied back asking for the visitation charges , but being in guarantee / warrantee I refused to pay any charges for inspection of the refrigerator within the warranty period.
D. That on the attitude and negligence on part of responded number 1, I again approached responded number 2, to replace the refrigerator or re-fund the entire amount of Rs33000.00, but found that the responded number 2, had wound up its business at Raja Garden.
E. That the respondents have will fully neglected their own product with manufacturing defect sold to the complain tent against full and final payment, against the receipts and guarantee card ( enclosed)
F. That there has been a will full deficiency in service and de-fault on the product sold to the complainant.
G. That the complainentent on account of negligence of the respondents has spoilt food of her minor children to the tune of about Rs 50,000.00 in the past one year, when the respondent ignored the complaints of the complaintents on telephone / SMS and otherwise.
H. That on account of above conduct of the respondent the complaintent and her minor children including the senior citizen of the family suffered mental and physical humiliation to the tune of Rs 1,00,000 and damaged food articles to the tune of Rs 50,000/-
It is therefore prayed at the responded may be directed to replace the refrigerator immediately or re-fund the amount received with interest at the rate of 24%p.a and respondant may be directed to pay the above damages for harassment, mental and physical humiliations, as the above damages of spoiled milk / Veg’s / Fruits on account of the defective refrigerator sold to the complaintant.
Any other relief are liable forum may deem fit by the compensating the complitant and punishing the respondants be given to the complaintant in the interest of justice.
