[Resolved]  Kohinoor Televideo Pvt Ltd — Unfair Trade practices

This is with regards to Samsung Galaxy Note 2 mobile phone that I have bought from Kohinoor Electronics, Andheri West Branch (Shop No. 1, Fortune Terrace, New Link Road, Andheri West, Mumbai - 400 053) on 6th December 2012, I would like to put it on record that it has been a very unpleasant experience. The way it happened...

1) On my visit to the above mentioned Kohinoor store on 6th December 2012 morning, I was attended by the store owner Mr. Rahul Mewani. On requesting for a good deal on the desired phone, he was kind enough to give me a discount on the same. The offer given to me was Rs. 36,500 for the Samsung Galaxy Note 2 phone + Rs. 1,500 for it's original cover.

2) My intention was to buy the phone on Easy Monthly Installment (EMI) of 12 months, so I enquired about the same from Kohinoor, and as Mr. Rahul had limited knowledge about it, he asked Mr. Bunty Dawani to attend to my query with regards to payment in EMIs. Mr. Bunty explained the HDFC Credit Card EMI offer to me in a very simple way and suggested that the total amount i.e. Rs. 38,000 that will be charged on my HDFC Credit Card will be converted into 12 equal EMIs automatically by the bank, and a flat processing fee of Rs. 500 will be charged by the bank for the 12 month EMI offer.

3) As I had a credit limit of Rs. 35,000 in my credit card account at that time, so I asked Mr. Bunty if the swipe will be for total amount or Monthly EMI amount. He told me that the difference in the credit limit can be paid in cash or by other credit card, and amount of Rs. 35,000 will be converted into 12 equal EMIs automatically by the bank.

4) Also as I was also approaching my new credit cycle I asked him if the 1st EMI will be deducted in this cycle or the next one, Mr. Bunty said that you will have to check with the bank, which I did on my own and got answer from the bank.

5) After making up my mind to buy the phone from Kohinoor, on way to the cash counter the sales representative who accompanied me asked me whether I would like to go for the 9 month EMI option or 12 month EMI option, on asking the difference between the two I was told that there is no difference and also the processing fee charged for either options will be Rs. 500. Then, while making payment at the cash counter the same thing was asked by the cashier, i.e. 9 months EMI option or 12 months EMI, on asking the difference again the cashier explained the exact thing that was explained by Mr. Bunty as well as the sales representative.

On 9th December 2012 when my credit card statement was emailed to me it came as a total shock, I have been charged for 4 EMIs in a single month and that is due for payment in this cycle itself. When I enquired with the bank they said you will have to talk to the merchant as they are the one's who have asked the bank for 4 EMIs as advance, and when I spoke to Kohinoor after that they told me we that we always take 4 advance EMIs.

I spent almost an hour in total in the store and no one from the store informed me before buying the phone that 4 advance EMIs will be charged from my first cycle, niether at the time of negotiating the phone deal, nor when I was enquiring about when it will reflect in my credit card statement and not even when I asked the difference between 9 month EMI option and 12 month EMI option. At the time of buying I was told no difference in 9 or 12 month EMI option, and total will be divided into the respective EMI option chosen by me. Now after I have been charged in my credit card statement I am told 3 advance EMIs are charged for 9 months and 4 advance EMIs are charged for 12 Months EMI option.

This is purely a case of cheating and misguiding the customer, the store owner Mr. Rahul and his employees say nothing can be done about it.

I have no intention to pay 4 EMIs as advance, this is highly unprofesional and I request you to look into the matter ASAP.
