[Resolved]  Ebay.in — a brand-new imported xiaomi mi mix 256gb duos/6gb/6.4" bezel less screen/16mp/5mp-black-item no.[protected]

For your kind attention: (Dates & events):
A brand-new imported xiaomi mi mix 256gb duos/6gb/6.4"bezel less screen/16mp/5mp-black-item no.[protected] – item described by ebay.in as if ‘”available – in stock”
Date of payment:- 15.02.2018 & my paisapay id: [protected].
Date of delivery as described by ebay.in:- between 19th feb. 2018 – 20th feb. 2018. But the item has not been delivered to me (Till now) as informed by ebay.in. On 19.02.2018 ebay.in requested me to accept “extension request” thereby assured / promised me to deliver the item within few days. As per their request, i have approved “extension request” on 19.02.2018. At that time, ebay.in also assured / promised me to deliver the item on or before 24th feb. 2018. But contrary to that, now they have informed me that the said item is yet to be shipped and will be delivered soon (Even without mentioning the date of delivery inspite of my repeated request).in this connection, periodically i have sent several emails to all of them (Ebay.in), thereby requested to resolve this issue and try to deliver the item on or before 24.02.2018 as promised / assured by them. But, instead of resolving this issue and deliver the product to me, the entire ebay.in personnel have given false / inconsistent / misleading statements through their several emails right from 19.02.2018 till now. That apart, ebay.in has also informed me by saying that “in this case if the courier company fails to deliver the product by 09-mar-2018 then you can initiate a refund request.
Earlier, one of the ebay.in personnel assured / promised me to deliver the product on or before 24th feb. 2018, the other informed me by saying that “… i noticed that the courier status for the mentioned item shows as delivered to your shipping address on “date”, by providing docket/airway bill details:[protected]& courier name: blue dart …” and the other informed me by saying that “… the product will be delivered to you soon …” (These are all few examples for their (Ebay.in) inconsistent / misleading statements).
While so, i don’t know whether the item was shipped and ebay.in has initiated any steps to deliver the item to me. Nothing was found in the tracking details (Except “to be shipped”) and also no response from their side till now. Adding insult to injury, ebay.in has periodically sent some emails to me thereby induce to purchase the same product again as the said item (Mobile) is “available – in stock”. I don’t know whether this particular item is available with them or not …? According to them, if it is very much available with them, they ought to have delivered the said item (Mobile) to me in time. But till date, ebay.in has not delivered the said product to me inspite of my repeated request through several emails.
But right from 19.02.2018 they repeatedly sending emails to me by stating that:-

• “… we have escalated this concern to our logistic team to get the shipment shipped at the earliest. Once it gets resolved you would be intimated…”
• “… we request you to kindly allow us the time of 48-72 hours to look in to this matter and resolve this problem...”
• “… we checked the details the order was not yet shipped and it is “seller is ready to ship item, inform lp".
• we request you to kindly wait for the order to be shipped …”
• but they never informed me about the actual date of delivery inspite of my repeated request.

The most unkindness and lethargic attitudes of ebay.in as stated above are unfair, unjust and unethical. For the aforesaid reasons, i totally lost faith on ebay.in. And consequently i have a doubt whether ebay.in will deliver the product to me or refund my money (Rs.39, 750/-) immediately.

Therefore i request you to take suitable action in this regard and resolve this issue immediately.

Yesterday, i.e. on 28.02.2018 you have (eBay.in) informed me that “… The seller is unable to ship the item by 28-Feb-18 and has refunded the amount to you with the message " as we don’t have stock ". You can check the status of the refund in the item receipt section below …” and in the Item Receipt Caption, it was mentioned that “… The seller initiated a refund for this item on 28-Feb-18. You should be able to see a refund for the amount of Rs. 39, 750.00 in your credit card statement / bank account within 3 working days …” At this juncture, with fond hope I am waiting for the refund of amount which I have paid on 15.02.2018 anticipating that eBay.in will refund the same within 3 working days from 28.02.2018.
Now you (eBay.in) are saying that “… We are sorry to hear that you've been having this experience. Since we can't reach you so you can contact us here …”
Please Note: Just now I have noticed in one of your (ebay.in) websites & through some other websites (alert messages) and also in my Facebook ad (as forwarded by you), I came to understand that the said item (A Brand-New Imported Xiaomi Mi Mix 256GB Duos/6GB/6.4" Bezel Less Screen/16MP/5MP-Black) is very much available with you (eBay.in) with varying prices and I have the proof for the same. Are you playing hide & seek game …? Don’t try to fool the customers like this …

Therefore it is crystal clear that eBay.in again & again giving FALSE / INCONSISTING / MISLEADING STATEMENT in this regard, which I found from the reliable sources. This is totally unfair, unethical and against the trading practice & you should not mislead the customers thereby enrich yourself. In the subject matter of this issue, I got frustrated and totally lost faith on eBay.in.
For the aforesaid reasons I reserve my rights to initiate necessary legal action against eBay.in in a court of law for appropriate reliefs regarding breach of trust & deficiency in service on the part of eBay.in apart from other damages (IF NECESSARY).

This is in connection with recent conversation (dt. 03.03.2018 at about 11:57 AM) with one of your officials (eBay.in) who contacted me from Mumbai (Contact No. [protected]) over my mobile number regarding “REFUND” and also in confirmation of the same I am sending this email. During conversation, I have accepted your request to extend the period of “REFUND” till 05.03.2018 and you promised me to refund the amount of Rs.39, 250/- (Rupees Thirty nine thousand two hundred and fifty only) on or before 05.03.2018 and intimate the same to me.
Please Note: If you failed to refund the amount as said above, I will take necessary legal action against all of you (eBay.in) in a court of law for appropriate reliefs and this is not for scare you.

At this juncture, in your recent email dated 28.02.2018 you have specifically mentioned that “… The seller is unable to ship the item by 28-Feb-18 and has refunded the amount to you with the message " as we don’t have stock ".
