[Resolved]  Educomp Solutions Limited, New Delhi — CHEATING SCHOOLS WITH EDUCLASS INTERACTIVE systems

Highly respected Sir, Sub: Cheating under the name of EDUCATION CARE by 1. Educomp Solutions Limited, New Delhi and 2. Edu Smart Services Private Limited, New Delhi [protected][protected][protected]------ We bring to your kind notice, sir that we are techno savvy people and we impart fulltime education to rural students here with nominal fees. Taking advantage of our spirit, the above firms played mischief with many schools in AP and the same, they want to play with us also. They have failed to implement the project till date from February 2012 (first time they approached us). Having spent lakh of rupees on publicity and having spared a well furnished class room for placing the EDUCLASS INTERACTIVE MODULES HARDWARE AND SCREEN, since June 2012, we chose to complain to your Hon’ble selves to take cognizance of this kind of cheating by DELHI based outfits. We never had the opportunity to visit New Delhi till now, but those two firms with as mentioned below, have cheated many schools. We request you to arrange to take action against them and make good our loss. We provide you the information as to how this cheating took place step wise and request you to do the needful in the interest of Rural Education in India. (1) “Educomp Solutions Limited”; Address as provided in their papers 1211; Padma Tower-1; 5, Rajendra Palace; New Delhi-110008 through its Managers Mr.Ravi (+91 [protected]) and Mr.Viswanatham (+91 [protected]) approached us in February 2012 with proposal to install ‘EDUCLASS INTERACTIVE’ equipment to provide students with advanced learning through computer interactive sessions/ classes. (2) As such advanced learning techniques were need of the times, we asked for demos to evaluate the quality and precision of the project. (3) “Educomp Solutions Limited” brought some person in 1st week of March and introduced to us as the Hard Ware Engineer from the firm “Edu Smart Services Private Limited” (Address as provided by them WZ 931 A/2, Street No.14, A/2, Sadh Nagar, Palam Colony, New Delhi-110045) and arranged a demo using their LAPTOP before all our staff. (4) All o[censored]s liked the process and decided to avail their service, unfortunately without properly enquiring about their credentials and service. (5) As we agreed to have the service, Mr.Ravi, Mr.Sekhar and someone from “Edu Smart Services Private Limited” approached us in last week of March 2012 and explained how they would execute the project to the advantage of students in our School. As part of execution of project, they undertook to provide a class room with Interactive Equipment and screen, to upload the necessary soft ware for interactive sessions, to maintain the equipment, to update the soft ware from time to time, and to ensure smooth functioning of total project. (6) As they took responsibility to ensure smooth functioning of project, we provided them with a suitable room in our School Premises for installing the equipment and entered into an unregistered ‘TRIPARTITE AGREEMENT’ on 26/3/2012 in our premises at Diwancheruvu Village, Rajanagaram Mandal, East Godavari District, Andhra Pradesh. The above two firms formed as Part ‘A’ and ‘C’ and ourselves being Part ‘B’ to the “Pre-printed Stamp Paper Rs.50/- bearing No.AA 484836 without vendors and buyers particulars”. When we asked about sanctity of such unregistered agreement on just unauthorized stamp paper, they admitted that that was just a formality to denote transaction having taken place. (7) As the deal was finalized, Mr. Sekhar came to us on 13/4/2012 and asked for advance payment towards cost of INTERACTIVE MODULE HARDWARE. We paid Rs.5000/- in cash to him and as he requested for Blank Cheques for balance cost of INTERACTIVE MODULE HARWARE, as mentioned in the unregistered tripartite agreement @ 4.4.1, we tendered FOUR Blank CHEQUES of SBI/DIWANCHERUVU bearing Numbers 459850 for Rs.10, 000/-; 459851; 459852 and 459853 each for Rs. 15, 000/- with unwritten understanding that each cheque would be presented for payment at the end of each quarter with prior permission from us as to satisfactory maintenance of systems by the above two parties. (8) Mr.Viswanatham, manager, “Educomp Solutions Limited” informed us in May 2012 that equipment arrived through parcel service and we received them on 30/5/2012. We launched a big campaigning in all the villages around to educate people of this new INTERACTIVE EDU CLASSES with huge expense of nearly a lakh rupees in anticipation of project being implemented smoothly from June 2012 as agreed and provided to by the parties ‘A’ and ‘C’. (9) They were to fix the equipment and make ready the room for usage with EDUCLASS INTERACTIVE Software by June 2012. But they failed to start the class even by 3rd week of July 2012. Then the tussle started as there was a lot of pressure from parents of our students. (10) Finally with a lot of coaxing, the room was ready by last week of July 2012, but the required software was not loaded to make the systems work. After so much banging the party ‘A’ and ‘C’ arranged to load a the software in August2012 and the same stopped working within 16 working days causing a lot of discomfort to all o[censored]s. When fired, they admitted that pending a latest version of Software, loaded obsolete software, so it stopped working. (11) Again in September 2012, they loaded again the obsolete software and made systems to work temporarily only to demand first payment vide blank cheques. When we refused payment due to malfunctioning of software and also that they failed in their commitment, they surreptitiously presented the cheque in September 2012, and the same was bounced. (12) Mr.Viswanatham ([protected]) came to us and promised to set right the things from October 2012. He also promised that new software was expected before October 2012. So there would be no disservice from their end thereafter. Believing him we paid Rs.10, 000/- in cash in lieu of the cheque bounced. (13) Since September 2012, neither they made good the project nor attended to our umpteen number of calls. (14) Because of the failure and cheating by Educomp Solutions Limited and Edu Smart Services Private Limited, we have incurred a great monitory loss till date in addition to loss of reputation in the society. Sir, as the whole world is moving forward with innovative techniques in the field of learning, we wanted to follow the trend very passionately and in doing so fell prey to the dirty schemes of Educomp Solutions Limited and Edu Smart Services Private Limited. These firms cheated many schools in AP and black-mailed many schools with blank cheques and of legal suits from New Delhi Jurisdiction. We earnestly request you, madam, to look into this case and save Educational Institutions from being cheated. Thanking you, Yours faithfully, Venkatrav Tikkana Godavari Vidhya Peetam Diwancheruvu, Rajanagarm Mandal East Godavari Dist, AP
