Dear sir,

Most humbly & respectfully, i wish to inform you as under:-

1. I have applied for balance transfer/top up of loan from your institution to nkgsb, jogeshwari (East) mumbai in the end of july’2017 from gic borivali (West);

2. I have visited the gic bvi branch with branch head mr. Vasanth of nkgsb, jogeshwari, who wanted to inspect the original documents on 1st or 2nd of august’2017. The original documents of property mortgaged were very much there in the gic bvi branch and were shown to branch head nkgsb with the permission of branch head of gic/bvi mr. Nayan ghagh. The branch head of nkgsb had handed over a letter in which nkgsb bank had given its consent for taking over the mortgage loan by balance transfer from gic to nkgsb;

3. As per statement given by bic bvi for rebate in income tax the opening balance as on 01.08.2017 rs. 11, 15, 914/-. The same is shown gic bvi detailed statement (Copy of statement and receipt dated 10.08.2017 is being enclosed herewith for your kind perusal and ready reference please);

4. Ironically, my bank (Nkgsb) was told to pay rs.11, 29, 998/- (Without informing me) paid by nkgsb’s banker’s vide gic/bvi receipt no. Borivali 58 dated 10.08.2017 with a bifurcation of emi rs.11, 14, 974/-+rs.600/- towards borrower adjustments+ emi of aug, 2017 rs.14424= rs.11, 29, 998/- (Whereas the payment was made on 10.08.2017). Why advance emi of august 2017 was charged when the payment was made on 10.08.2017 by banker’s cheque. Despite my best efforts i am failed to understand why advance emi was charged as due date was 14/15-08.2017 and i have paid my instalments up to july’2017. Apart from that the original documents which were very much there in gic bvi branch on 1st and/or 2nd august’2017 were not handed over to branch head nkgsb jogeshwari for custody on 10.08.2017 the pretext that same have been sent to their some office in rajasthan and/or belapur (As they themselves were not sure of as to where the documents has been sent) and finally the custody of same has been given on 01.09.2017;

5. To my utmost dismay, it is submitted that gic/bvi were aware of fact of closure of account by balance transfer on 1st & 2nd august’2017 as also told by branch head nkgsb jogeshwari to branch head gic on 1st or 2nd august’2017. Moreover, there were lots of holidays between 1st & 10th august, therefore gic/bvi claim that the original documents were sent to rajasthan and/or to belapur does not seem justified and looks like fabricated and fictitious so as to starve me in the similar manner as on one saturday (If you want details i can provide) i was called to come personally only to collect the documents viz. Statements for claiming rebate in income tax and list of documents with gic, as the neither the soft nor hard copy of the same (Duly authenticated on letter head with seal) can be sent by email & post. Since i had no option, so i visited gic/bvi office with my wife despite the fact that i was recuperating from “paralysis, seizure and convulsion”. Since, i was unable to climb bridges etc so it was not possible for me to come by train so i took cab and reached gic office by cab by spending rs.1600/- only to return empty handed. Please check with gic staff ms. Devaki who was in office & no authorize signatory was available. Gic/bvi also tormented me in the matter of foreclosure and interpolated 4% as foreclosure charges (I have record of it). Gic/bvi has only released the sealed and authenticated documents and agreed not to charge foreclosure charges only after i approached your nodal officer and general manager gic. Their act has particularly taken place despite the fact that gic was aware of my ailments and tormented me a lot in this matter too continuously causing me mental agony, stresses and strains. Although my doctors had advised me to refrain from mental stresses & strains, anger & tensions to keep my blood pressure and mental stature in control,

6. Now once again you are tormenting me (1) my bank paid you overcharged amounts and you have over charged me (2) released my documents on 01.09.2017 i. E after 21 days of payment was made (3) one instalment was charged extra (4) plus i had to pay the interest to nkgsb for no use as i had applied for balance transfer loan with top up which i could not avail till custody of mortgaged documents were handed over to nkgsb;

7. The amount i was supposed to pay on 10.08.2017 was rs.11, 15, 974+3976=1119950 plus rs.600/- g. Total rs.11, 20, 550/-

8. Plus i have paid an interest of no use as top up was not given till the documents were handed over on 01.09.2017 and i paid an interest of rs.11, 29, 998 for 21 days rs.7, 801/-

9. Therefore, total extra amount paid by me is :-
Amount payable to gic up to 10.08.2017 rs.11, 20, 550/-
Amount pad by nkgsb on 10.08.2017 rs.11, 29, 998/-
Overcharging by gic rs. 9448/-
Plusamount paid as interest to nkgsb (21 days) rs. 7801/-
Taxi fare for useless visit to bank rs. 1600/-
Amount due from gic rs. 17409/-

While informing you the above facts & truths with documentary evidence, i request your honourable selves to kindly help me in retrieval of above amount with interest plus impose a penalty on gic for causing me “mental stresses & strains, anger & tensions to keep my blood pressure uncontrolled and mental stature was also disturbed by gic.

I have also asked about one dsa, his role and how far he been instrumental in my captioned loan of one mental stresses & strains, anger & tensions to keep my blood pressure and mental stature who was introduced to me by the gic employee. Gic has never replied on that issue.

You are requested to kindly look into the matter with a humble request to kindly intervene and sort out keeping in view that i am recuperating from “paralysis, seizure and convulsion”.

Dear Sir,

This is in response to your above said mail dated 14th November, 2017, we submit our say as under.

We repeat, reiterate and confirm our stands specified in our earlier mail dated 14.11.2017 and deny all your allegations and contentions that are contrary thereto and inconsistent with the facts.

Please note, we have clarified our position in detailed and in the event of you being ill-advised to choose any legal action against us, the same shall be defended by us at your cost and expenses.

The so called threat given of approaching Consumer forum, Regulatory Authority / NHB office is totally uncalled for and tantamount to blackmail and coercion. We will take strict legal action for defamation and damages against you in the event of you acting in an irresponsible manner which please you note.

I am herewith forwarding copy of letter from GIC Borivali dated 13.11.2017 & Copy of receipt [protected] Voc[protected] dated 10./08/2017 as an evidence that the claim of 14.5% interest & special scheme as mentioned in first para is an eye wash, baseless and window-dressing has been done by GIC BVI to save & side line their own mistake to torment me again & again as they have done on several occasion indifferent matters relating to my account while I am recuperating from serious ailments and provide medical papers. Therefore, I want a compensation equal to 10 times of my "original claim of refund" for causing me mental agony tormenting me and for having tried to dis-balance my medical conditions continuously. I am ready to contest this case anywhere in India in the presence of Regulatory Authority provided RUD's of the case are provided to me and role of Mr. Kishan Bhai Rajpoot is defined. As he knows every one if you want name/s of your officials that can be revealed. And if he was not the appropriate perso then why he was allowed to deal my case. Why I was not cautioned in this case.

At the cost of repetitions, I lodge a compensation equal to 10 times of my claim of refund. The proper notice is being prepared and will be served to to all concerns either today or by tomorrow by Post & Email.

SUBMISSION TO NHB

My Special request to Regulatory Authority is that is BT is a crime. If not then why GIC/BVI should not be reprimanded and/or are not liable for appropriate action.
