[Resolved]  HDFC Bank — sl crest - misleading / unethical practices while selling

Was approached by hdfc relationship manager for sl crest policy in 2014 when i opened savings account with them. He ask me to opt for this policy as it will help me in income tax stating that i can surrender the policy anytime of i do not like it.
I took this policy at 50k rs per annum in march 2014.
In february 2016 i wanted to surrender the policy and approach my relationship manager. He ask me to call his coallegue for from hdfc life and surprisingly i was told that i cannot surrender the policy before 3 year as i have to pay minimum 3 premiums under this policy. As it was matter of only a month i decided to pay the premium in 2016. As this policy was not paying good returns i wanted to surrender it and hence call my relationship manager. He again hooked up me with one of his coallegues who advised me to pay couple of more premiums (Total 5) and i will get good returns. Hence, i continue paying premium until 2018 and after 5 premiums were paid i call my relationship manager again through whom this policy was taken in kolkata for surrendering this policy. He gave me contact number of his coallegues again who told me that she is going to the concern office so the policy can be liquidated. Next day she ask me to visit nearest hdfc life office in mumbai/thane (As i reside in thane now) and submit the form for liquidating the policy. To my surprise again i was informed that there is a lock on period of 5 years and i cannot liquidate this policy before march 2019. I dropped a mail to selfcare (Hdfc) and i got a reply from kolkata branch that they are looking in the matter. I got couple of calls from the kolkata branch as well and since i did not pick then up as i was traveling abroad, i got a mail from the said representative that he wants to speak to me. I dropped him a mail that i will call him once i am back in india and gave him a call when i landed in mumbai. He told me that he is looking into the matter and wants to meet me (Probably wanted to sell me some product). I told him that i have left kolkata and hence we can correspond on phone / mail. After thay there was no call from his side, hence after couple of days passed by i started chasing him on phone. First my phone's went unanswered but finally he answered my phone and advised that this policy cannot be encashed before march 2019. I told him that i am ready to pay 1% or 2% penalty (Whatever it is) for early termination but need he money for some other matters. He advised that same is possible and copied mail to one of his colleague in hdfc life and ask him to get back to me. After couple of days i got reply from his coallegue that this policy cannot be encashed in any circumstances before 2019.
I have been calling my relationship manager in kolkata who is not answering my calls now for last one month after this episode. It looks hdfc bank pressurizes their employees to sell unsuspecting customers insurance policies by hook pr by crook and most of the times we buy products from this same relationships managers (As they come crying that they need to achieve their targets) in good faith who often mislead us without disclosing full details of the policies.
This is not the first product which hdfc bank have sold me with their unethical tactics.
On one hand we have a policy which is not paying returns and which i cannot encash (In short i cannot use my own money) and on other hand we have credit card interest rate which are quite high (Which means banks are extracting money from us giving false information and if we are not able to pay credit card dues on time we are charged at a very high interest rate. Indirectly for using our own money which is invested in banks).

I am planning to go legally against hdfc and suggestions are welcome. Can i go in consumer court??

I am also paying 13k per annum against hdfc ergo family plan for past 3 years (Last year i paid 18k) and i think it is better to transfer policy to some company like lic as i have lost my faith in hdfc bank.
It is better to bank with sbi.

I also have foreign inward remittance coming in under the company which i own and i have observed that hdfc bank does not deposit money in my companies bank account when they ecpect usd to fall against inr. They will hold the money for couple of days and convert it into inr and deposit it in my bank account when usd goes week against inr. (For example, my inward remittance didn't get deposited yesterday when usd had breached 68 rs. And when i went to bank today to enquire i was told that there was a system error yesterday hence funds could not get deposited in my company's account. (Also the exchange rate which was given was poor almost ibr minus 1 rupee).

Also i receive unsolicited phone calls from hdfc bank / hdfc life for marketing their products which is quite annoying.

Crooks... Don't buy policies from hdfc...

This complaint has not yet resolved as claimed by HDFC life. I have paid a total premium of Rs. 50, 000 x 5 installments. = Rs. 250, 000. As I was mislead ed when the policy was sold to me upon complaining in this forum, the company send me an email from [email protected] advising me that as a special case they allow me to surrender the policy before the due date (i.e. 5 year lock in period which was expiring in March 2019). I am stationed abroad, and i visited the HDFC Life Branch in Kapurbawdi, Thane on 12th September 2018 with necessary documents and copy of email which I have received from HDFC life and as it was only matter of 6 months for maturity I asked them what value will I get of I surrender the policy on the same day and expected value if I wait until March 2019. I was advised that the fund value as on 12th September 2018 would be INR 267, 000 and I will get same if I surrender the policy on that day. Also, this policy has no growth and there won't be any significant growth if I chose to wait until March 2019. Hence, I decided to surrender the policy the same day and was advised that the funds would be transferred to my HDFC Bank savings bank account within a week. On 17th September, I received a transfer of INR 200, 000.07 from HDFC Life instead of INR 267, 000 which I should have got. As, I am abroad I cannot call on their toll free number and upon regular follow up on email I was advised by HDFC Life that they have transferred INR 50, 000 on 17th September 2018. However, so far I have only received INR 200, 000.07 from HDFC life. I have already provided them with my HDFC bank statement 3 times for the period of 30th August 2018 to 08th October 2018 and the only inward remittance from HDFC life is for the amount INR 200, 000.07. Both HDFC Life and my personal banker from HDFC Bank knows this very well from 18th September 2018, however this are delay tactics from HDFC. This dispute is not yet close as I have not yet been paid in full and if HDFC Life delays it further I have right to make damages claims as my time is being wasted and I have lost my peace of mind due to this process.
HDFC Life customer support has been notified about the posted complaint.

As, I am overseas I visited HDFC, Kapurbawdi - Thane (MS) branch on 12th September 2018 with necessary documents. In view the policy was going to mature in March 2019, I ask them how much I would receive if I continue to keep the policy until March 2019 and what amount I will receive if I terminate the policy on the same day (i.e. 12th Sep).

I was advise by the lady on the counter that if I terminate the policy immediately, I will get my fund value on the date of surrendering the policy which was Rs. 268, 000 and if I decide to wait until March 2019, there won't be much growth in the amount as compared to the present fund value.
Hence I went ahead and surrender the policy on 12th September 2018 and submitted the necessary documents.

On 18th September 2018, I received a credit of Rs. 200, 000.07 from HDFC life. Since, I am overseas I am not in position to call on the toll free number which HDFC life has provided and there is not alternate number provided by HDFC life where I can make inquiries.

Hence I dropped a mail to HDFC life asking them, how come they have refunded only Rs. 200, 000.07 when my fund value on the date of surrendering the policy was Rs. 268, 000 and I had paid total Rs. 250, 000 (Rs. 50, 000 x 5 premiums).

As, I did not received any reply, I called my personal banker back in India and requested him to liaise with HDFC life. He was advised that HDFC life have remitted Rs. 50, 000 to my bank account on 16th September 2018 and Rs. 200, 000 on 17th September 2018. As, he had my customer ID, he cross checked same against my HDFC bank savings account and advised them that only Rs. 200, 000 have been credited to my saving accounts. There is no trace of Rs. 50, 000 which HDFC life claims to have transferred on 16th September. We are still waiting for HDFC life reply.

HDFC life is crook, I have paid total Rs. 250, 000 over 5 years (i.e. from March 2014 to March 2018, annual premium of Rs. 50, 000 each). They have used my money for 5 years and now don't want to refund back the fund value of Rs. 268, 000 which was there on 12th September 2018.

In fact, they have not even refunded the amount which I have paid until now.

First they have sold the policy by misrepresentation and now they don't want to pay me my fund value.

Please advise whether I can put a legal case against HDFC not only to recover my entire dues but also I want to put damage claims on HDFC.

I will like to advise all people to beware while banking and buying any products from HDFC as ultimately it is customer loss. There is no point in making this bankers richer. It is better to bank with government banks like SBI where charge are less compared to banks like HDFC.
Also, it is better in investing in products of LIC.

We receive numerous calls from HDFC bank employees (same when we visit their branch) who promise us various things while selling HDFC various products, but when there is a dispute, the same bank employees advise that so and so is a different entity.

Have received following mail on 02nd May 2018. However, will like to reiterate that I was not advised regarding the lock in period when the policy was sold to me any my personal banker that time had assured me that policy can be surrendered anytime whenever I want it and I can contact him if there are any problems.
It is a mis-sale, either your executives have no information about the product they are selling or they are under pressure to sell INSURANCE POLICIES by hook or crook.

Also, I have visited the HDFC Life Branch in Kapurbawdi, Thane in April 2018 with necessary documents and was advised that I can't surrender / encash the policy before March 2019.

Please note that HDFC Life does not encourage alleged discrepancies or issue any insurance contract based on incorrect information. As part of our internal policy, we always send the policy bond with all the supporting documents to the policyholder to reiterate the terms of the policy.

If you wish to surrender the policy, the Life Assured will not be covered for the risk benefits with immediate effect.

The amount payable on surrender will be the Unit Fund Value on surrender less the Discontinuance Charge.

If the surrender is in the first five years of the policy, the amount will be moved to a ‘Discontinued Policy Fund’ which will earn a minimum guaranteed interest rate as specified by the IRDA. A Fund Management Charge of 0.50% p.a., charged daily, will be levied on the ‘Discontinued Policy Fund’.

The amount allocated to the Discontinued Policy Fund, with accrued interest, will be paid out to the policyholder, or nominee if applicable, on completion of the Lock-in Period.

In case of the death of the Life Assured before the payment of the surrender benefit, the amount in the ‘Discontinued Policy Fund’ will be paid out immediately.

Once any surrender payment has been made, the Policy terminates and no further benefits are payable.

Kindly note on request of surrender after the completion of 5 years, the Unit Fund value will be payable immediately on receipt all relevant of documents. The policy will terminate immediately after this payment.

If you wish to surrender your policy, please visit any HDFC Life branch (http://www.hdfclife.com/contact-us/branch-locator) personally as we will be unable to accept surrender requests through third party submissions-

* Original policy document/ Policy Document Waiver form (attached)

* Self-attested copy of identity and residence proofs with the originals for verification

* Surrender Processing form (attached)
