Hero Motocorp — Mileage issue

Respected sir, I have purchased hero splendor ismart 110cc bike in July 2016 from Bhudia Auto Korba chattisgarh . from day one I have noticed that my bike's my mileage is not up to the mark . so I started measuring, each time it is around 40-45kmpl which is way below from what company claims . I complained about the mileage issue along with self start issue in all my three servicing, but none were fixed till date .
Now I really don't want niether the service nor bike anymore and want a refund instead
