ACC Has accepted the membership of a Illegal Governing Body as their members.
In this regard, please consider following points.
Point No-1: Article-6 of Law on Associations and Non-governmental Organizations
The law specifically states that Domestic associations or non-governmental organizations shall be required to register with the Ministry of Interior, Royal Government of Cambodia.
Pursuant to this requirement of law under Article 6 “any association or non-government” can only be considered as legal unless its registered with Ministry of interior.
Point No-2: Article-9 of Law on Associations and Non-governmental Organizations
The article 9 of the law, A domestic association or non-governmental organization shall become a legal entity from the date it is registered by the Ministry of Interior.
Also, Article 9 specifically states that any domestic association or non-governmental organization that is not registered shall not be allowed to conduct any activity within the Kingdom of Cambodia.
Pursuant to the requirement of the Law under Article 9 ACC can only consider any association or sports body that is registered with Ministry of Interior and shall allow to conduct any activity.
Therefore, ACC can not consider “Cricket Association of Cambodia” as a Legal governing Body since it is not registered with Ministry of Interior and shall not allow to conduct any activity in kingdom of Cambodia.
Point No-3: Article-20 of Law on Associations and Non-governmental Organizations
An association or non-governmental organization, which has registered or signed the memorandum o[censored]nderstanding, shall be subjected to the existing taxation regime law.
Pursuant to this Article- 20 the association must be registered with general department of Taxation (GDT) and file its monthly income & expense report and Annual Certified audited financial Balance sheet Annually.
“Cricket Association of Cambodia” recognized by the ACC do not have any respect to the existing Taxation regime Law.
Point No-4: Article-21 of Law on Associations and Non-governmental Organizations
An association or non-governmental organization, which has registered or signed the memorandum o[censored]nderstanding, shall be entitled to enter into contracts to cooperate with its partners for implementing its activities according to the existing laws of the Kingdom of Cambodia.
Pursuant to the Ariticle-21 only legally registered associations can sign the MoU with ACC for implementing the sports activities.
“Cricket Association of Cambodia” which is notregistered with Ministry of Interior Cambodia cannot be considered as legal Association or Non-Governmental Body, considering their application or any documents is absolute violation of the laws of the land.
In this context, ACC has made a decision which violates the Laws of government by recognizing a body of sports that is not having a legal status.
Unfortunately, Cricket Federation Cambodia Association has lost the trust of the public, the international Sports councils who support the development and assist in providing funds.
Therefore, you are requested to intervene in this matter and provide justice to the people of Cambodia and legal entity by restraining the decision to suspend the membership of "Cricket Association of Cambodia"
We’ve all got to play by the rules – ICC has been clear on this. Senior Sports officials of ACC must be held to a higher standard and lead by example because our public, sports community interests depend on it.
