Landlord — Flat owner deduct money from deposit | |||
I have a complaint against my Flat owner. On vacating the flat he has deducted rs 5000/-( out of total 40000/-) on the name of cleaning and touchup of flat. I inquired online on what legally can be deducted by landlord from deposit amount and i found below info:- 1. Holes in walls 2. Broken Tiles 3. Broken Walls 4. Removing paint if any done by tenant 5.Tears, holes or burn marks on carpet or curtains 6. Broken windows 7. Broken Doors and locks 8. Appliances broken. 9. Clogged drains you can get many more points referring to below link:- https://realestate.findlaw.com/landlord-tenant-law/what-can-a-landlord-deduct-fr...⇄ None of above things applied in my case. list of things that are generally considered as normal wear and tear which according security deposit law cannot be deducted from Security Deposit:- 1.Faded paint 2. Broken plumbing 3. Dirty blinds and curtain. 4. furniture mark in carpet 5. Dusting And many other things. We have not done any pin holes in walls to hang any item (watch or pictures) I have read that owner may be sued if he is unable to provide a written description of deductions . I have dropped him a mail asking for details but he is not responding. Neither he is reading the watsapp messages. I want the deducted amount to be refunded to me as he is not having any proper clarification for deductions. Regarding his unprofessional and rude behavior:- 1. Asked us to leave early but demanded full month rent:- Rent Agreement dated- Apr 15 to Feb 16. He asked us in Feb that he will be increasing the rent from April, so if we can pay the increased rent we can continue to stay in the flat. It was agreed that if we stay till March we can continue to stay at the same rent we were giving. But suddenly in March 1st week he asked us to vacate the flat by 27th Mar as his parents would be visiting Pune and will be staying in that flat. We decided to vacate the flat early by 20th Mar (as we were getting a flat ready immediately) and informed him, But he wanted rent to be paid for full month. We had to argue with him on not paying the full rent if we are leaving early, later he agreed to return the excess rent along with deposit but asked us to pay full moth rent for that time. 2. No communication for deposit return:- it was agreed that he will return the deposit by 1st week of April and accordingly we planned our expenses ( paying deposit/rent) for new rented flat but the flat owner did not make any contact till 8th April, When he just sent a watsapp message that he transferring amount and deducting 5000/- for cleaning, painting. And then he ignored all our queries on deductions, we tried contacting him by several ways, his relatives also did not pick my calls. After too many attempts, he called me and said he would be replying to my mail but no reply received. 3. While we stayed there, we reported few issues in his flat, he asked us to get it repaired on our own expenses as he will not be paying anything. We got the taps repaired on our own expenses. He is based in US but currently in India. We have only one contact number which is o[censored]S.
