This is regarding my Allotment of Virtual Space no 151, GF at MSX Mall Site –IV, UPSIDC, Greater Noida, Gautam Budh Nagar, UP, vide Application dated 22/10/2012. I have done the 95% (8.55 lac) payment on Feb 2013 and got cleared (payment receipts available with me) for the unit with area of 100 Sq ft. Builder complete name is MSX Mall Pvt Ltd and there Corporate office is at : 601-602, 6th floor, Ocean Heights, Plot No. K-4, Sector 18, Noida, U.P.- 201301. As per the allotment letter and agreement Builder has to give me Assured Rental after payment of 95%. After that payment in Feb 2013 my I have start getting assured rentals. In the starting I was getting 6 half yearly cheques which gone reduced to 3 going forward. I was getting letters from them to pay balance 5% amount with additional charges. Further I have paid balance amount of 5% and remaining payment for Balance and Additional charges with amount of Rs. 1.31 lac on dated 7/6/2014. Struggle to get the cheques for assured rental was already started till then. I have to give reminders to their representatives including Garima Aggarwal (one of the Director @ [protected]/[protected]), Naaz, Kamini, Zoaib, Faizuddin Khan and many more. I have to send SMS, mails and to do visits to their Noida Sector 18 office to get the cheques. I was getting cheques late on every quarter from year 2014 onwards. At times I have been able to receive and submit the cheques after 15-20 days after due date. Height is there when in the month of March 2015 there given cheque got bounced. After repeated messages, mails, reminders I have been told to represent the same cheque and they assured me that they will give me bouncing charges in my next month/quarter cheques. In the month of April 2015 I have got the cheques from April to June 2015 that too day night follow up without bouncing charges. I was feeling helpless and was visiting there office to get the money but nothing happened. Now Cheques from July 2015 onwards are exhausted and Builder is communicating that they will not give me further assured rental cheques. I have done SMS, Whats up, mails (all are with me in records) to the Director of MSX including Garima Aggarwal ([protected]/[protected]), Alka Aggarwa, M. S. Aggarwal and their representatives including Kamini ([protected]), Naaz ([protected]), Zoiab ([protected]), Faizuddin khan ([protected]) to get the cheques or to return my complete money paid to them but no one responding. I am feeling helpless as I am a simple salaried person. I have invested my hard earned money, my savings, taken loans etc. After this incident me and my family is living in mental, physical and financial stress. It is giving impact on my family health and just because of the Builder MSX Mall Pvt ltd, there Directors and representatives. Need your support to return my hard earned money from the builder. They are not even bothered to communicate me and to return my money. Please help and need support.

They are king of fraud. Delayed the project by 2 years and also had not given any penalty to buyers as mentioned in agreement. Now they are charging 200rs daily more in the name of electricity. at msx alpha homes

We need to collect and do lodge a case in NCRDC (NATIONAL CONSUMER DISPUTES REDRESSAL COMMISSION)
which is coming as tough on these kind of builders.

And then later NCDRC judgement can only be challenged in Supreme court, so Jaypee challenged it in Supreme court but Lost the case in supreme court also, finally gave the house possession to all people who filled the case in 90 days from judgement.

And we can also do the same but we need to have couple of shop owners in the same project or for same builder i.e. MSX developers, so that the value of our investment is more than 1 crore INR hence NCDRC can take our case and we also need to register an association for the same.

And then if we are more people then we can divide lawers cost also, which would e much lesser, Thanks.

The MSX Mall sufferers.

Please email me your number with clear subject line invested in MSX and with your shop number and contact details, and i will come back to you with next step, if you want to talk them to legal court or put them behind bars then we will get our money very easily. I have already done case on JAypee builder and for the same I have been consulting with many Sr. Supreme Court lawyers and some judges and after all the above have come to some conclusion which I can share with you if you prove you are the authentic owner of shop in MSX Mall and from there once I get customers with the net money which MSX owes to us more than 2 Crore INR, then you will see them behind bar in less than 180 days and you will get all your money with interest on delay in less than 300 days.

Just to give a glimpse of lawyers plan is to take them to NCLT (Delhi) and parallel launching FIR against them for fraud and taking them to EOW (Economics Offence wing) (for EOW we need to be more than 2 crore INR collectively) but we can still go to NCLT.

Under Section 12, Consumer Protection Act 1986 is as under:
Honourable Sir, The plaintiff pleas as under:
1) That the plaintiff is old and due to his advanced age, he did require a shop to manage his expenses in his old age and to fulfil this requirement of his, he was introduced to defendants no. 2), 3) and 4) who were representing the defendant number 1)
2) That the defendant numbered 3) and 2) convinced the plaintiff to invest in the shop in the proposed Janpath Street in MSX Mall Site IV, Greater Noida, Gautam Budh Nagar and assured the plaintiff that there would be no cheating or defrauding and explained in detail about the proposed scheme.
3) That in lieu of purchase of the said shop by the plaintiff he was assured of a return for the next 07 years by the defendants numbered 3) and 2) over the invested money. The plaintiff assured of the returns and satisfied by the scheme as communicated by defendants numbered 3) and 2) invested in a shop in the said Mall for his personal use vide agreement dated 12.09.2011 and defendant number 3) on behalf of defendant no. 1), entered into the said agreement with the plaintiff in lieu of Shop number JS-369 on the 2nd floor of the Mall.
4) That the plaintiff as per the agreement made a payment by two cheques on the same date totalling 95% of the total value of the shop totalling Rs 9, 49, 050.00 by two cheques drawn in favour of the said company, and the defendants encashed them and credited the proceeds to the account of defendant number 1).
5) That the defendant party started paying a monthly return calculated @ 14% per annum and amounting to Rs 11072.00 (per month) to the plaintiff beginning from 01.01.2012 and it was assured that possession of the said shop shall be granted up to 16.11.2018 and that the balance amount of 5% payable towards the cost of the shop shall be payable upon the execution of the property papers by defendants numbered 3) and 2) in favour of plaintiff.
6) That the assured return cheques amounting to Rs 11072.00 per month were paid by the defendants only from 01.01.2012 to 01.06.2014. On having failed to receive the cheques from July 2014, the plaintiff met the defendants at their office wherein he was assured that the defendants had not received the monies due to them from various sources and that all the balance amount in arrears would be paid up within 01 or 02 months upon realisation of the payment from their sources by them. It was also assured that the returns as promised would continue to be paid by them as per the agreement. That it was also assured that the possession of the shop Number JS 369 would also be handed over as per the terms of the agreement and within the stipulated time as defined in the agreement.
7) That the plaintiff subsequently visited the office of the defendants during September 2014, December 2014, March 2015, June 2015, September 2015, December 2015, March 2016, June 2016, September 2016, but every time the defendants cited paucity of funds as their inability in paying the returns regularly and would defer making the payments and always used to assure the plaintiff that all arrears would be paid but no return was received after 01.07.2014
8) That during this time the 2nd floor in the said Mall had been constructed and possession was being handed over and the plaintiff also went to the mall to take possession of his shop and approached the concerned representatives of the company for taking the possession of his shop. That on reaching the Mall the plaintiff learnt that the said shop no. JS-369 had been allotted to some other person, unknown to the plaintiff.
9) That when the plaintiff reached the office of the defendants number 1) and 3) in Noida, the defendants number 3) and 2) requested the plaintiff not to initiate any legal action against them and instructed defendant numbered 4) to make a statement of accounts to determine the amount due towards the defendant, and that the defendant numbered 4) made a statement of accounts on a plain paper and shared a copy of that with the plaintiff and according to which the defendants were liable to pay an assured return towards 54 months totalling Rs 6, 16, 872.00 besides handing over the possession of the shop number JS 369.
10) That defendant number 2) and 4) requested the plaintiff that they could offer possession of a different shop on the same floor to the plaintiff at the allotment rate of Rs 7400.00 per square feet and the balance amount of Rs 6, 16, 872.00 could be adjusted by increasing the original area from 83 square feet to 218 square feet, but that the plaintiff shall have to pay an additional sum of Rs 2, 57, 787.00
11) That the plaintiff agreed to have the possession of the alternate shop but refused to pay an additional sum of Rs 2, 57, 787.00. That upon the refusal for the additional area and a payment thereof, the defendants revised the area of the alternate shop to 183 square feet on the same floor to which the plaintiff readily agreed.
12) That the defendants number 2) and 4) disclosed to the defendant that the defendant shall have to surrender the original allotment letter of the original shop No JS 369 with the defendants and that they shall make and execute a fresh agreement with the new shop and area in square feet with the plaintiff. That the plaintiff out of sheer desperation and having no other option left with him, had to hand over the original agreement and allotment on the instructions of defendant number 2) and 3) with the defendant number 4) . Upon having handed over the allotment letter of the original shop no. JS 369 the defendant no. 3) assured the plaintiff that the new set of papers and a fresh allotment letter and physical possession of the new shop ad measuring 183 square feet shall be handed over to the plaintiff within a month and the documents shall be duly executed in favour of the plaintiff.
13) That the plaintiff remained under assurance from the defendant’s number 2) and 3) and when he approached them to have the documents executed and for physical possession of the proposed new shop, he was again asked to wait and that the documents would be executed in favour of the plaintiff in March 2017. That till date no such papers have been executed, nor has any communication or allotment letter been received from the defendants or any agreement received.

I think all the peoples who purchased property from MSX are suffering, I am also facing the same issue with MSX, I am having shop no. 97 at ground floor in MSX mall. MSX employee are very smart and each of them knows very well, how to make us fool. To fight against MSX, we need to fight together.
