Respected sir,

I am a resident of flat no. 801, c-wing, swapnalok society, khadki, pune– 411003.

I stay in my flat with my family. I wish to inform you that my family and i have been facing problems due to the illegal/unauthorised civil work of permanent nature done by the owner of flat no. 702, c-wing in our society.

The list of illegal construction of permanent nature carried out by the owner of flat no. 702, c-wing which has caused problems/issues to me and my family are as under:

1. The owner of flat no. 702, c-wing has illegally extended the dry balcony, due to which the duct is wrongly covered causing obstruction to the easementary rights i. E. Natural light and air in the duct for other occupants. Further, such illegal act of extending the dry balcony is very risky for the functioning of the building especially for critical repair work and fire related acts.

2. The owner of flat no. 702, c-wing has also illegally installed his water tank above the dry balcony area of flat no. 702, c-wing which is bulging out above the ground level of 8th floor, in the duct, which is supposed to be an open space and it is right opposite to the dry balcony area of my flat. This illegal act of the owner of flat no. 702, c-wing has caused and is yet causing not only irreparable harm, damage/ losses to me and my family but is a serious issue as it is blatantly violating the privacy rights and is a big threat to the safety and security of my family. Due to water tank being installed in such a manner, there is a gap through which any person could climb up and without any restriction can have an easy access in my flat i. E. Flat no. 801, c-wing from 2 (Two) sides i. E. Kitchen, 2 dry terrace and a terrace (Adjoining the master bedroom). Due to this, it is quite easy for a trespasser to commit criminal offence of theft/ robbery and other offences by entering my flat which is of high risk to my family especially, my young daughter and my bed ridden elder brother. Also due to installation of water tank, there is a huge problem of mice. The mice have damaged my furniture and the interiors of my flat. The mice have bitten off electrical wires and disturbing the electrical supplies many times and i have had to incur repairing costs for the same. I reserve the right to claim damages/ losses that have arisen and may further arise in future until the illegal and unauthorized constructed work by the owner of flat no. 701, c-wing is demolished/ removed.

3. The owner of flat no. 702, c-wing has extended his terrace area, adjoining his living room, illegally by affixing aluminium sheets with support of iron bars and filled the same with concrete.

4. The owner of flat no. 702, c-wing has constructed a permanent wall in the duct area adjoining his terrace of master bedroom blocking the natural light and ventilation space for other adjoining flats including my flat which was originally provided in the sanctioned plan.

5. The owner of flat no.702, c-wing has also installed iron bars along with aluminium sheets illegally on the refugee area of the building which is also a cause of grave concern. Due to such installation, people of the building have also started misusing the refugee area for their enjoyment purposes which leads to accumulation of dirt in the refuge area and the common passage on the 8th floor.

6. The owner of flat no. 702, c-wing has illegally occupied 16 square feet of passage space in the life lobby by extending his enterance.

Due to all of the aforesaid illegal and unauthorized civil work of permanent nature being carried out by the owner of flat no. 702, c-wing, the structural stability of the building is also in danger.

It is further submitted that recently the covid-19 lockdown has been lifted, due to which the owner of flat no. 702, c-wing can resume further work at any moment and continue with his further illegal activities without thinking of any consequences that may follow and also causing further nuisance, damage, losses, costs, etc. To my flat & my family.

Hence, i request you to please take a serious note of the matter at the earliest and demolish all the illegal/unauthorised civil work of permanent nature done by the owner of flat no. 702, c-wing at the earliest.

Almost a month but No action or any kind of inspection has been done yet. I atleast expected a fast course of action for such crucial matter. This is one of the reason people are unafraid of the law & get guts/bold for any such illegal activity & the complaint-ant looses faith.
