residing at 12, Ahilya Society, Yerwada, Pune – 411 006, I have to address you as
follows
I says that on 14th June, 2017 there was a heavy rain caused in
Pune around 4:30 to 5 p.m, which resulted into heavy damages and losses to
my house property. My client further states that initially they were (family)
of the opinion, that this destruction was caused due to the act of god,
however after perusal and inspection with the surrounding and adjacent
properties led them to the ascertained conclusion that such destruction was
due to the negligence exhibited by you all.
I says that the rain water, waterlogged and entered in their house
due to the unfair construction of vermiculture pit on the rain water drainage
channel constructed by the Goel Ganga Society which
resulted into chocking and blocking of the outlet of society drainage. As
there was no maintenance of vermiculture pit by any of you and hence it
collapsed in the drainage system and resulting into blockage of drainage.
I says that their house property is adjacent to the compound
of the Noticee No.2 Goel Ganga Society, where the above mentioned
vermiculture pit is constructed jointly to the said compound illegally. Hence,
the rain waterlogged and entered in their house with heavy force and became
the utmost reason for the destruction of house property. There was 2 feet
water accumulated inside their house and almost 4 feet height of watersurrounded by their house within 5 minutes of collapsing vermiculture pit.
My client’s 80 years old mother, 3 years daughter, sister and wife were
trapped inside the house drowned by the water and my client was so helpless
to help all, as he was unable to enter in the house by any means. My client
further says that he called all possible help such as neighbours, relatives,
friends, PMC Officers, Fire brigade and political leaders to take out his
family members from the house, however no one could rescue them as water
level was very high comparatively to the surroundings.
I further states that all his furniture, utensils, books, clothes, etc.
were floating and water was successfully poured in his car and bike parked
in his house premises. My client was in tremendous shock as he faced the
financial loss and physiological disturbance due to the unfair and illegal
construction of vermiculture pit, which collapsed in the rain water drainage
and became the reason of such destruction to my belongings and property.
I further states that, he alongwith his family was residing at his
relative’s house for one (1) month as it took almost a month to resettle in the
house property after carrying out necessary repairs and renovation. Further,
my client has to take leave for fifteen (15) days to resettle in the house
property.
Still municipal corporation officer are not working on it to fix the problem and can be repeat this problem for next year rain. So can you please take action against this ?
Builder has to pay our compensation amount also as it is because on his fault, but before that we need to fix the problem first ?
Please help as our corporaters are also not helping us
