Dear Sir, For compliance of your acceptance of O.T.S. proposal letter dated 01.01.2016 I sent my representative Amitabha Som to meet Deputy Circle Head, PNB Mr. N. Khatai posted at 125, Park Street, Kolkata who has given me to understand through Mr. Amitabha Som that once I deposit balance amount of Rs.4, 75, 000/- of the O.T.S. amount I will be entitled to return of my original sale deed dated 03.09.2002 and the bank authority will withdraw the Title Suit No.123 of 2009 of the 5th Civil Judge (Sr. Divn.) at Alipore and the letter of complaint dated 23.09.2011 submitted to Burrabazar P.S. Accordingly, I am depositing balance amount of the O.T.S. proposal being Rs.4, 75, 000/- for appropriation of the said amount against my Loan A/c. No.008900NC00001801 in terms of your acceptance of O.T.S. proposal dated 01.01.2016. I deposited Rs.25, 000/- on 14.09.2015 which has already been appropriated towards liquidation of my loan account as per your acceptance letter dated 01.01.2016. Neither I nor Sri Jayanta Deb Biswas and my mother Smt. Gita Deb Biswas have filed any case against Punjab National Bank and even I am not contesting the Title Suit No.123 of 2009 pending in the court of the Ld. Civil Judge (Sr. Divn.) at Alipore. It is pertinent to mention that one of the defendants Mrs. Nibedita Pattanayak of T.S. No.123 of 2009 filed a case being SA/11 of 2009 in the DRT – III, Kolkata against PNB for quashing the possession notice dated 23.04.2009 which has been disposed of by quashing the possession notice dated 23.04.2009 issued by the Chief Manager, Specialised SSI Branch, PNB, P-35, Cotton Street, Burrabazar, Kolkata – 700 007 and the Chief Manager, Specialised SSI Branch is also restrained to proceed under the SARFAESI Act, 2002 until disposal of Title Suit No.196 of 1999. Neither I nor Punjab National Bank is a party to the said Title Suit No.196 of 1999 which is being fought on different issues between the said Nibedita Pattanayak and Jayanta Deb Biswas. As after liquidation of the entire outstanding in my aforesaid loan account through compliance of O.T.S., the interest of the PNB will be totally protected and purpose of recovery will be fulfilled by recovery of the outstanding so the bank authority will not be needed to proceed against anybody through legal proceedings. Since the bank authority is also at present not a party in any case so nothing of the documents I filed in the bank for the purpose of obtaining loan will be required for future reference. In view of the above, I would most fervently request you to return my original registered Indenture of Sale dated 03.09.2002 (Deed No.6127 of 2002 of Additional Registrar of Assurance, Kolkata) giving me liberty to use my flat and also to withdraw the Title Suit No.123 of 2009 pending in the court of the Ld. 5th Civil Judge (Sr. Divn.) at Alipore and the letter of complaint dated 23.09.2011 submitted to the O.C., Burrabazar Police Station.
