Hi, i have booked a flat from salarpuria sattva (Cadenza). This project is jointly developed by land owner and salarpuria sattva. I booked this flat from land owner share. Sale agreement price was 75 lakh, including amenities, car parking and other things like club house, advance maintanance.
Sale aggrement was done on april 2017.
In sale aggrement they have not mentioned any tax component like vat or service tax.
Now after gst got implemented ther are asking for 12 % gst on the total flat cost.
Which is arround 9 lakhs.
I requested them to take the gst amount which is extra from earlier tax system.
They are not aggreing to my proposal.
They are saying either pay full gst which is 12 and 18 %.
They want to canel the flat now and discontinue the sale aggrement.
My question is whether they are legally right to take extra 12 % on the amount mentioned in sale aggrement?
If so, then whether they have not taken and given any tax to the government?
Why freshly they are charging extra 12 %?
