[Resolved]  Sterling Holidays Resorts — not refunding my money back

An executive of Sterling Holiday Resort Mr. Ankit (at Patna) called me for selling his product on 12th May 2017. After listening to him, I was impressed and wanted to take the product. The executive told me that the total amount to be paid for membership would be approx 2 lakhs but today we are offering it for around Rs42778/- and you can pay this amount in 3 equal instalments through credit card. Rest amount can be paid in installments. I felt it was a good deal and I accepted that offer. He took signatures on few papers and I paid Rs 42778/- through my credit card. After few days I had to spent some amount for family members, and was unable to continue with the membership, so I called Mr. Ankit and informed him that I would not be able to continue, so please get the membership cancelled and refund my money back. He said he will take that forward to the company and do the needful. Meanwhile, they also charged one installment of Rs9506/- through my credit card. Since that amount was charged, I had to pay and then I had to give instruction to my credit card for blocking the card. The card was blocked. so the total amount paid by me was Rs 52284/- After few days on 14th June’17, I received a mail from Sterling Holidays related to my membership. They sent me my documents with terms and condition. I saw in the terms and conditions it was mentioned that you cancel your membership within 10 days else your money would not be refunded. I was shocked to see that as the executive did not told me anything regarding the same.
I wrote a reply mail on the same giving all the reasons for cancellation and refund and also regarding blocking my credit card for further installments. They replied back according to the company policy now they cannot refund the money back as the due dates have been expired.
I also asked Mr. Ankit to please get the money refunded. He kept me giving assurance that he will get it done and took almost 5-6 months and then he said the company is not listening to him and now he won’t be able to help me in getting the refund. so you directly speak to them and take whatever action you want to do against them.
I again wrote to them and asked for the same and they replied that they will not refund the amount as per the policy and I have signed the documents also.
I have been cheated by their executive and now I don’t want to continue with them and want my money refunded back.
Requesting the forum to please get my hard earned money back. The amount paid by me is Rs52284/-
