[Resolved] Sulekha.com — owner refused to give back advance for his mistake | |||
We approached below flat for rent and gave 3000 rs advance on 17th of april 2019 and the owner said the house will be available from 22 or 23rd. We informed him that we have a dog and he approved it and took the advance. On 22rd he called and said he will not allow the dog inside the house, so i asked him to give my advance back as i will be looking for another house for rent. Despite giving my advance back he threatened me and said as there is no proof he won't give my advance back. Also when i confirmed with the apartment there is no woman called Anaya Kumar staying in that apartment.

Do you have any document with the landlord when he accepted you as a tenant and took the deposit from you?
Did you give the said amount in cash or in any other mode?
Do you have any texts or emails exchanged with the landlord?
If the answer to is yes to any two of the above, then you have few rights you can uphold.
If you cannot prove that the transfer of money ever took place, it will be very difficult for you to recover your money.
Shed more light and we can see if you have any route to recover your money back.
Also, please look online on the website, if there are any rights or protection available to the tenants from the business. Sometimes the business can refund your money to protect you as a tenant. But then again you will have to prove the exchange of the money between the two of you.
