Sub: Complaint against website designing company - TECHNIANS.COM
(Technians Softech Pvt Ltd).


Dear Sir/ Madam,

First and foremost, I would like to thank you for providing such a powerful platform to the consumers to raise their voice against unscrupulous and corrupt companies who try to make easy money from innocent people by trapping them with big advertising gimmick and then deny services after payment.

I am a biotech researcher in a Government institute in New Delhi. It is a matter of around June last year (2014) when I approached and made calls to some website designing companies and talked to them about building E-learning website. One of those companies (technians.com) started calling me repeatedly to convince me for handing over the project to them. They insisted for a meeting and in that meeting they were ready to accomplish everything which I suggested them (unlike other companies who were very clear in their approach and straightly denied the thing which they did not feel approachable).

To
be in a safer side I handed over the feature list of my website to them and
mutually signed over that in each page (myself (undersigned) and the representative
of Technians.com) along with the agreement.

I made the first payment (by cheque) of
Rs.12, 000/- in order to purchase the domain name of my choice i.e., PioneerScholar.com.
They again asked for Rs. 12, 000/- more for developing the homepage.

When they soon demanded Rs. 18, 000/- more I
objected and asked whether they are competent enough to develop a website,
because the homepage was very haphazard and not up to my expectation and
feature list (later I came to know that it was taken from a portal (vibethemes.com)
and sent to me as such).

I took a written assurance (email) that
after the payment of Rs.18, 000/- they will complete all the functionalities as
discussed in the feature list within fifteen (15) days as they have understood
all our requirements. [By this time I had paid Rs.42, 000/- to them. Moreover,
the way of demanding the money was very harsh and impolite].

After 20 days of the payment of Rs.18, 000/-
they did some minor modifications to the existing website and started demanding
the remaining amount of Rs.18, 000/-. When we checked the website and sent them
a list of errors to be rectified they resented upon it and threatened to
increase the fee by Rs. 15, 000/- per week. When we did not agree to any of
their conditions they assured us to rectify the list of errors only without any
further consideration. They even did not agree to the fact that the website
should be operable by us because we will only be going to upload the document
related to e-learning.

They did not pay any heed to our necessity
or the feature-list which they had agreed upon. Their argument was that the
website is fully functional from their side and they cannot satisfy each and
every demand of the feature-list or the client.

Even in the last meeting, despite of many
lacunae in the present website they demanded the money and denied any further correction.


The reasons for complaining against the company (Technians Softech Pvt Ltd) and claiming our money back
are given below:

1) The website developing
company is denying any further correction to the existing website without the
final payment despite of the agreement that the final payment will be given to
them after the testing phase is passed by us (client) based on the functionalities
described in the agreement.

2) The Technians.com
claims that it is not possible to accomplish each and every point written in
the agreement, our argument is “then why did they agree and claimed money for
the project”. They should have denied the so called impossible task for them, we
would have gone to some other place.

3) Technians.com is
claiming that the agreement and the feature list which were mutually signed by
both parties are not in valid anymore since in one of the clauses it is written
that the validity is for 2 months. Our argument is that the money should be
returned to us with the interest and other compensation (our travel expenses)
since the company had claimed to achieve the target within two months but they
could not do so after seven (7) months.

4) Technians.com also threatened
to hike the fee in between the project to Rs. 15, 000/- per week which shows
their unreliability in future conversations.

5) Technians.com has
threatened us that a website remains in the control of the web developer even
after the final payment so we should be in total agreement to their conditions
in order to keep the website functional.

6) Technians.com also
denied the free service of one year (as mentioned in the agreement) citing the
expiry of validity of the agreement after two (2) months. Our argument is -
then why did they write such misleading information in the agreement, didn’t they
know that they have to serve the customer after two months anyhow for one year.


Before that they told us
once that it has been 6 months so far so your free service is remaining for
only six months more, we argued that the initiation of free service will be
after delivery of the project to the client and the time taken by the
web-developer is not counted as free service as you have already charged us for
that.

7) Technians.com does not
allow us to operate the website and threatens us to charge if we get any errors
in future, our argument is that the errors appear during the development of the
website by the web-developer and not by the client. If by any means the error
appears, the web-developer should sort it without any charge. We are also
apprehensive that this may be one of the ways the Technians.com extracts money
from the customers by deliberately introducing some error and halt the usual
process of the client (as this is e-learning website in which there is
continuous effort of the client to upload content and publish it unlike a
display website in which there is no administrative exercises).

8) Technians.com has kept the website under
its own domain name and is not ready to publish it under the name of
PioneerScholar.com until the final payment. Our argument is that there are many
functions that need to be checked after the website is online so how can we
give you the final payment.

9) Technians.com is also threatening us by
saying that they can sell the website to some other client as they can get much
more money than our remaining balance. Our apprehension is that Technians.com
is deliberately denying us the delivery of the website as they might have got a
customer whom they can sell the website with hefty amount.

10) Technians.com has also denied our
access to the project management system (pms) – technians.com/pms in which the
whole progress of the project is present.

11) Technians.com has also refused to give
the password of our domain registration in godaddy.com in the name of
PioneerScholar.com, now they have captured our precious domain name and may
sell it at a cost of at least Rs.10, 000/-, so our demand is the password of the
registration or equivalent amount of money.

Apart from the above mentioned reasons,
there are a lot of errors and deficiencies in the website that should be
considered in this regard.

I am requesting you please
help me in getting my money (Rs. 42, 000/- principal amount paid by us till 7th
July 2014 plus Rs.1270/- interest @ 6% for 6 months plus Rs.10, 000/- cost of our domain name, plus Rs. 900 for three
trips to Gurgaon (Technians office) equaling Rs.54, 170/-.

So, I request you to
kindly help me get my money back as I have suffered so much. If we fail to curb
nuances of such inexperienced and unscrupulous so-called companies then they
will be targeting more and more innocent people. Please
go through all the email conversations and payment receipts as attachment for
your kind consideration, so that these miscreants may not befool other
credulous people and extract their hard earned money.
