Dear Sir/madam, Vatika customer service team has refused any compensation with regard to delayed possession of our apartment booked in Sep 2009 which is being offered for possession in DEC 2016. this delay is impacting our peace of mind as my family needs move into the apartment soonest. The accumulated delay of about 48 months should be compensated with about Rs 400, 000/- which they refuse to acknowledge. Further I am paying a monthly rent of Rs 1, 25, 000/- ( annually 15Lacs). which is a huge cost to me. The possession letter offered has a disclaimer printed on it which says i shall not claim any delayed delivery compensation etc, i have a copy of same. Q1)What is to be done, Should i sign and accept possession ? or do we hold of and fight a case through consumer court. Q2)Can we take possession and document the duress on email to VATIKA ? Q3)Does this help later to fight for the case? Q4) Can the this issue be resolved having signed the letter and realizing the claim is due at a later date??
