Subject: request for refund with interest and penalty of the plots and land in acrage in the project sushant megapolis phase-2 phase - 3 d-3, but failed to develop and allot till date as per their commitment thus caused brech of trust and faith.
Dear sir,
1. I am ex-soldier, an old man of 76 years of age. As i knew of ansal builders, who at one time, were the biggest/largest and most honest, competent ones and they were the only most renowned builders in the whole country from 1967 onward.
2. Though, i know that the ansals, being the biggest/largest builders have acquired more than 1500 acres or may be even more land in greater noida as they were fully capable and competent to do so. Whatever, they are they have miserably, despondently rather, wretchedly failed in their mission and commitment in the project under subject.
3. It is mentioned that m/s ansal hi-tech townships ltd. Launched a new project named sushant megapolis in jan 2011 located at bodaki, greater noida/noida extension in u. P., and the possession of the plots was to be given after 30 months of booking, extendable by a maximum period of six months but only due to special exigency. Causing any more delay than this, was to draw/attract the penalty clause.
4. As such, taking into consideration the past records of the ansals and my personal knowledge of them, i unhesitatingly invested mine and my whole family’s complete/entire funds, belongings and assets in this project through their vender mr. Rakesh bhardwaj and my investments goes in crores in the project under subject. However, seeing the present performance of the builder, i am repenting and realize that it was most unwise decision on my part.
5. In fact, initially, i booked only two plots each of size 311 sq yds in this project. Later, m/s ansal hi-tech townships ltd. Opened a new lucrative scheme of asking deposits of rs. 35 lac and in-return paying rs. 51 lac to the depositors after a period of 20 months. For this too, i was contacted by the vender, who informed and convinced me of the reliability of the scheme.in this scheme, i deposited/invested rs. 35x3 lac as i had total faith and reliability in the ansal brothers at that time. Accordingly, agreements were executed between m/s ansal hi-tech townships ltd. And us.
6. Further, they have also failed to fulfill their commitment to pay the return of rs.51x3 lac that was due to me after the stipulated time. The worst part of it is that, i was not even informed of the fact as to when the payment of the return was to be made as 20 months were already over. However, later, after some time, on expiry of the due date, i contacted mr. Vivek gupta and mr. On phone regarding the payment. Both these officials kept on befooling me for a long time saying that they are processing the case. Rather, they kept on delaying the case for a couple of months. Later, when i repeatedly kept on reminding them of the payment, they denied to make the payment saying that m/s ansal hi-tech townships ltd. Have no funds/money to pay the dues of the return. Instead they offered to accept land/plot in phase 3, d3 with a firm commitment but all in verbal handover the plots after fully developed in all respects by the year end 2013. Though, i did not want to invest in any of the plots that were being offered, but they refuse to 51x3 lac and forced me to accept the plots at the prevailing rate of rs. 13500/- per sq yds.
7. After expiry of the due date, i regularly kept on asking to give me the possession of the plots from the time the due date was over, but i never received any reply from anyone.
8. As such, when i became desperate, i visited the location of the project. The most horrible, nastiest, awful, evil, terrible, heartbreaking, and miserable fact is that there is no sign of minutest development in the areas where the plots are allotted. What to talk of the stipulated period, even till date there is no sign of any development of the plots.
9. I very well know the reasons of such an inordinate delay and mishap caused by the builders in this matter, but there is no point of my discussing here at this stage, but i am sure they know it very well. Yet, i must say, this mishap has happened due to their greediness and poorest of poor.
10. On having repeatedly following my case, the staff officer called me in their office and suggested me to accept the plots at a new location in the same project, with the same terms and condition as the plots were allotted. They affirmed that they will hand over the plots in fully developed condition.
11. I personally visited the new location where the plots are proposed to be allotted. When i saw this newly proposed site with my own eyes, i was amazed, astounded, shocked and flabbergasted on seeing the location which was totally barren land. Also i observed that even there is no bleakest sign of any kind of development nor expected to be possible in near future for years together.
12. Nevertheless, if no action is taken in my case on the basis of this letter, i will personally discuss the case with each and every authority of the ansal api builders to seek justice, including the general managers, administrators, vice presidents, president, all directors as well as with the chairman cum managing director and i will meet mr. Sushil ansal who is the sole pillar and owner of the entire ansal regime.
13. As such, it is against my conscious to bring out that considering all the facts mentioned in the foregoing paragraphs, i with heavy heart, yet, with due apology, may say rather even a layman will straight way say that it is a case of total lying, cheating, dishonesty, unbelievably, unreliability, immoral, devious, deceitful practices, thus, hoodwinking, deceiving, misleading, prowling, pillaging, marauding, and looting the customers of the builders api ansal in their project sushant megapolis. Thus, i perforce am projecting my request to you for the refund of my total investments.
14. However, i give a proposal to accept the plot and that is, if the plots to be re-allotment must be of the similar size and location e. T. C in phase 1, sector 3a, or 3b or 3c only and nowhere else. It may be noted that the plots to be re-allotted in the proposed location; must be near to your project, where the flats are already constructed by you, and/or must be already handed over or likely to be handed over shortly. The plots to be so re-allotted must be fully developed; ready for construction of the houses on the plots can be started without any delay, failing which the refund must be afforded to me without any delay.
15. In view of the facts explained above, i mainly want the refund of my total investments. The refunded be afforded with interest of @ 12% for 30 months and @ 24% for the remaining period till the investments remained under your custody which is as per the norms as you too charge @ 24% for the delayed payment period. I once again make most sincere request to afford me the refund on most urgently and highest priority basis please or may re-allot the plots as suggested at para 14 above.
