Axis Bank — Harassment by Bank Officials - Personal Loan

Hi, My name is Girish Nair & I took a PL of Rs. 4, 00, 000 from Axis Bank in 2008 Aug/Sep and the tenure of the repayment was 3 years. I paid my EMI's regularly for 2 years (14, 000 per month), after which circumstances were such that I could not pay, as I was without a job; however, i did not run away as my intention was always to clear my debts. I visited the bank branch in Gurgaon in a mall and met the manager, informing him of the situation. He advised me to write a letter to the bank, which I did & was in regular touch with them, discussing as to how we can close it. I kept on telling them that I'm willing to pay but in small amounts as I do not have a job & I'm looking for one.Time & again either my wife or I have been out of job because of which I was not able to pay them, though my intention is to settle the account. But the bank officials Uday Shankar, Rana, Krishnamoorthy, Sahu etc (sem to be fake names), have been troubling me by giving me obnoxious phone calls (phone nos. are [protected], [protected]), threatening me in hindi ("khaal udhed doonga saale", "tujhe uthwaa loonga") and using abusive language etc etc. I really don't know what to do...no way to go, i honestly thought of committing suicide also as im too disturbed by the phone calls & worked up because of the harassment, when my wife suggested that i should write to you directly...Please let me know if you can help me. Hey you have family... Dont panic...
I dont know how my advice will help you but please read carefully.

1. Drop a mail to the customer care of the bank marking the senior authorities of the bank mentioning your situation. Br straight and frank. You paid the EMI for last 2 years not your situation is not permitting you to pay the EMI with such huge amount. You you want a reduction in the EMI for a longer period. As you have taken the loan, so you only have to pay it off. You have no choice but you can ask for a longer period with lower EMI. You can get all the mail id of the senior persons from the bank. Whenever you write a mail to the bank you mark the CIBIL(Mail id you can get from the site)

2. Dont pay anything. Tell them you want to settle your loan at one go. You tell you have no money and your situation is very bad to pay it off. Ask then you need a minimum payment. like 20%/30% of the remaining amount. Whatever the way they follow they can follow but you stick to it... One time come they will silent and agree for settlement with a minimum amount. In this case you name will reflect in CIBIL ad defaulter and in future you will be not eligible for any time of loan or credit card.

Now choice is yours... Dont ever try to commit suicide... Life is for once only.. njoy it dont spoil it... Kepp in thouch and update me.
