Bruhat Bengaluru Mahanagara Palike [BBMP] — Complaint Regarding Illegal Construction And Occupation Of The Public Street And Creating Nuisance Around The Residential.

Dear Sir,

I, Kanakaraj, S/O. Muniswamy, aged 69, residing at House No.185, Mahalingeshwara badawane, Adugodi, past 30 years. I am working as daily wages, painting houses, security guard for a private college. I have five daughters, educated and arranged marriage for four by earning by daily wages, and still looking for alliance for my last daughter.

Background of the issue:

1. I was residing house no.185 till April-2022, it was a very old sheet house. I had applied for government loan scheme to reconstruct this house. The loan got sanctioned in April-2022 and the old sheet house was demolished by the government contract labours to reconstruct. Now the contractor completed the foundation, pillar, constructing the house till slab or window stage. The contractor working on building the slab concrete, staircase.

2. However my neighbor House No.171, Mr. Praveen Kumar, S/o. Pushparaj making on issue, fighting, shouting, abusing language at the government contract labours and not allowing them to continue the construction of government aided house.

3. On August 06, 2022, Saturday, Mr. Vinod Kumar, elder son of Pushparaj, developed an argument with my wife and daughters, when I was not at house. Kept on quarreling and fighting Mr. Vinod Kumar damaged the construction work, concrete materials.

4. In the first week of July-2022, all the three sons of Mr. Pushparaj, i.e. Mr. Vinod Kumar, Mr. Praveen Kumar and Mr. Naveen kumar went on fighting with the government contract labours and stopped the foundation work. However, asking others, elders and neighbors, explaining the fact and managed to continue the construction.

5. On August 12, 2022, Friday, the BBMP filed officers came to our site place basis the compliant launched by S/o. Pushparaj. The field officers have done the measurement and confirmed that, my site, House No. 185 and reconstruction is happening as per the Hakka Pathra or Registration Certificate, which is 15 x 17 Ft. However, Mr. Praveen Kumar S/o. Pushparaj shouting the on the labour and not allowing the construction forcefully and violently.

6. And further, the BBMP field officers confirmed that, Mr. Pushparaj, House No. 171 measurement of built in area is not as per the Hakku Pathra, have occupied the public street and dairy compound sewage water line also.

7. Mr. Pushparaj, House No. 171 measurement is 23.5 x 15.5 Ft. as per Hakku Pathra; however, their built in area is 35.5 x 21 Ft.

Enclosed here with a portrait of my house, my neighbor house, streets and measurements for your kind reference.

1. My house / site is in the corner of the streets between east-west and south-north and the measurement is 15*17 respectively, which is exactly matching with the scale mentioned in the “Hakku Pathra” registration certificate issued by the govt. authority.

2. Mr. Praveen kumar house is off the street of south-north and parallel to my corner house. Therefore the street south-north in between Mr. Pushparaj and my house. The south-north street begins and end till Mr. Pushparaj house by width of 4.8 Feet, However Mr. Pushparaj occupied 2 Feet of the public street and 2 Feet at Daily Compound sewage water line. The ground floor slab and first floor balcony covers the rest of 2.8 Feet of the complete street.

3. Therefore the public street in between my house and Mr. Pushparaj house became narrow, i.e. 2.8 Feet, the common people unable to walk through easy and unable to carry any small house hold things through the street.

4. The has been discussed with Mr. Pushparaj F/o. Praveen kumar when they were constructing their house approximate 10 years back, to leave space for walking passage, i.e. 4.8 Feet as begins the south-north street, and requested not to cover the complete street by the ground floor slabs, first floor the balcony, and construction.

5. All the nearby house elders asked the same to Mr. Pushparaj, However, They denied to remove the 2 Feet of the public street occupation, However, agreed to remove the ground floor slabs, first floor balcony, and construction, which is covering the complete street, i.e. 2.8 Feet, when we reconstructing the old house.

6. Now, we are reconstructing my house aided by government scheme, in the wall beside the street of south-north, could not keep any windows because of Mr. Pushparaj ’s illegal construction and occupation of the public street and there should be no ventilation, air, light to my house which is completely blocked by Mr. Pushparaj ’s illegal construction and occupation of the public street

7. Now, all the three sons of Mr. Pushparaj developing one another issues, arguments and not allowing us or the government contract labours to construct our house aided by government scheme and the stair case.

REQUEST HEREWITH:

Hence, we are requesting you to take action, to remove the illegal construction of 2 feet on the public street and 2.8 Feet of the ground floor slab, first floor balcony, constructions, which covers the complete street.
I am the only man, aged 69 at home residing with my daughter and wife, unable to speak, explain this issue with Mr. Pushparaj and his following three sons, which becomes a very big quarrel and fight:
1. Mr. Vinod Kumar
2. Mr. Praveen Kumar
3. Mr. Naveen Kumar

Requesting your kind intervention and immediate action to enable constructing my house which is government aided with proper ventilation, air, light.
