[Resolved] Club Mahindra Holidays — Refund of initial membership subscription amount | |||
We ( Moni Phukan and Minakshi Phukan) on 14th November 2013, applied for a Club Mahindra Membership after a brief 20 minutes presentation given to us in their Vadodara office. All explanations were verbal and no copy of terms and conditions were given to us for study. An amount Rs.27600.00 was taken from us thru Credit Card as initial processing fee. 1.- On 15th November we finding the offer unsuitable requested for cancellation of the applied membership, personally visiting Club Mahindra Vadodara office. Request denied, cancellation letter was not accepted. 2.-19th November, we again confirmed our desire to cancel again and request for refund of our money. 3.- On 21.st November CM representatives visit us at office and residence insisting us to continue and change plan to suite our requirements. 4.- Under insistence we agree for change in plan . 5.- On 27th Nov Conditions and instruction given to us to submit documents and PDC. As the new conditions were not suitable we again confirmed cancellation. 6. -On 28 Nov we were visited again, talked on phone to continue. 7. -30th Nov, CM representative visit us insisting to continue. We ask for written confirmations of promised offer and facilities. 8. - Written confirmations denied, and CM representative visit us and gives us the copy of Terms and Conditions for the first time. 9.- 7th December we are called again to deposit further amount of money and to continue. We refuse and request for refund. We were told as per terms and conditions we are not eligible for refund. 10-. 11th December we are again called and asked for a meeting. We refuse any further talk on the matter and ask for cancellation and a refund. 11.- Continuous e-mails and personal visit insisting our continuation till date. 12.- On 12th April Club Mahindra demand an amount of Rs. 1160000 from us as Annual subscription amount from us. This is a harassment and a dirty trick to extract money from people. Once an amount is paid Club Mahindra does not accept cancellation which can be clearly seen here. On top of everything they are demanding Annual Subscription Fee from us. We want Club Mahindra Holidays to refund our initial paid amount along with interest. This was my reply to them.
Dear Ms. Ekta
Either you have not read the full content of my mail (which you have attached) or you just do not want to see it and understand. The mail from Priyanka telling me to submit photo ID and co applicants signed letter was after I consistently repeated my wish to cancel. If this is the accepted cancellation procedure then why was the need to send Photo ID and a co applicants signed letter was asked from me before on
1. 15th Nov in visiting your Vadodara office and informing for cancellation by your representative Mr. Chaube and Miss Surrya ?
2. On all telephonic talks and visits made by your representatives ?
3. 28th November when Piyanka was told to stop all procedure ?
4. On 4th December4.
5. Or even on 7th December when Mr. Chaube was categorically told to close the issue.
It is clear that you simply did not accept the cancellation and delay.
6. Why did Mr. Sunil Yadav called me to pursued me to continue ?
7. Why did Mr. Kalpesh again mailed and visited me insisting the same thing even after our saying no so many times?
It again shows your intentions.
8. Your asking us to pay for your ASF amount again confirms that.It is a very obvious tactic you are adopting not to cancel and refund and is not acceptable. All the conversations thru mail are attached here.
