[Resolved]  Dunlop tube for motorcycle — over charging

I have purchased one dunlop tube . The MRP of the product was Rs. 248. But when I demanded the bill the shopkeeper has charged 12.5% tax extra. As per my understanding nobody can charge more than MRP as the MRP includes all the taxes. Please suggest can i lodge an FIR against the shopkeeper. If yes under which section of IPC or other criminal law. thanks

This incident took place on 16th Saturday May at 8:00 PM. My bike back tube got punctured and I was in search of puncture shop. Unluckily I stepped into AAR agencies, #162 Kammanahalli Main road, Bangalore. This was the only shop open at 8:00 PM.

I requested the technician to follow me to get my bike tube issue to be rectified. He was willing to do but the lady who was on the shop said to take my bike which was parked near to Kalpaka restaurant till the shop. Later the tech identified the tube got 2 punctures. One due to a nail and another due to my mistake. People who read this blog never ever move your vehicle if your tube is punctured. This make one more hole in your pocket. When we move our vehicle with out rider the valve will get off the tube due to bike weight. This will force us to buy a new tube. This is the new technique done by the shop to sell tubes.

Now coming to my complaint, since the tube valve came off I have no other option other than to buy a new tyre. There was one more person before me who did the replacement of tyre for 240 RS. I could see one sticker on the Dunlop tyre packet which says 238. I tried to take it out. Alas I could find two shocking things. The first one is the manufacturing date which was 2007 and secondly the price which is 160. I checked with the lady why you are asking extra 80 from me. She asked the technician to stop replacing the tube and asked me to get a new tube from outside. I liked that response at 9:00 PM, she is well aware their wont be any shop open at that time, and she will be the only source to get it rectified. I had no other option other than to pay 240 RS for the Dunlop tube manufactured on 2001 with a price tag of 160.

Later I asked for bill, she provided me a cash bill with serial number 158, there was no license number and bill goes like this. “New Tyre with fitting – 240”. Isn’t a easy money?
The same thing happened with me today morning in HBR layout...I was too late to office so i had requested my friend to take my bike to puncture shop...but unfortunately he did the same thing ( When we move our vehicle with out rider the valve will get off the tube due to bike weight. This will force us to buy a new tube. )

The tube MRP was 240 rs...but he asked us 320 rs... Finally i agreed to pay 300 rs as i was getting late to office...No other option.

Today I visited a Puncher shop near Sarjapur flyover(Iblur Corss), to check my bike tyre. Problem was my bike tire air, was getting emptied in every 4-5 days. He removed the tube and tried some scratching over the tube and found a small damage near the pin.

He then said I need to buy new tube and he had only Dunlop tube which he said is Rs. 380.00 plun fitting chargers.30.00. There was no label or MRP on the tube which he given, when I asked he said, he removed it otherwise if sales tax people raided he has to pay tax for it.

I said, I dont want to buy it and refit my existing tube. Since he tried making some scratches, after fitting air was continuously coming out and not usable condition. There was no way other thank buying it. I said I will pay Rs.350.00 and he started fitting it. After fitting it he I given him Rs.350.00 and he started abusing me for Rs.410.00. After lot of arguiments I decided not to pay any extra and left from there.
