[Resolved]  Illegal Building — Illegal contribution for repairing of building

I the undersigned person, Khalid Yousuf Zariwala, age 50yrs, residing at 103 Faisal Park, First Floor, Mirza Complex, Rashid Compound, Kausa, Behind Millennium Hospital, Mumbra hereby like to file a complaint against Mr Iqbal Murtuza (Flat # 406 fourth floor) and Mr Azad (Flat # 403 fourth floor) both residing at the same building.

On 12th December 2010 at 9.30pm, these two persons came over to our flat along with four persons, and started demanding Rs 10,000 to my wife. When asked why the money was being demanded, they said it is for repairs of the foundation of the building being weak and every resident has to pay this amount. My wife said we do not have this kind of money, they said we will have to pay Rs 10000 or in two installments of Rs 5000 each.

On their way out, Mr Azad threatened my elder son, saying the amount has to be paid within 10 days anyhow, sell your ornaments or anything or else face dire consequences. We shall be back in 10 days to recover the amount and we know how to recover it.

This kind of threatening of dire consequences is a very great concerned to be put attention to it. Let me clarify that these two persons has no rights or any authority for any collection of any amount, for any reason whatsoever. I want you to find out under whose saying these persons are collecting the amount from every flats of the building without having any documentation or authority? I don’t think they have any knowledge also as to how the procedure is followed for any major repairs of the building.


PLEASE NOTE: To apprise you briefly, I have strongly objected to carry out the repairs to the building, as a prior permission is to be obtained from concerned authority.

1.Permission from the builder and all flat owners of 30 flats in writing and the same to be addressed to Thane Municipal Corporation (Property Dep’t) that no structural changes will be made from original building construction plan.

2.Structural Engineers auditors report from Thane Municipal Corporation to know the extent of damage and the work carried out as per their specifications.
3.Housing repair board to issue notice of repair after their inspection (advisable as in case of major repairs after their inspection & advisable as in case of major repairs the tenants may have to be relocated).

4.Importantly, the repairs of the building is the responsibility of the builder as
a)OCCUPATION CERTIFICATE HAS NOT BEEN ISSUED FROM TMC.
b)BUILDING COMPLETION CERTIFICATE FROM BUILDING ARCHITECT.
c)CONVEYANCE OF THE BUILDING HAS NOT BEEN DONE.
d)BUILDING SOCIETY IS NOT FORMED AND REGISTERED NOR AN ADHOC COMMITTEE BEEN FORMED.
